Article I After the present Agreement between the Netherlands and Indonesia has been signed and ratified by both Contracting Parties, the Netherlands and Indonesia will jointly sponsor a draft resolution in the United Nations under the terms of which the General Assembly of the United Nations takes note of the present Agreement, acknowledges the role conferred upon the Secretary-General of the United Nations therein, and authorizes him to carry out the tasks entrusted to him therein. 1962 77 21-08-1962 1962 160 28-12-1962 21-09-1962

Article II After the adoption of the resolution referred to in Article I, the Netherlands will transfer administration of the territory to a United Nations Temporary Executive Authority (UNTEA), established by and under the jurisdiction of the Secretary-General, upon the arrival of the United Nations Administrator appointed in accordance with article IV. Article III In order to facilitate the transfer of administration to the UNTEA after the adoption of the resolution by the General Assembly, the Netherlands will invite the Secretary-General to send a representative to consult briefly with the Netherlands Governor of the territory prior to the latter's departure. Article V The United Nations Administrator, as chief executive officer of the UNTEA, will have full authority under the direction of the Secretary-General to administer the territory for the period of the UNTEA administration in accordance with the terms of the present Agreement. 1962 77 21-08-1962 1962 160 28-12-1962 21-09-1962

Article VI The United Nations flag will be flown during the period of United Nations administration. With regard to the flying of the Netherlands and Indonesian flags, it is agreed that this matter will be determined by agreement between the Secretary-General and the respective governments. 1962 77 21-08-1962 1962 160 28-12-1962 21-09-1962

Article VII The Secretary-General will provide the UNTEA with such security forces as the United Nations Administrator deems necessary; such forces will primarily supplement existing Papuan (West Irianese) police in the task of maintaining law and order. The Papuan Volunteer Corps, which on the arrival of the United Nations Administrator will cease being part of the Netherlands armed forces, and the Indonesian armed forces in the territory will be under the authority of, and at the disposal of, the Secretary-General for the same purpose. The United Nations Administrator will, to the extent feasible, use the Papuan (West Irianese) police as a United Nations security force to maintain law and order and, at his discretion, use Indonesian armed forces. Article VIII The United Nations Administrator will send periodic reports to the Secretary-General on the principal aspects of the implementation of the present Agreement. Article IX The United Nations Administrator will replace as rapidly as possible top Netherlands officials as defined in Annex A with non-Netherlands, non-Indonesian officials during the first phase of the UNTEA administration which will be completed on 1 May 1963. The United Nations Administrator will be authorized to employ on a temporary basis all Netherlands officials other than top Netherlands officials defined in Annex A, who wish to serve the UNTEA, in accordance with such terms and conditions as the Secretary-General may specify. As many Papuans (West Irianese) as possible will be brought into administrative and technical positions. To fill the remaining required posts, the UNTEA will have authority to employ personnel provided by Indonesia. Article X Immediately after the transfer of administration to the UNTEA, the UNTEA will widely publicize and explain the terms of the present Agreement, and will inform the population concerning the transfer of Administration to Indonesia and the provisions for the act of self-determination as set out in the present Agreement. 1962 77 21-08-1962 1962 160 28-12-1962 21-09-1962

Article XI To the extent that they are consistent with the letter and spirit of the present Agreement, existing laws and regulations will remain in effect. The UNTEA will have the power to promulgate new laws and regulations or amend them within the spirit and framework of the present Agreement. Article XII The United Nations Administrator will have discretion to transfer all or part of the administration to Indonesia at any time after the first phase of UNTEA administration. Article XIII United Nations security forces will be replaced by Indonesian security forces after the first phase of United Nations administration. Article XIV After the transfer of full administrative responsibility to Indonesia, Indonesian national laws and regulations will in principle be applicable in the territory, it being understood that they be consistent with the rights and freedoms guaranteed to the inhabitants under the terms of the present Agreement. New laws and regulations or amendments to the existing ones can be enacted within the spirit of the present Agreement. Article XV After the transfer of full administrative responsibility to Indonesia, the primary task of Indonesia will be further intensification of the education of the people, of the combating of illiteracy, and of the advancement of their social, cultural and economic development. Efforts also will be made in accordance with present Indonesian practice to accelerate the participation of the people in local government through periodic elections. Article XVI At the time of the transfer of full administrative responsibility to Indonesia a number of United Nations experts, as deemed adequate by the Secretary-General after consultation with Indonesia, will be designated to remain wherever their duties require their presence. Their duties will, prior to the arrival of the United Nations Representative, who will participate at the appropriate time in the arrangements for self-determination be limited to advising on and assisting in preparations for carrying out the provisions for self-determination except in so far as Indonesia and the Secretary-General may agree upon their performing other expert functions. Article XVII inter alia, Indonesia will invite the Secretary-General to appoint a Representative who, together with a staff made up,of experts referred to in Article XVI, will carry out the Secretary-General's responsibilities to advise, assist and participate in arrangements which are the responsibility of Indonesia for the act of free choice. The Secretary-General will, at the proper time, appoint the United Nations Representative in order that he and his staff may assume their duties in the territory one year prior to the date of self-determination. Such additional staff as the United Nations Representative might feel necessary will be determined by the Secretary-General after consultations with Indonesia. Article XVIII Indonesia will make arrangements, with the assistance and participation of the United Nations Representative and his staff, to give the people of the territory the opportunity to exercise freedom of choice. Such arrangements will include: a. Consultation (Musjawarah) with the representative councils on procedures and appropriate methods to be followed for ascertaining the freely expressed will of the population. b. The determination of the actual date of the exercise of free choice within the period established by the present Agreement. c. a b Formulation of the questions in such a way as to permit the inhabitants to decide () whether they wish to remain with Indonesia; or () whether they wish to sever their ties with Indonesia. d. The eligibility of all adults, male and female, not foreign nationals to participate in the act of self-determination to be carried out in accordance with international practice, who are resident at the time of the signing of the present Agreement and at the time of the act of self-determination including those residents who departed after 1945 and who return to the territory to resume residence after the termination of Netherlands administration. 1962 77 21-08-1962 1962 160 28-12-1962 21-09-1962

Article XXI After the exercise of the right of self-determination, Indonesia and the United Nations Representative will submit final reports to the Secretary-General who will report to the General Assembly on the conduct of the act of self-determination and the results thereof. Article XXII 1 The UNTEA and Indonesia will guarantee fully the rights, including the rights of free speech, freedom of movement and of assembly of the inhabitants of the area. These rights will include the existing rights of the inhabitants of the territory at the time of the transfer of administration to UNTEA. 2 The UNTEA will take over existing Netherlands commitments in respect of concessions and property rights. 3 After Indonesia has taken over the administration it will honor those commitments which are not inconsistent with the interests and economic development of the people of the territory. A joint Netherlands-Indonesian commission will be set up after the transfer of administration to Indonesia to study the nature of the above-mentioned concessions and property rights. 4 During the period of the UNTEA administration there will be freedom of movement for civilians of Indonesia and Netherlands nationalities to and from the territory. 1962 77 21-08-1962 1962 160 28-12-1962 21-09-1962

Article XXIII Vacancies in the representative councils caused by the departure of Netherlands nationals or for other reasons, will be filled as appropriate consistent with existing legislation by elections, or by appointment by the UNTEA. Article XXIV 1 Deficits in the budget of the territory during the UNTEA administration will be shared equally by the Netherlands and Indonesia. 2 The Netherlands and Indonesia will be consulted by the Secretary-General in the preparation of the UNTEA budget and other financial matters relating to United Nations responsibilities under the present Agreement; however, the Secretary-General will have the final decision. 3 The Parties to the present Agreement will reimburse the Secretary-General for all costs incurred by the United Nations under the present Agreement and will make available suitable funds in advance for the discharge of the Secretary-General's responsibilities. Article XXV The present Agreement will take precedence over any previous agreement on the territory. Article XXVI For the purposes of the present Agreement, the Netherlands and Indonesia will apply to United Nations property, funds, assets and officials the provisions of the Convention on the Privileges and Immunities of the United Nations. In particular, the United Nations Administrator, appointed pursuant to Article IV, and the United Nations Representative, appointed pursuant to Article, XVII, will enjoy the privileges and immunities specified in Section 19 of the Convention on the Privileges and Immunities of the United Nations. 1962 77 21-08-1962 1962 160 28-12-1962 21-09-1962

Article XXVII 1 The present Agreement will be ratified in accordance with the constitutional procedures of the Contracting Parties. 2 The instruments of ratification will be exchanged as soon as possible at the Headquarters of the United Nations by the accredited representatives of the Contracting Parties. 3 The Secretary-General will draw up a procès-verbal of the exchange of the instruments of ratification and will furnish a certified copy thereof to each Contracting Party. 1962 77 21-08-1962 1962 160 28-12-1962 21-09-1962

Article XXVIII 1 The present Agreement will enter into force upon the date of the adoption by the General Assembly of the resolution referred to in Article I of the present Agreement. 2 Upon the entry into force of the present Agreement, the Secretary-General of the United Nations will register it in accordance with Article 102 of the Charter. 1962 77 21-08-1962 1962 160 28-12-1962 21-09-1962

Artikel II Na de aanvaarding van de in artikel I bedoelde resolutie, draagt Nederland het bestuur over het gebied over aan een Tijdelijk Bestuursorgaan van de Verenigde Naties (United Nations Temporary Executive Authority; UNTEA), ingesteld door en onder gezag staand van de Secretaris-Generaal, zodra de ingevolge artikel IV benoemde Bestuurder der Verenigde Naties ter plaatse zal zijn aangekomen. Artikel III Teneinde, na de aanvaarding van de resolutie door de Algemene Vergadering, de overdracht van het bestuur aan het UNTEA te vergemakkelijken, nodigt Nederland de Secretaris-Generaal uit, een vertegenwoordiger te zenden om gedurende korte tijd met de Nederlandse Gouverneur van het gebied vóór diens vertrek overleg te plegen. Artikel V De Bestuurder der Verenigde Naties is als hoogste bewindvoerende functionaris van het UNTEA, volledig bevoegd onder leiding van de Secretaris-Generaal het gebied in overeenstemming met de bepalingen van deze Overeenkomst te besturen gedurende de tijd dat het onder het bestuur van het UNTEA staat. 1962 84 24-08-1962 1962 160 28-12-1962 21-09-1962

Artikel VI 1 De vlag van de Verenigde Naties wordt gevoerd gedurende de periode waarin door de Verenigde Naties het bestuur wordt uitgeoefend. 2 Ten aanzien van het voeren van de Nederlandse en de Indonesische vlag is overeengekomen dat deze kwestie zal worden geregeld in overleg tussen de Secretaris-Generaal en de onderscheiden regeringen. 1962 84 24-08-1962 1962 160 28-12-1962 21-09-1962

Artikel VII De Secretaris-Generaal stelt de door de Bestuurder der Verenigde Naties nodig geoordeelde veiligheidstroepen ter beschikking van het UNTEA; deze troepen dienen in de eerste plaats om de bestaande Papoea-politie (Westirianese politie) aan te vullen voor de handhaving van recht en orde. Het Papoea-Vrijwilligerskorps, dat bij aankomst van de Bestuurder der Verenigde Naties zal ophouden deel uit te maken van de Nederlandse strijdkrachten, en de zich in het gebied bevindende Indonesische strijdkrachten staan voor dezelfde doeleinden onder het gezag van en ter beschikking van de Secretaris-Generaal. De Bestuurder der Verenigde Naties gebruikt zoveel mogelijk de Papoea-politie (Westirianese politie) als veiligheidstroepen van de Verenigde Naties ter handhaving van recht en orde en, indien hij dit wenselijk oordeelt, Indonesische strijdkrachten. De Nederlandse strijdkrachten worden zo snel mogelijk gerepatrieerd en staan, zolang zij zich nog in het gebied bevinden, onder het gezag van het UNTEA. 1962 84 24-08-1962 1962 160 28-12-1962 21-09-1962

Artikel VIII De Bestuurder der Verenigde Naties zendt de Secretaris-Generaal periodiek rapporten betreffende de voornaamste aspecten van de uitvoering van deze Overeenkomst. De Secretaris-Generaal legt uitvoerige rapporten over aan Nederland en Indonesië en kan, wanneer hij dit wenselijk oordeelt, rapporten overleggen aan de Algemene Vergadering of aan alle leden van de Verenigde Naties. 1962 84 24-08-1962 1962 160 28-12-1962 21-09-1962

Artikel IX Gedurende de eerste fase van het bestuur door het UNTEA, welke fase tot 1 mei 1963 loopt, vervangt de Bestuurder der Verenigde Naties zo spoedig mogelijk de in bijlage A aangeduide Nederlandse topfunctionarissen door niet-Nederlandse, niet-Indonesische functionarissen. De Bestuurder der Verenigde Naties is bevoegd, op tijdelijke basis gebruik te maken van alle Nederlandse ambtenaren die niet behoren tot de in bijlage A aangeduide Nederlandse topfunctionarissen en die bereid zijn het UNTEA te dienen op door de Secretaris-Generaal te omschrijven voorwaarden. Zoveel mogelijk Papoea's (West-Irianezen) zullen in bestuurlijke en technische ambten worden aangesteld. Om in de overige nog opengebleven ambten te voorzien heeft het UNTEA de bevoegdheid, door Indonesië beschikbaar gesteld personeel aan te stellen. Artikel X Onmiddellijk na de overdracht van het bestuur aan het UNTEA, geeft het UNTEA op grote schaal bekendheid aan de bepalingen van deze Overeenkomst en licht deze toe; het UNTEA zal de bevolking eveneens inlichten over de overdracht van het bestuur aan Indonesië en de bepalingen ter regeling der uitoefening van het zelfbeschikkingsrecht zoals in deze Overeenkomst vermeld. 1962 84 24-08-1962 1962 160 28-12-1962 21-09-1962

Artikel XI Voor zover zij in overeenstemming zijn met letter en geest van deze Overeenkomst, blijven de bestaande wetten en voorschriften van kracht. Het UNTEA is bevoegd, nieuwe wetten en voorschriften af te kondigen of deze naar geest en opzet van deze Overeenkomst te wijzigen. Artikel XII Het staat de Bestuurder der Verenigde Naties vrij om het gehele bestuur, of een deel daarvan, aan Indonesië over te dragen op elk tijdstip na het einde van de eerste fase van het bestuur door het UNTEA. Artikel XIII Na de eerste fase van het bestuur door het UNTEA worden de veiligheidstroepen der Verenigde Naties vervangen door Indonesische veiligheidstroepen. Artikel XIV Na overdracht van de volledige bestuursverantwoordelijkheid aan Indonesië zijn de Indonesische nationale wetten en voorschriften in beginsel in het gebied van toepassing, mits zij verenigbaar zijn met de rechten en vrijheden die krachtens deze Overeenkomst aan de inwoners worden gewaarborgd. Er kunnen nieuwe wetten en voorschriften of wijzigingen van bestaande worden uitgevaardigd in de geest van deze Overeenkomst. Artikel XV Na de overdracht van de volledige bestuursverantwoordelijkheid aan Indonesië is het in de eerste plaats de taak van Indonesië krachtig voort te gaan met de opvoeding van de bevolking, de bestrijding van het analfabetisme en de bevordering van haar sociale, culturele en economische ontwikkeling. Er wordt tevens naar gestreefd, in overeenstemming met de in Indonesië bestaande praktijk de deelneming van de bevolking aan het plaatselijke bestuur verder te bespoedigen door middel van periodieke verkiezingen. Alle aspecten van de uitoefening der vrije keuze worden beheerst door de bepalingen van deze Overeenkomst. 1962 84 24-08-1962 1962 160 28-12-1962 21-09-1962

Artikel XVI Op het tijdstip van de overdracht van de volledige bestuursverantwoordelijkheid aan Indonesië worden zoveel deskundigen van de Verenigde Naties als de Secretaris-Generaal na overleg met Indonesië voldoende oordeelt, aangewezen om te verblijven op alle plaatsen waar hun werkzaamheden hun aanwezigheid vereisen. Vóór de aankomst van de Vertegenwoordiger van de Verenigde Naties, die, wanneer de tijd gekomen is, deel zal hebben in de regelingen met betrekking tot de zelfbeschikking, blijven hun werkzaamheden beperkt tot advies en bijstand bij de voorbereidingen voor de tenuitvoerlegging der bepalingen inzake de zelfbeschikking, met dien verstande dat Indonesië en de Secretaris-Generaal hun gezamenlijk andere werkzaamheden kunnen toewijzen, waarvoor deskundigen vereist zijn. Artikel XVII Indonesië nodigt de Secretaris-Generaal uit, een vertegenwoordiger aan te stellen, die, tezamen met een staf waarvan ook deskundigen als bedoeld in artikel XVI deel uitmaken, belast zal zijn met de uitvoering van de op de Secretaris-Generaal rustende taak om advies en bijstand te verlenen bij, en deel te hebben in, de regelingen waarvoor Indonesië verantwoordelijk is met het oog op de uitoefening van de vrije keuze. De Secretaris-Generaal stelt op het daarvoor geschikte ogenblik de Vertegenwoordiger van de Verenigde Naties aan, zodat hij en zijn staf hun werkzaamheden in het gebied kunnen aanvangen een jaar voor de datum van zelfbeschikking. Door de Vertegenwoordiger van de Verenigde Naties noodzakelijk geachte aanvullingen van de staf worden vastgesteld door de Secretaris-Generaal, na overleg met Indonesië. De Vertegenwoordiger van de Verenigde Naties en zijn staf genieten dezelfde bewegingsvrijheid als het in artikel XVI bedoelde personeel. 1962 84 24-08-1962 1962 160 28-12-1962 21-09-1962

Artikel XVIII Indonesië treft, met bijstand en bemoeiing van de Vertegenwoordiger van de Verenigde Naties en zijn staf, regelingen om aan de bevolking van het gebied de gelegenheid te geven hun keuze vrijelijk te bepalen. Deze regelingen zullen inhouden: a) overleg (musjawarah) met de vertegenwoordigende raden over procedures en geëigende methoden die moeten worden gevolgd om de vrijelijk tot uitdrukking gebrachte mening van de bevolking te constateren; b) vaststelling van de datum van de feitelijke uitoefening der vrije keuze binnen het in deze Overeenkomst neergelegde tijdvak; c) a b formulering van de vragen op een wijze die de inwoners in staat zal stellen te beslissen () of zij bij Indonesië wensen te blijven; () of zij hun banden met Indonesië wensen te verbreken; d) het recht tot deelneming aan de uitoefening van de zelfbeschikking in overeenstemming met internationaal gebruik van alle volwassenen, zowel mannen als vrouwen, die geen vreemde nationaliteit bezitten en die ingezetenen zijn ten tijde van de ondertekening van deze Overeenkomst en ten tijde van de uitoefening van de zelfbeschikking, daarbij inbegrepen die ingezetenen die na 1945 zijn vertrokken en naar het gebied terugkeren, om zich aldaar na beëindiging van het Nederlands bestuur wederom te vestigen. 1962 84 24-08-1962 1962 160 28-12-1962 21-09-1962

Artikel XXI 1 Na de uitoefening van het zelfbeschikkingsrecht zullen Indonesië en de Vertegenwoordiger van de Verenigde Naties eindrapporten indienen bij de Secretaris-Generaal, die aan de Algemene Vergadering verslag zal uitbrengen over de wijze waarop het zelfbeschikkingsrecht is uitgeoefend, alsmede over de uitslag daarvan. 2 Partijen bij deze Overeenkomst zullen de uitslag van de uitoefening van het zelfbeschikkingsrecht erkennen en er zich aan houden. 1962 84 24-08-1962 1962 160 28-12-1962 21-09-1962

Artikel XXII 1 Het UNTEA en Indonesië garanderen volledig de rechten der inwoners van het gebied, met inbegrip van de vrijheid van meningsuiting, de bewegingsvrijheid en het recht van vereniging en vergadering. Deze rechten omvatten tevens de op het ogenblik van de overdracht van het bestuur aan het UNTEA bestaande rechten der inwoners van het gebied. 2 De bestaande Nederlandse verplichtingen ten aanzien van concessies en eigendomsrechten worden door het UNTEA overgenomen. 3 Nadat Indonesië het bestuur heeft overgenomen, komt het die verplichtingen na, welke niet onverenigbaar zijn met de belangen en de economische ontwikkeling der bevolking van het gebied. Na de overdracht van het bestuur aan Indonesië wordt een gemengde Nederlands-Indonesische commissie ingesteld ter bestudering van de aard der bovengenoemde concessies en eigendomsrechten. 4 Tijdens het bestuur door het UNTEA kunnen burgers van Nederlandse en van Indonesische nationaliteit het gebied vrijelijk binnenreizen en verlaten. 1962 84 24-08-1962 1962 160 28-12-1962 21-09-1962

Artikel XXIII Vacatures in de vertegenwoordigende raden, ontstaan door het vertrek van Nederlandse onderdanen of door andere oorzaken, worden op de daarvoor in aanmerking komende wijze en overeenkomstig de bestaande wetgeving vervuld door middel van verkiezingen of door benoeming door het UNTEA. De vertegenwoordigende raden worden gehoord alvorens tot de benoeming van nieuwe vertegenwoordigers wordt overgegaan. 1962 84 24-08-1962 1962 160 28-12-1962 21-09-1962

Artikel XXIV 1 Tekorten op de begroting van het gebied tijdens het bestuur door het UNTEA worden door Nederland en Indonesië, ieder voor de helft, gedragen. 2 Nederland en Indonesië worden door de Secretaris-Generaal geraadpleegd bij de opstelling van de UNTEA-begroting en ten aanzien van andere financiële aangelegenheden met betrekking tot de verantwoordelijkheden van de Verenigde Naties krachtens deze Overeenkomst; aan de Secretaris-Generaal is evenwel de definitieve beslissing voorbehouden. 3 De Partijen bij deze Overeenkomst zullen de Secretaris-Generaal alle kosten vergoeden, die de Verenigde Naties krachtens deze Overeenkomst maken en de nodige voorschotten verstrekken teneinde de Secretaris-Generaal in staat te stellen zijn taak te vervullen. Artikel XXV Deze Overeenkomst prevaleert over alle eerdere overeenkomsten inzake het gebied. Eerdere verdragen en overeenkomsten met betrekking tot het gebied kunnen derhalve worden beëindigd of, indien noodzakelijk, worden aangepast, zodat zij in overeenstemming zijn met de bepalingen van deze Overeenkomst. 1962 84 24-08-1962 1962 160 28-12-1962 21-09-1962

Artikel XXVI Ter fine van deze Overeenkomst passen de Regering van Indonesië en de Regering van Nederland op de eigendommen, fondsen, bezittingen en functionarissen van de Verenigde Naties de bepalingen toe van het Verdrag nopens de voorrechten en immuniteiten van de Verenigde Naties. Met name genieten de ingevolge artikel IV benoemde Bestuurder der Verenigde Naties en de ingevolge artikel XVII benoemde Vertegenwoordiger van de Verenigde Naties de voorrechten en immuniteiten aangegeven in par. 19 van het Verdrag nopens de voorrechten en immuniteiten van de Verenigde Naties. 1962 84 24-08-1962 1962 160 28-12-1962 21-09-1962

Artikel XXVII 1 Deze Overeenkomst zal worden bekrachtigd in overeenstemming met de grondwettelijke procedures van de Overeenkomstsluitende Partijen. 2 De akten van bekrachtiging worden zo spoedig mogelijk door de geaccrediteerde Vertegenwoordigers van de Overeenkomstsluitende Partijen op het hoofdkwartier van de Verenigde Naties uitgewisseld. 3 De Secretaris-Generaal stelt een proces-verbaal op van de uitwisseling der akten van bekrachtiging en verstrekt een gewaarmerkt afschrift van dat proces-verbaal aan elk der Overeenkomstsluitende Partijen. 1962 84 24-08-1962 1962 160 28-12-1962 21-09-1962

Artikel XXVIII 1 Deze Overeenkomst treedt in werking op de dag waarop de Algemene Vergadering de in artikel I van deze Overeenkomst bedoelde resolutie aanneemt. 2 Zodra deze Overeenkomst in werking is getreden, registreert de Secretaris-Generaal van de Verenigde Naties haar overeenkomstig artikel 102 van het Handvest. 1962 84 24-08-1962 1962 160 28-12-1962 21-09-1962
