Overeenkomst betreffende de vrijwillige bijdragen bestemd voor de uitvoering van het project tot het behoud van de tempels van Philae

Article I 1 Every Contracting Member State or Associate Member of Unesco undertakes to contribute to the execution of the project to save the temples of Philae by making a contribution in kind or by paying into the Trust Fund established for this purpose by the Director-General of the United Nations Educational, Scientific and Cultural Organization, hereinafter referred to as “the Director-General”, the amounts set forth in the Annex to this Agreement, in the currency, on the dates and under the conditions specified in the said Annex. 2 The Director-General will not transmit any amount that may have been deposited with him to the competent authorities of the United Arab Republic, nor will he take any steps to make contributions in kind available to these authorities, until such time as the Government of the United Arab Republic has finally given an assurance that it will undertake the operations to save the temples of Philae and take the necessary measures for their satisfactory completion and that it will conclude for that purpose, with one or more contractors, the contract for the work described in the specifications drawn up by the Ministry of Culture of the United Arab Republic (Salvage of the Temples of Philae). 1972 6 17-01-1972 1972 41 10-04-1972 23-03-1972

Article II 1 The Director-General will obtain all the necessary particulars regarding the payment dates with which the United Arab Republic will have to reckon in executing the contract referred to in Article I, paragraph 2. He will also receive periodical progress reports. 2 He will pay the amounts which he receives in conformity with the terms of Article I, paragraph 1, and in accordance with the procedure laid down in the Agreement between Unesco and the Government of the United Arab Republic concerning the safeguarding of the temples of Philae to the appropriate authorities of the United Arab Republic, taking the time-table of payments due and the progress of work into account. 1972 6 17-01-1972 1972 41 10-04-1972 23-03-1972

Article III The Director-General will communicate a periodical information report, at least every six months, to the Contracting Member States and Associate Members of Unesco concerning the implementation of this Agreement and the progress of the operations to save the temples of Philae. 1972 6 17-01-1972 1972 41 10-04-1972 23-03-1972

Article IV The Agreement will bear the date of 19 December 1970 and will remain open to the signature of all the Member States and Associate Members of Unesco. 1972 6 17-01-1972 1972 41 10-04-1972 23-03-1972

Article V This Agreement shall enter into force for each Contracting Member State or Associate Member of Unesco upon its signature or, if it is signed subject to ratification or acceptance, on the date of the deposit of an instrument of ratification or acceptance with the Director-General. 1972 6 17-01-1972 1972 41 10-04-1972 23-03-1972

Article VI The Director-General will hold at the disposal of Contracting Member States and Associate Members of Unesco the sums which the latter have contributed under this Agreement if the Government of the United Arab Republic does not conclude the contract for the work described in the specifications drawn up by the Minister of Culture (Salvage of the Temples of Philae). 1972 6 17-01-1972 1972 41 10-04-1972 23-03-1972

Article VII The Director-General shall inform the Member States and Associate Members of Unesco of the signature affixed to this Agreement, as well as of the deposit of the instruments of ratification or acceptance mentioned in Article V of this Agreement. 1972 6 17-01-1972 1972 41 10-04-1972 23-03-1972

Article VIII In accordance with Article 102 of the Charter of the United Nations, this Agreement will be registered at the United Nations Secretariat, at the request of the Director-General. 1972 6 17-01-1972 1972 41 10-04-1972 23-03-1972

Article I 1 The Government of the United Arab Republic undertakes to proceed with the work of saving the temples of Philae in accordance with the project it has approved and which consists in dismantling the temples and reconstructing them on a small island close to their original site at a total estimated cost equivalent to about thirteen million three hundred thousand dollars of the United States of America. 2 In conformity with resolution 4. 421, adopted by the General Conference at its twelfth session, the Government of the United Arab Republic shall take the necessary measures to preserve the international character of the enterprise in the execution of the project. 1972 6 17-01-1972 1972 41 10-04-1972 23-03-1972

Article II 1 The Director-General of the Organization shall transmit to the competent authorities of the United Arab Republic, in accordance with the methods, conditions and time-table laid down in the semi-annual plans drawn up and approved in conformity with the provisions of the Annex to this Agreement, which constitutes an integral part thereof, the amounts paid to him for that purpose by Member States and Associate Members of the Organization in compliance with the Agreement Concerning Voluntary Contributions, and the amounts already paid into the Trust Fund and specially earmarked for the salvage of the temples of Philae. 2 With a view to assisting the Government of the United Arab Republic in meeting the obligations which it will have incurred in convertible currencies for the work of saving the temples of Philae the Director-General of the Organization shall transfer to the Government of the United Arab Republic, in convertible currencies, the sums paid in these currencies into the Trust Fund and shall also endeavour to make available to the Government of the United Arab Republic additional sums in convertible currencies obtained by converting, in agreement with other Agencies of the United Nations, donations and contributions received in currencies subject to exchange regulations. 3 Furthermore, the Director-General shall take all necessary steps to enable the Government of the United Arab Republic to make use, as expeditiously as possible, of any contributions in kind that Member States and Associate Members may have made available through the Organization. 1972 6 17-01-1972 1972 41 10-04-1972 23-03-1972

Article III In addition to the information and documents foreseen in the Annex to this Agreement, the Government of the United Arab Republic shall supply the Director-General of the Organization, as expeditiously as possible, with the plans of operation, draft contracts and costs estimates concerning the salvage work of the temples of Philae together with all necessary information and documents on the progress of the work, in order to enable the Director-General of the Organization to keep the contributing Member States and Associate Members and the Executive Committee of the Campaign to Save the Monuments of Nubia fully and regularly informed of the work done. 1972 6 17-01-1972 1972 41 10-04-1972 23-03-1972

Article IV The Director-General of the Organization shall continue to appeal to governments and to public and private sources in order to assist the Government of the United Arab Republic in making up any difference between the total amount of contributions so far secured and the expected cost of the operation: about thirteen million three hundred thousand dollars of the United States of America. 1972 6 17-01-1972 1972 41 10-04-1972 23-03-1972

Article V The Director-General of the Organization, in conformity with the resolutions of the General Conference, shall pursue the International Campaign to Save the Monuments of Nubia and, in particular, to save the temples of Philae. 1 At least two months before a session of the Executive Committee whose agenda will include consideration of the semi-annual plan of financial operations provided for in paragraph 2 of resolution II, adopted by the Executive Committee at the close of its fifth session the Government of the United Arab Republic shall send the Organization a report indicating, with reference to the clauses of the works contract and the progress of the operations, the payments it will have to meet during the semi-annual period in question. 2 In the light of all the information so received and of the situation of the Trust Fund, taking into account the receipts expected during the semi-annual period in question, the Director-General shall establish the above-mentioned plan of financial operations indicating by type of currency, the proportion of the payments falling due under contract which can be met by the Trust Fund. This document shall be communicated as expeditiously as possible to the Government of the United Arab Republic for observations, and transmitted to the Executive Committee for approval. 1972 6 17-01-1972 1972 41 10-04-1972 23-03-1972

3 The amounts provided for on the schedule of payments approved by the Executive Committee shall be placed at the disposal of the Government of the United Arab Republic fifteen days before the due date of each payment, in accordance with the practical arrangements agreed upon by the said Government and the Director-General. 1972 6 17-01-1972 1972 41 10-04-1972 23-03-1972

4 Within three months after the expiry of each semi-annual period, the Government of the United Arab Republic shall send the Organization a financial report, reviewing both the work carried out and the payments made during the semi-annual period covered, and indicating any changes which may have been made in the initial estimates. After obtaining, where appropriate, any additional information that may be necessary, the Director-General shall transmit this report to the Executive Committee for consideration at its next session. 1972 6 17-01-1972 1972 41 10-04-1972 23-03-1972

5 Within six months after the completion of the work of each stage of the project, the Government of the United Arab Republic shall forward to the Organization a technical report and a financial report covering all the work done and payments made which relate to that stage. Artikel I 1 Ieder der Overeenkomstsluitende Lid-Staten of geassocieerde leden van de Unesco verbindt zich bij te dragen tot de uitvoering van het project tot behoud van de tempels van Philae door een bijdrage in natura te leveren of door in het hiertoe door de Directeur-Generaal van de Organisatie voor onderwijs, wetenschap en cultuur van de Verenigde Naties, hierna te noemen „de Directeur-Generaal”, ingestelde „Trust Fund” de bedragen te storten, genoemd in de Bijlage bij deze Overeenkomst, en wel in de valuta, op de data en op de wijze als aangegeven in deze Bijlage. 2 De Directeur-Generaal draagt elk bedrag dat bij hem is gedeponeerd eerst dan aan de bevoegde instanties van de Verenigde Arabische Republiek over en neemt eerst dan stappen om de bijdragen in natura ter beschikking van deze instanties te stellen, nadat de Regering van de Verenigde Arabische Republiek zich definitief heeft verbonden de werkzaamheden tot behoud van de tempels van Philae op zich te nemen en de maatregelen te treffen die nodig zijn om deze op bevredigende wijze te voltooien, alsmede voor dat doel met een of meer aannemers de overeenkomst aan te gaan betreffende de werkzaamheden omschreven in het bestek opgemaakt door het Ministerie van Cultuur van de Verenigde Arabische Republiek (Behoud van de tempels van Philae). 1972 6 17-01-1972 1972 41 10-04-1972 23-03-1972

Artikel II 1 De Directeur-Generaal wordt volledig op de hoogte gehouden van de vervaldagen waarmee de Regering van de Verenigde Arabische Republiek rekening moet houden bij de uitvoering van de overeenkomst bedoeld in het tweede lid van artikel I. Hem wordt bovendien periodiek verslag uitgebracht omtrent de voortgang van de werkzaamheden. 2 Hij draagt de door hem ontvangen bedragen overeenkomstig de bepalingen van het eerste lid van artikel I en overeenkomstig de procedure voorzien in de Overeenkomst tussen de Unesco en de Regering van de Verenigde Arabische Republiek betreffende de bescherming van de tempels van Philae over aan de bevoegde instanties van de Verenigde Arabische Republiek, daarbij rekening houdende met de vervaldagen en de voortgang van de werkzaamheden. 1972 6 17-01-1972 1972 41 10-04-1972 23-03-1972

Artikel III De Directeur-Generaal brengt regelmatig, maar ten minste eenmaal in de zes maanden, aan de Overeenkomstsluitende Lid-Staten en geassocieerde leden van de Unesco verslag uit omtrent de toepassing van deze Overeenkomst, alsmede over de voortgang van de werkzaamheden tot behoud van de tempels van Philae. 1972 6 17-01-1972 1972 41 10-04-1972 23-03-1972

Artikel IV Deze Overeenkomst is gedagtekend 19 december 1970 en staat ter ondertekening open voor alle Lid-Staten en geassocieerde leden van de Unesco. 1972 6 17-01-1972 1972 41 10-04-1972 23-03-1972

Artikel V Deze Overeenkomst treedt voor iedere Overeenkomstsluitende Lid-Staat of ieder Overeenkomstsluitend geassocieerd lid van de Unesco onmiddellijk na de ondertekening in werking of, indien de ondertekening is geschied onder voorbehoud van bekrachtiging of aanvaarding, op de datum van de nederlegging van een akte van bekrachtiging of van aanvaarding bij de Directeur-Generaal. 1972 6 17-01-1972 1972 41 10-04-1972 23-03-1972

Artikel VI De Directeur-Generaal houdt de bedragen die de Overeenkomstsluitende Lid-Staten en geassocieerde leden van de Unesco gestort hebben ter uitvoering van deze Overeenkomst te hunner beschikking in geval de Regering van de Verenigde Arabische Republiek de overeenkomst betreffende de werkzaamheden omschreven in het door het Ministerie van Cultuur opgemaakte bestek (Behoud van de tempels van Philae) niet mocht sluiten. 1972 6 17-01-1972 1972 41 10-04-1972 23-03-1972

Artikel VII De Directeur-Generaal doet de Lid-Staten en de geassocieerde leden van de Unesco mededeling van alle ondertekeningen van deze Overeenkomst, alsmede van de nederlegging van de akten van bekrachtiging of van aanvaarding bedoeld in artikel V van deze Overeenkomst. 1972 6 17-01-1972 1972 41 10-04-1972 23-03-1972
