Aanvullend Protocol bij het Algemeen Verdrag nopens de voorrechten en immuniteiten van de Raad van Europa

Article 1 Agreement Any present or future Member of the Council of Europe not a signatory of themay accede to the latter and to this Protocol by depositing its instrument of accession to them both with the Secretary-General of the Council of Europe, who shall notify the Members of the Council thereof. 1953 16 10-02-1953 1956 115 07-09-1956 11-07-1956

Article 2 a) Part IV of the Agreement The provisions ofshall apply to representatives attending meetings of the Ministers' Deputies. b) Part IV of the Agreement The provisions ofshall apply to representatives other than representatives to the Consultative Assembly attending meetings convened by the Council of Europe and held when neither the Committee of Ministers nor the Ministers' Deputies are in session save that representatives attending such meetings shall not be exempt from arrest and prosecution when found committing, attempting to commit, or just having committed an offence. 1953 16 10-02-1953 1956 115 07-09-1956 11-07-1956

Article 3 Article 15 of the Agreement The provisions ofshall apply to representatives to the Assembly, and their substitutes, at any time when they are attending or travelling to and from, meetings of Committees and Sub-Committees of the Consultative Assembly, whether or not the Assembly is itself in session at such time. 1953 16 10-02-1953 1956 115 07-09-1956 11-07-1956

Article 4 The permanent representatives of Members of the Council of Europe shall, while exercising their functions and during their journey to and from the place of meetings, enjoy the privileges, immunities and facilities normally enjoyed by diplomatic envoys of comparable rank. 1953 16 10-02-1953 1956 115 07-09-1956 11-07-1956

Article 5 Privileges, immunities and facilities are accorded to the representatives of Members not for the personal benefit of the individuals concerned, but in order to safeguard the independent exercise of their functions in connection with the Council of Europe. Consequently, a Member has not only the right but the duty to waive the immunity of its representative in any case where, in the opinion of the Member, the immunity would impede the course of justice and it can be waived without prejudice to the purpose for which the immunity is accorded. 1953 16 10-02-1953 1956 115 07-09-1956 11-07-1956

Article 6 The provisions of Article 4 are not applicable in relation to the authorities of the State of which the person is a national or of the Member of which he is or has been a representative. 1953 16 10-02-1953 1956 115 07-09-1956 11-07-1956

Article 7 a) Agreement This Protocol shall be open to signature by all Members which have signed the. The Protocol shall be ratified at the same time as or after the ratification of the Agreement. Instruments of ratification shall be deposited with the Secretary-General of the Council of Europe. b) Agreement This Protocol shall enter into force on the day when it shall have been ratified by all the signatories who at that date have ratified the, on condition that the number of signatories who have ratified the Agreement and the Protocol shall not be fewer than seven. c) As regards any signatory ratifying subsequently, the Protocol shall enter into force at the date of the deposit of its instrument of ratification. d) Agreement In the case of Members which have acceded to theand Protocol in accordance with the terms of Article 1 the Agreement and Protocol shall enter into force: (i) b On the date specified in paragraph () above in cases where the instrument of accession has been deposited prior to this date; or (ii) b On the date of deposit of the instrument of accession in cases where this instrument is deposited at a date subsequent to that specified in paragraph () above. 1953 16 10-02-1953 1956 115 07-09-1956 11-07-1956

Artikel 1 Verdrag Elk tegenwoordig of toekomstig lid van de Raad van Europa, dat hetniet heeft ondertekend, kan toetreden tot dit Verdrag en tot dit Protocol door nederlegging van zijn akte van toetreding tot beide instrumenten bij de Secretaris-Generaal van de Raad van Europa, die van deze nederlegging kennis geeft aan de Leden van de Raad. 1953 16 10-02-1953 1956 115 07-09-1956 11-07-1956

Artikel 2 a) Titel IV van het Verdrag De bepalingen vanzijn van toepassing op de vertegenwoordigers, die vergaderingen van de Plaatsvervangers der Ministers bijwonen. b) Titel IV van het Verdrag De bepalingen vanzijn van toepassing op de vertegenwoordigers (met uitsluiting van de vertegenwoordigers in de Raadgevende Vergadering), die vergaderingen bijwonen welke bijeengeroepen zijn door de Raad van Europa en gehouden worden buiten de zittingen van het Comité van Ministers en van de Plaatsvervangers der Ministers; de vertegenwoordigers, die deze vergaderingen bijwonen, kunnen echter deze immuniteit niet doen gelden bij aanhouding of gerechtelijke vervolging volgend op ontdekking op heterdaad. 1953 16 10-02-1953 1956 115 07-09-1956 11-07-1956

Artikel 3 artikel 15 van het Verdrag De bepalingen vanzijn eveneens van toepassing — of de Raadgevende Vergadering al of niet zitting heeft — op de vertegenwoordigers in de Vergadering alsmede op hun plaatsvervangers, telkens wanneer zij deelnemen aan een vergadering van een commissie of sub-commissie, of op weg zijn naar of van de plaats van samenkomst. 1953 16 10-02-1953 1956 115 07-09-1956 11-07-1956

Artikel 4 De permanente vertegenwoordigers der Leden bij de Raad van Europa genieten, tijdens de uitoefening van hun functie en tijdens hun reizen van en naar de plaats van samenkomst, de voorrechten, immuniteiten en faciliteiten, welke diplomatieke ambtenaren van overeenkomstige rang genieten. 1953 16 10-02-1953 1956 115 07-09-1956 11-07-1956

Artikel 5 Deze voorrechten, immuniteiten en faciliteiten worden toegekend aan de vertegenwoordigers der Leden, niet voor hun persoonlijk voordeel, maar teneinde de onafhankelijke uitoefening van hun functie in verband met de Raad van Europa te verzekeren. Een Lid heeft derhalve niet alleen het recht, maar tevens de plicht van de immuniteit van zijn vertegenwoordiger afstand te doen in al die gevallen, waarin naar het oordeel van het Lid de immuniteit de loop van het recht in de weg zou staan en van de immuniteit afstand kan worden gedaan zonder inbreuk te maken op het doel, waarvoor de immuniteit wordt verleend. 1953 16 10-02-1953 1956 115 07-09-1956 11-07-1956

Artikel 6 De bepalingen van artikel 4 gelden niet voor de autoriteiten van de Staat, waarvan de vertegenwoordiger een onderdaan is, of van het Lid, waarvan hij de vertegenwoordiger is of is geweest. 1953 16 10-02-1953 1956 115 07-09-1956 11-07-1956

Artikel 7 a) Verdrag Dit Protocol is opengesteld ter ondertekening door de Leden, die hethebben ondertekend. Het Protocol zal worden bekrachtigd tegelijkertijd met of na de bekrachtiging van het Verdrag. De akten van bekrachtiging zullen worden nedergelegd bij de Secretaris-Generaal van de Raad van Europa. b) Verdrag Dit Protocol treedt in werking op de dag, dat het bekrachtigd is door alle ondertekenaars, die op die datum hetzullen hebben bekrachtigd, op voorwaarde dat het aantal ondertekenaars, dat het Verdrag en het Protocol heeft bekrachtigd, niet minder is dan zeven. c) Voor de ondertekenaars, die het later zullen bekrachtigen, zal het Protocol in werking treden bij de nederleging van hun akte van bekrachtiging. d) Verdrag Voor de Leden die tot heten het Protocol zijn toegetreden in overeenstemming met artikel 1, treden het Verdrag en het Protocol in werking: i) b op de hierboven in lid () vermelde datum, ingeval de akte van toetreding vóór die datum is nedergelegd, of wel ii) b zodra de akte van toetreding is nedergelegd, ingeval deze nederlegging plaats vindt op een latere datum dan die in bovenstaand lid () vermeld. 1953 16 10-02-1953 1956 115 07-09-1956 11-07-1956
