Overeenkomst tussen de Lid-Staten van de Raad van Europa betreffende het uitreiken aan militaire en burger-oorlogsinvaliden van een internationaal bonboekje voor het herstellen van prothesen en orthopedische apparaten

Article 1 1 There shall be instituted an international book of vouchers for the repair of prosthetic and orthopaedic appliances, which will be issued solely to military and civilian war-disabled. 2 The book will be issued and used according to the conditions laid down in the Regulations appended to this Agreement. 1963 176 22-11-1963 1964 141 30-09-1964 22-06-1964

Article 4 1 This Agreement shall be open to signature by the member States of the Council of Europe, who may become Parties to it either by: (a) signature without reservation in respect of ratification or acceptance, or (b) signature with reservation in respect of ratification or acceptance, followed by ratification or acceptance. 2 Instruments of ratification or acceptance shall be deposited with the Secretary-General of the Council of Europe. 1963 176 22-11-1963 1964 141 30-09-1964 22-06-1964

Article 5 1 This Agreement shall enter into force one month after the date on which three member States of the Council shall, in accordance with the provisions of Article 4, have signed the Agreement without reservation in respect of ratification or acceptance or shall have deposited their instrument of ratification or acceptance. 2 As regards any member States who shall subsequently sign the Agreement without reservation in respect of ratification or acceptance or who shall ratify or accept it, the Agreement shall enter into force one month after the date of such signature or the date of deposit of the instrument of ratification or acceptance. 1963 176 22-11-1963 1964 141 30-09-1964 22-06-1964

Article 6 1 After the entry into force of this Agreement, the Committee of Ministers of the Council of Europe may invite any non-member State to accede to the present Agreement. 2 Such accession shall be effected by depositing with the Secretary-General of the Council of Europe an instrument of accession which shall take effect one month after the date of its deposit. 1963 176 22-11-1963 1964 141 30-09-1964 22-06-1964

Article 7 1 Any Contracting Party may at the time of signature or when depositing its instrument of ratification, acceptance or accession, specify the territory or territories to which this Agreement shall apply. 2 Any Contracting Party may when depositing its instrument of ratification, acceptance or accession or at any later date, by declaration addressed to the Secretary-General of the Council of Europe, extend this Agreement to any other territory or territories specified in the declaration and for whose international relations it is responsible or on whose behalf it is authorised to give undertakings. 3 Any declaration made in pursuance of the preceding paragraph may, in respect of any territory mentioned in such declaration, be withdrawn according to the procedure laid down in Article 8 of this Agreement. 1963 176 22-11-1963 1964 141 30-09-1964 22-06-1964

Article 8 1 This Agreement shall remain in force indefinitely. 2 Any Contracting Party may, insofar as it is concerned, denounce this Agreement by means of a notification addressed to the Secretary-General of the Council of Europe. 3 Such denunciation shall take effect six months after the date of receipt by the Secretary-General of such notification. 1963 176 22-11-1963 1964 141 30-09-1964 22-06-1964

Article 9 The Secretary-General of the Council of Europe shall notify the member States of the Council and the Government of any State which has acceded to this Agreement of: (a) any signature without reservation in respect of ratification or acceptance; (b) any signature with reservation in respect of ratification or acceptance; (c) the deposit of any instrument of ratification, acceptance or accession; (d) any date of entry into force; (e) any amendment to the Regulations made in accordance with Article 3; (f) any declaration received in pursuance of the provisions of paragraphs 2 and 3 of Article 7; (g) any notification received in pursuance of the provisions of Article 8 and the date on which denunciation takes effect. 1963 176 22-11-1963 1964 141 30-09-1964 22-06-1964

Article 1 The purpose of this book, a specimen copy of which is attached hereto, is to enable any military or civilian war-disabled, when travelling or temporarily residing abroad, to have their prosthetic or orthopaedic appliances repaired free of charge. Article 2 This book shall be issued by the competent organisation responsible for providing such appliances to any military or civilian war disabled within its purview who wishes to travel or temporarily reside abroad. 1963 176 22-11-1963 1964 141 30-09-1964 22-06-1964

Article 3 This book must comply with the following specifications: It will be printed in the language or languages prescribed by the law of the issuing Contracting Party and in one of the official languages of the Council of Europe. Article 5 The holder of this book, which must not be defaced or altered, is entitled to have the prosthetic or orthopaedic appliances which he has to wear in connection with his war disability, repaired free of charge by the supplier approved by the official organisations of the country where he has his temporary residence. 1963 176 22-11-1963 1964 141 30-09-1964 22-06-1964

Article 6 In order to obtain repayment of the cost of the repairs carried out, the supplier should send Coupon No. 2 of the book to the competent organisation responsible in his country for the supply of appliances to military and civilian war-disabled. This Coupon No. 2, and also Coupon No. 1, must bear details of the nature and cost of repairs carried out. The supplier may only charge the price refunded by the competent organisation responsible in his country for the supply of appliances to military and civilian war-disabled nationals. 1963 176 22-11-1963 1964 141 30-09-1964 22-06-1964

Article 7 The competent organisation of the supplier's country, responsible for the supply of appliances to military and civilian war-disabled, will check the necessity and suitability of the price demanded and will pay to the supplier the cost of repairs carried out. 1963 176 22-11-1963 1964 141 30-09-1964 22-06-1964

Article 8 The Contracting Parties will each year settle among themselves the accounts arising from the costs of repairs carried out for the benefit of their war-disabled and will determine, where necessary, the authorities competent for that purpose. 1963 176 22-11-1963 1964 141 30-09-1964 22-06-1964

Article 9 Books will not be renewed until fully used up and duly handed in, with the counterfoils intact, to the holder's organisation mentioned under Article 2. 1963 176 22-11-1963 1964 141 30-09-1964 22-06-1964

Article 10 As soon as he returns to his home country the war-disabled person is to report any repairs which may have been carried out to the competent organisation of his home country, sending in the book of vouchers at the same time. 1963 176 22-11-1963 1964 141 30-09-1964 22-06-1964

Article 11 Any person fraudulently acquiring or using this book may render himself liable to prosecution under the laws and regulations in force in the country of the organisation mentioned under Article 2. In the case of fraudulent use of the book, the costs involved shall be refunded by the war-disabled person; these costs can be reclaimed from him through administrative channels. IMPORTANT THIS BOOK IS NOT TRANSFERABLE PENALTIES The holder of this book, which must not be defaced or altered, is entitled to have the prosthetic and orthopaedic appliances which he has to wear in connection with his war disability, repaired free of charge by the supplier accredited by the official organisations of the country where he has his temporary residence. Description and type of these appliances: ……….... As soon as he returns to his home country, the war-disabled person is required to report any repairs which may have been carried out to the competent organisation of his home country, at the same time sending in the book of vouchers. Artikel 4 1 Deze Overeenkomst staat ter ondertekening open voor de Lid-Staten van de Raad van Europa, die er partij bij kunnen worden door: (a) ondertekening zonder voorbehoud van bekrachtiging of aanvaarding, of (b) ondertekening onder voorbehoud van bekrachtiging of aanvaarding, gevolgd door bekrachtiging of aanvaarding. 2 De akten van bekrachtiging of aanvaarding worden nedergelegd bij de Secretaris-Generaal van de Raad van Europa. 1963 176 22-11-1963 1964 141 30-09-1964 22-06-1964

Artikel 5 1 Deze Overeenkomst treedt in werking een maand na de datum waarop drie Lid-Staten van de Raad, overeenkomstig de bepalingen van artikel 4, de Overeenkomst zonder voorbehoud van bekrachtiging of aanvaarding hebben ondertekend of hun akte van bekrachtiging of aanvaarding hebben nedergelegd. 2 Voor iedere Lid-Staat die deze Overeenkomst op een later tijdstip zonder voorbehoud van bekrachtiging of aanvaarding ondertekent, of die haar bekrachtigt of aanvaardt, treedt deze Overeenkomst in werking een maand na de datum van ondertekening of van de nederlegging van de akte van bekrachtiging of aanvaarding. 1963 176 22-11-1963 1964 141 30-09-1964 22-06-1964

Artikel 6 1 Na de inwerkingtreding van deze Overeenkomst kan het Comité van Ministers van de Raad van Europa iedere staat die geen lid is van de Raad uitnodigen tot deze Overeenkomst toe te treden. 2 De toetreding geschiedt door nederlegging bij de Secretaris-Generaal van de Raad van Europa van een akte van toetreding, welke van kracht wordt een maand na de datum van deze nederlegging. 1963 176 22-11-1963 1964 141 30-09-1964 22-06-1964

Artikel 7 1 Iedere Overeenkomstsluitende Partij kan ten tijde van de ondertekening of bij de nederlegging van haar akte van bekrachtiging, aanvaarding of toetreding bepalen op welk gebied of welke gebieden deze Overeenkomst van toepassing is. 2 Iedere Overeenkomstsluitende Partij kan ten tijde van de nederlegging van haar akte van bekrachtiging, aanvaarding of toetreding, of op een later tijdstip, door middel van een aan de Secretaris-Generaal van de Raad van Europa gerichte verklaring, deze Overeenkomst uitbreiden tot ieder ander gebied of alle andere gebieden in deze verklaring genoemd, waarvan zij de internationale betrekkingen behartigt, of in naam waarvan zij bevoegd is verbintenissen aan te gaan. 3 Elke overeenkomstig het vorig lid afgelegde verklaring kan, met betrekking tot ieder in zulk een verklaring aangegeven gebied, worden ingetrokken, met inachtneming van het bepaalde in artikel 8 van deze Overeenkomst. 1963 176 22-11-1963 1964 141 30-09-1964 22-06-1964

Artikel 8 1 Deze Overeenkomst blijft voor onbepaalde tijd van kracht. 2 Iedere Overeenkomstsluitende Partij kan harerzijds deze Overeenkomst opzeggen door daarvan mededeling te doen aan de Secretaris-Generaal van de Raad van Europa. 3 Deze opzegging wordt van kracht zes maanden na de ontvangst van deze mededeling door de Secretaris-Generaal. 1963 176 22-11-1963 1964 141 30-09-1964 22-06-1964

Artikel 9 De Secretaris-Generaal van de Raad van Europa doet de Lid-Staten van de Raad en de Regering van iedere tot de Overeenkomst toegetreden Staat mededeling van: (a) iedere ondertekening zonder voorbehoud van bekrachtiging of aanvaarding; (b) iedere ondertekening onder voorbehoud van bekrachtiging of aanvaarding; (c) de nederlegging van iedere akte van bekrachtiging, aanvaarding of toetreding; (d) iedere datum van inwerkingtreding; (e) iedere wijziging in de voorschriften, daarin aangebracht overeenkomstig het bepaalde in artikel 3; (f) iedere verklaring die wordt ontvangen krachtens het bepaalde in de leden 2 en 3 van artikel 7; (g) iedere mededeling die wordt ontvangen krachtens het bepaalde in artikel 8 en van de datum waarop de opzegging in werking treedt. 1963 176 22-11-1963 1964 141 30-09-1964 22-06-1964

Artikel 1 1) [Red: Zie Annex Regulations concerning the use of the international book of vouchers for the repair of prosthetic and orthopaedic appliances.] Het doel van dit boekje, waarvan een model is bijgevoegdis alle militaire en burgerlijke oorlogsinvaliden, die op reis zijn in het buitenland of daar tijdelijk verblijven, in de gelegenheid te stellen hun prothesen of orthopedische apparaten kosteloos te doen herstellen. Artikel 2 Dit boekje wordt door de voor de verstrekking van dergelijke apparaten verantwoordelijke bevoegde instantie uitgereikt aan iedere onder haar ressorterende militaire of burgerlijke oorlogsinvalide, die voornemens is een buitenlandse reis te maken of tijdelijk in het buitenland denkt te verblijven. 1963 176 22-11-1963 1964 141 30-09-1964 22-06-1964

Artikel 3 Dit boekje moet aan de volgende eisen voldoen: Het zal worden gedrukt in de bij de wet van de betreffende Overeenkomstsluitende Partij voorgeschreven taal of talen en in een der officiële talen van de Raad van Europa. Artikel 5 De houder van dit boekje - dat niet mag worden beschadigd en waarin geen wijzigingen mogen worden aangebracht - is gerechtigd de prothesen of orthopedische apparaten die hij in verband met zijn in de oorlog opgelopen invaliditeit moet dragen, door de als zodanig door de officiële instanties van het land waar hij tijdelijk verblijft erkende leverancier, kosteloos te doen herstellen. 1963 176 22-11-1963 1964 141 30-09-1964 22-06-1964

Artikel 6 Ter verkrijging van vergoeding van de kosten van de uitgevoerde reparaties dient de leverancier bon 2 uit het boekje in te zenden aan de in eigen land voor het verstrekken van dergelijke apparaten aan militaire en burgerlijke oorlogsinvaliden verantwoordelijke instantie. Zowel op deze bon als op bon 1 dienen bijzonderheden te worden vermeld inzake de aard en de kosten van de uitgevoerde reparaties. De leverancier mag niet meer in rekening brengen dan het bedrag dat in zijn land wordt vergoed door de instantie verantwoordelijk voor de verstrekking van dergelijke apparaten aan militaire en burgerlijke oorlogsinvaliden die onderdaan van dat land zijn. 1963 176 22-11-1963 1964 141 30-09-1964 22-06-1964

Artikel 7 De voor de verstrekking van dergelijke apparaten aan militaire en burgerlijke oorlogsinvaliden verantwoordelijke bevoegde instantie in het land van de leverancier controleert de redelijkheid en de grootte van het gevraagde bedrag en betaalt het met de uitgevoerde reparaties gemoeide bedrag aan de leverancier uit. 1963 176 22-11-1963 1964 141 30-09-1964 22-06-1964

Artikel 8 Ieder jaar zullen de Overeenkomstsluitende Partijen onderling de rekeningen vereffenen die verband houden met de kosten van reparaties die zijn uitgevoerd ten behoeve van haar oorlogsinvaliden en zullen, indien nodig, de daartoe bevoegde instanties aanwijzen. 1963 176 22-11-1963 1964 141 30-09-1964 22-06-1964

Artikel 9 Een boekje wordt niet eerder vernieuwd dan nadat alle bonnen zijn gebruikt en het, met alle strookjes intact, bij de in artikel 2 genoemde instantie die het aan de houder heeft uitgereikt, is ingeleverd. 1963 176 22-11-1963 1964 141 30-09-1964 22-06-1964

Artikel 10 Zodra de oorlogsinvalide in zijn eigen land is teruggekeerd, dient hij eventueel verrichte reparaties aan de in zijn eigen land bevoegde instantie te melden, onder gelijktijdige inzending van het bonboekje. 1963 176 22-11-1963 1964 141 30-09-1964 22-06-1964

Artikel 11 Een ieder die dit boekje onrechtmatig verkrijgt of gebruikt, stelt zich bloot aan strafvervolging overeenkomstig de in het land van de in artikel 2 genoemde instantie geldende wetten en bepalingen. In geval van onrechtmatig gebruik van het boekje wordt het daarmede gemoeide bedrag door de oorlogsinvalide terugbetaald; dit bedrag kan langs officiële weg bij hem worden ingevorderd.
