Article II Co-operation of the national authorities with the United Nations 1 The States Parties to the present Protocol undertake to cooperate with the Office of the United Nations High Commissioner for Refugees, or any other agency of the United Nations which may succeed it, in the exercise of its functions, and shall in particular facilitate its duty of supervising the application of the provisions of the present Protocol. 2 In order to enable the Office of the High Commissioner, or any other agency of the United Nations which may succeed it, to make reports to the competent organs of the United Nations, the States Parties to the present Protocol undertake to provide them with the information and statistical data requested, in the appropriate form, concerning: (a) The condition of refugees; (b) The implementation of the present Protocol; (c) Laws, regulations and decrees which are, or may hereafter be, in force relating to refugees. 1967 76 06-06-1967 29-11-1968 1968 183 31-12-1968 29-11-1968

Article III Information on national legislation The States Parties to the present Protocol shall communicate to the Secretary-General of the United Nations the laws and regulations which they may adopt to ensure the application of the present Protocol. 1967 76 06-06-1967 29-11-1968 1968 183 31-12-1968 29-11-1968

Article IV Settlement of disputes Any dispute between States Parties to the present Protocol which relates to its interpretation or application and which cannot be settled by other means shall be referred to the International Court of Justice at the request of any one of the parties to the dispute. 1967 76 06-06-1967 29-11-1968 1968 183 31-12-1968 29-11-1968

Article V Accession Convention The present Protocol shall be open for accession on behalf of all States Parties to theand of any other State Member of the United Nations or member of any of the specialized agencies or to which an invitation to accede may have been addressed by the General Assembly of the United Nations. Article VI Federal clause In the case of a Federal or non-unitary State, the following provisions shall apply: (a) Convention With respect to those articles of theto be applied in accordance with article I, paragraph 1, of the present Protocol that come within the legislative jurisdiction of the federal legislative authority, the obligations of the Federal Government shall to this extent be the same as those of States Parties which are not Federal States; (b) Convention With respect to those articles of theto be applied in accordance with article I, paragraph 1, of the present Protocol that come within the legislative jurisdiction of constituent States, provinces or cantons which are not, under the constitutional system of the federation, bound to take legislative action, the Federal Government shall bring such articles with a favourable recommendation to the notice of the appropriate authorities of States, provinces or cantons at the earliest possible moment; (c) Convention A Federal State Party to the present Protocol shall, at the request of any other State Party hereto transmitted through the Secretary-General of the United Nations, supply a statement of the law and practice of the Federation and its constituent units in regard to any particular provision of theto be applied in accordance with article I, paragraph 1, of the present Protocol, showing the extent to which effect has been given to that provision by legislative or other action. 1967 76 06-06-1967 29-11-1968 1968 183 31-12-1968 29-11-1968

Article VII Reservations and declarations 1 Convention 1 3 4 16 (1) 33 At the time of accession, any State may make reservations in respect of article IV of the present Protocol and in respect of the application in accordance with article I of the present Protocol of any provisions of theother than those contained in articles,,,andthereof, provided that in the case of a State Party to the Convention reservations made under this article shall not extend to refugees in respect of whom the Convention applies. 2 Convention article 42 Reservations made by States Parties to thein accordance withthereof shall, unless withdrawn, be applicable in relation to their obligations under the present Protocol. 3 Any State making a reservation in accordance with paragraph 1 of this article may at any time withdraw such reservation by a communication to that effect addressed to the Secretary-General of the United Nations. 4 article 40, paragraphs 1 and 2, of the Convention article 44, paragraph 3, of the Convention mutatis mutandis Declaration made underby a State Party thereto which accedes to the present Protocol shall be deemed to apply in respect of the present Protocol, unless upon accession a notification to the contrary is addressed by the State Party concerned to the Secretary-General of the United Nations. Article VIII Entry into force 1 The present Protocol shall come into force on the day of deposit of the sixth instrument of accession. 2 For each State acceding to the Protocol after the deposit of the sixth instrument of accession, the Protocol shall come into force on the date of deposit by such State of its instrument of accession. 1967 76 06-06-1967 29-11-1968 1968 183 31-12-1968 29-11-1968

Article IX Denunciation 1 Any State Party hereto may denounce this Protocol at any time by a notification addressed to the Secretary-General of the United Nations. 2 Such denunciation shall take effect for the State Party concerned one year from the date on which it is received by the Secretary-General of the United Nations. 1967 76 06-06-1967 29-11-1968 1968 183 31-12-1968 29-11-1968

Article X Notifications by the Secretary-General of the United Nations The Secretary-General of the United Nations shall inform the States referred to in article V above of the date of entry into force, accessions, reservations and withdrawals of reservations to and denunciations of the present Protocol, and of declarations and notifications relating hereto. 1967 76 06-06-1967 29-11-1968 1968 183 31-12-1968 29-11-1968

Article XI Deposit in the archives of the Secretariat of the United Nations A copy of the present Protocol, of which the Chinese, English, French, Russian and Spanish texts are equally authentic, signed by the President of the General Assembly and by the Secretary-General of the United Nations, shall be deposited in the archives of the Secretariat of the United Nations. Artikel I Algemeen 1 artikelen 2 tot en met 34 van het Verdrag De Staten welke partij zijn bij dit Protocol verplichten zich detoe te passen op vluchtelingen zoals hieronder omschreven. 2 Verdrag Voor de toepassing van dit Protocol wordt onder „vluchteling” verstaan, behalve wat betreft de toepassing van het derde lid van dit artikel, elke persoon die aan de omschrijving vervat in het eerste artikel van hetvoldoet, alsof de zinsneden „ten gevolge van gebeurtenissen welke vóór 1 januari 1951 hebben plaats gevonden”, en „ten gevolge van bovenbedoelde gebeurtenissen” uit artikel 1 A, lid 2, waren weggelaten. 3 Verdrag Dit Protocol is zonder enige geografische begrenzing van toepassing op alle Staten welke hierbij partij zijn, met dien verstande dat de verklaringen die overeenkomstig het bepaalde in artikel 1 B (1) (a) van hetzijn afgelegd door Staten die reeds partij zijn bij het Verdrag eveneens onder dit Protocol van toepassing zijn, tenzij de verplichtingen van de verklarende Staat op grond van het bepaalde in artikel 1 B (2) van het Verdrag zijn uitgebreid. 1967 76 06-06-1967 29-11-1968 1968 183 31-12-1968 29-11-1968

Artikel II Samenwerking van de nationale autoriteiten met de Verenigde Naties 1 De Staten welke partij zijn bij dit Protocol verbinden zich om met het Bureau van de Hoge Commissaris van de Verenigde Naties voor de Vluchtelingen of elke andere organisatie van de Verenigde Naties die het mocht opvolgen samen te werken in de uitoefening van zijn functie en zullen in het bijzonder zijn taak om toe te zien op de toepassing van de bepalingen van dit Protocol vergemakkelijken. 2 Teneinde het Bureau van de Hoge Commissaris of elke andere organisatie van de Verenigde Naties die het mocht opvolgen in staat te stellen rapporten in te dienen bij de bevoegde organen van de Verenigde Naties, verbinden de Staten welke partij zijn bij dit Protocol zich om aan eerstgenoemde organisatie in de daarvoor in aanmerking komende vorm de gevraagde inlichtingen en statistische gegevens te verschaffen betreffende: a) de status van vluchtelingen; b) de tenuitvoerlegging van dit Protocol; c) de wetten, voorschriften en besluiten welke met betrekking tot vluchtelingen van kracht zijn of van kracht zullen worden. 1967 76 06-06-1967 29-11-1968 1968 183 31-12-1968 29-11-1968

Artikel III Inlichtingen betreffende de nationale wetten en voorschriften De Staten welke partij zijn bij dit Protocol zullen aan de Secretaris-Generaal van de Verenigde Naties mededeling doen van de wetten en voorschriften welke zij mochten aannemen om de toepassing van dit Protocol te verzekeren. 1967 76 06-06-1967 29-11-1968 1968 183 31-12-1968 29-11-1968

Artikel IV Beslechting van geschillen Elk geschil tussen partijen bij dit Protocol betreffende de uitlegging en de toepassing daarvan en dat niet op andere wijze kan worden beslecht, zal op verzoek van een van de partijen bij het geschil aan het Internationale Gerechtshof worden voorgelegd. 1967 76 06-06-1967 29-11-1968 1968 183 31-12-1968 29-11-1968

Artikel V Toetreding Verdrag Dit Protocol staat open voor toetreding door alle Staten welke partij zijn bij het, alsmede door elke Staat die lid is van de Verenigde Naties of van een van de gespecialiseerde organisaties dan wel door elke Staat aan wie de Algemene Vergadering van de Verenigde Naties een uitnodiging tot toetreding tot het Protocol heeft gericht. Artikel VI Federale clausule In het geval van een federale of niet-eenheidsstaat, zijn de volgende bepalingen van toepassing: a) Verdrag Wat betreft de artikelen van hetdie van toepassing zijn ingevolge artikel I, eerste lid, van dit Protocol en die vallen binnen de wetgevende bevoegdheid van de federale wetgevende macht zullen de verplichtingen van de federale Regering in dit opzicht dezelfde zijn als die van de partijen die geen federale Staten zijn. b) Verdrag Wat betreft de artikelen van hetdie van toepassing zijn ingevolge artikel I, eerste lid, van dit Protocol en die vallen binnen de wetgevende bevoegdheid van elk van de samenstellende staten, provincies of kantons, die krachtens het constitutionele stelsel van de federatie niet gehouden zijn wetgevende maatregelen te nemen, zal de federale Regering bedoelde artikelen zo spoedig mogelijk met een gunstige aanbeveling ter kennis brengen van de bevoegde autoriteiten der staten, provincies of kantons. c) Verdrag Een federale Staat die partij is bij dit Protocol zal, op het door tussenkomst van de Secretaris-Generaal van de Verenigde Naties overgebrachte verzoek van enige andere Staat die partij is bij dit Protocol, een uiteenzetting verstrekken van de in de federatie en haar samenstellende delen geldende wetten en gebruiken met betrekking tot enige bepaling van hetdie toegepast moet worden overeenkomstig artikel I, eerste lid, van dit Protocol, waaruit blijkt in hoeverre door een wettelijke of andere maatregel uitvoering is gegeven aan die bepaling. 1967 76 06-06-1967 29-11-1968 1968 183 31-12-1968 29-11-1968

Artikel VII Voorbehouden en verklaringen 1 Verdrag artikelen 1 3 4 16 (1) 33 Bij de toetreding mag elke Staat voorbehouden maken ten aanzien van artikel IV van dit Protocol en ten aanzien van de toepassing overeenkomstig artikel I van dit Protocol, van alle bepalingen van het, met uitzondering van de,,,en, mits, in het geval van een Staat welke partij is bij het Verdrag, de voorbehouden krachtens dit artikel gemaakt geen betrekking hebben op vluchtelingen op wie het Verdrag van toepassing is. 2 artikel 42 van het Verdrag De voorbehouden van de Staten welke partij zijn bij het Verdrag overeenkomstig het bepaalde inzijn, tenzij ze zijn ingetrokken, van toepassing op de verplichtingen die uit dit Protocol voortvloeien. 3 Elke Staat die overeenkomstig het bepaalde in het eerste lid van dit artikel een voorbehoud maakt kan dit te allen tijde intrekken door middel van een daartoe strekkende mededeling aan de Secretaris-Generaal van de Verenigde Naties. 4 artikel 40, eerste en tweede lid, van het Verdrag artikel 44, derde lid, van het Verdrag mutatis mutandis, De verklaringen overeenkomstig, afgelegd door een Staat welke partij is bij het Verdrag en toetreedt tot dit Protocol, worden geacht van toepassing te zijn met betrekking tot dit Protocol, tenzij bij de toetreding de desbetreffende Staat welke partij is bij het Verdrag een daaraan tegengestelde kennisgeving richt aan de Secretaris-Generaal van de Verenigde Naties. Artikel VIII Inwerkingtreding 1 Dit Protocol zal in werking treden op de dag van de nederlegging van de zesde akte van toetreding. 2 Voor elke Staat die tot het Protocol toetreedt na de nederlegging van de zesde akte van toetreding, zal het Protocol in werking treden op de dag van de nederlegging van de akte van toetreding van die Staat. 1967 76 06-06-1967 29-11-1968 1968 183 31-12-1968 29-11-1968

Artikel IX Opzegging 1 Elke Staat welke partij is bij dit Protocol kan dit te allen tijde opzeggen door middel van een aan de Secretaris-Generaal van de Verenigde Naties gerichte kennisgeving. 2 De opzegging zal voor de betrokken Staat van kracht worden één jaar na de datum waarop zij door de Secretaris-Generaal van de Verenigde Naties is ontvangen. 1967 76 06-06-1967 29-11-1968 1968 183 31-12-1968 29-11-1968

Artikel X Kennisgeving door de Secretaris-Generaal van de Verenigde Naties De Secretaris-Generaal van de Verenigde Naties zal wat dit Protocol betreft aan alle Staten bedoeld in artikel V mededeling doen van de data van inwerkingtreding, van toetreding, van nederlegging en intrekking van voorbehouden, van opzeggingen en van verklaringen en kennisgevingen die daarop betrekking hebben. 1967 76 06-06-1967 29-11-1968 1968 183 31-12-1968 29-11-1968

Artikel XI Nederlegging van het Protocol in het archief van het Secretariaat van de Verenigde Naties Een exemplaar van dit Protocol waarvan de Engelse, de Chinese, de Spaanse en de Russische tekst gelijkelijk authentiek zijn, ondertekend door de President van de Algemene Vergadering en door de Secretaris-Generaal van de Verenigde Naties, zal worden nedergelegd in het archief van het Secretariaat van de Organisatie.
