Overeenkomst inzake de internationale uitwisseling van publikaties

Article 1 Exchange of publications The Contracting States undertake to encourage and facilitate the exchange of publications between both governmental bodies and non-governmental institutions of an educational, scientific and technical, or cultural nature, which are non-profit-making in character, in accordance with the provisions of the present Convention. 1973 60 15-05-1973 1975 142 08-12-1975 21-11-1976

Article 2 Scope of the exchange of publications 1 For the purpose of the present Convention, the following publications may be considered appropriate articles to be exchanged, for use but not for resale, between the bodies and institutions referred to in Article 1 of the present Convention: (a) publications of an educational, legal, scientific and technical, cultural and informational nature, such as books, newspapers and periodicals, maps and plans, prints, photographs, microcopies, musical works, Braille publications and other graphic material; (b) publications covered by the Convention concerning the exchange of official publications and government documents between States, adopted by the General Conference of the United Nations Educational, Scientific and Cultural Organization on the third day of December 1958. 2 The present Convention in no way affects exchanges carried out under the Convention concerning the exchange of official publications and government documents between States, adopted by the General Conference of the United Nations Educational, Scientific and Cultural Organization on the third day of December 1958. 3 The present Convention does not apply to confidential documents, circulars and other items which have not been made public. 1973 60 15-05-1973 1975 142 08-12-1975 21-11-1976

Article 3 Exchange services 1 The Contracting States may entrust the national exchange service or, where no such national exchange service exists, the central exchange authority or authorities with the following functions in connexion with the development and co-ordination of the exchange of publications among bodies and institutions referred to in Article I of the present Convention: (a) facilitating the international exchange of publications, in particular by transmitting, when appropriate, the material to be exchanged; (b) supplying advice and information on exchange possibilities for bodies and institutions at home and abroad; (c) encouraging, when appropriate, the exchange of duplicate material. 2 However, when it is deemed undesirable to centralize in the national exchange service or in central authorities the development and co-ordination of exchanges among bodies and institutions referred to in Article 1 of the present Convention, any or all of the functions enumerated in paragraph 1 of the present article may be entrusted to other authority or authorities. 1973 60 15-05-1973 1975 142 08-12-1975 21-11-1976

Article 4 Method of transmission The transmission may be made either directly between the bodies and institutions concerned, or through the national exchange service or exchange authorities. 1973 60 15-05-1973 1975 142 08-12-1975 21-11-1976

Article 5 Transport charges When transmissions are made directly between exchange partners, the Contracting States shall not be required to bear the cost thereof. If the transmission is made through the exchange authority or authorities, the Contracting States shall bear the cost of the transmission as far ar destination, but, for transport by sea, the cost of packing and carriage shall be paid only as far as the customs office of the port of arrival. 1973 60 15-05-1973 1975 142 08-12-1975 21-11-1976

Article 6 Rates and conditions of transport The Contracting States shall take all the necessary measures to ensure that the exchange authorities benefit from the most favourable existing rates and transport conditions, whatever the means of transport chosen: post, road, rail, inland or sea transport, airmail or air cargo. 1973 60 15-05-1973 1975 142 08-12-1975 21-11-1976

Article 7 Customs and other facilities Each Contracting State shall grant its exchange authorities exemption from customs duties for both imported and exported material under the provisions of the present Convention or under any agreement in implementation thereof and shall accord them the most favourable treatment as regards customs and other facilities. 1973 60 15-05-1973 1975 142 08-12-1975 21-11-1976

Article 8 International co-ordination of exchange Constitution To assist the United Nations Educational, Scientific and Cultural Organization in the performance of the functions assigned to it by itsconcerning the international co-ordination of exchange, the Contracting States shall send to the Organization annual reports on the working of the present Convention and copies of bilateral agreements entered into in accordance with Article 12. 1973 60 15-05-1973 1975 142 08-12-1975 21-11-1976

Article 9 Information and studies The United Nations Educational, Scientific and Cultural Organization shall publish information received from the Contracting States in application of Article 8 and shall prepare and publish studies on the working of the present Convention. 1973 60 15-05-1973 1975 142 08-12-1975 21-11-1976

Article 10 Assistance of UNESCO 1 The Contracting States may call upon the United Nations Educational, Scientific and Cultural Organization for technical assistance in connexion with any problem arising out of the application of the present Convention. The Organization shall accord such assistance within the limits fixed by its programme and its resources, in particular, for the creation and organization of national exchange services. 2 The Organization is authorized to make, on its own initiative, proposals on this matter to the Contracting States. 1973 60 15-05-1973 1975 142 08-12-1975 21-11-1976

Article 11 Relation to previous agreements The present Convention shall not affect obligations previously entered into by the Contracting States by virtue of international agreements. 1973 60 15-05-1973 1975 142 08-12-1975 21-11-1976

Article 12 Bilateral Agreements Whenever necessary or desirable, the Contracting States shall enter into bilateral agreements for the purpose of supplementing the present Convention and regulating matters of common concern arising out of its application. 1973 60 15-05-1973 1975 142 08-12-1975 21-11-1976

Article 13 Languages The present Convention is drawn up in English, French, Russian and Spanish, the four texts being equally authoritative. 1973 60 15-05-1973 1975 142 08-12-1975 21-11-1976

Article 14 Ratification and acceptance 1 The present Convention shall be subject to ratification or acceptance by States members of the United Nations Educational, Scientific and Cultural Organization, in accordance with their respective constitutional procedures. 2 The instruments of ratification or acceptance shall be deposited with the Director-General of the United Nations Educational, Scientific and Cultural Organization. 1973 60 15-05-1973 1975 142 08-12-1975 21-11-1976

Article 15 Accession 1 The present Convention shall be open for accession by all States not members of the Organization invited to do so by the Executive Board of the United Nations Educational, Scientific and Cultural Organization. 2 Accession shall be effected by the deposit of an instrument of accession with the Director-General of the United Nations Educational, Scientific and Cultural Organization. 1973 60 15-05-1973 1975 142 08-12-1975 21-11-1976

Article 16 Entry into force The present Convention shall enter into force twelve months after the date of the deposit of the third instrument of ratification, acceptance or accession, but only with respect to those States which have deposited their respective instruments on or before that date. It shall enter into force for each other State which deposits its instrument of ratification, acceptance or accession, twelve months after the deposit of its instrument of ratification, acceptance or accession. 1973 60 15-05-1973 1975 142 08-12-1975 21-11-1976

Article 17 Territorial extension of the Convention Any Contracting State may, at the time of ratification, acceptance or accession, or at any time thereafter, declare by notification adressed to the Director-General of the United Nations Educational, Scientific and Cultural Organization that the present Convention shall extend to all or any of the territories for whose international relations it is responsible. Article 18 Denunciations 1 Each Contracting State may denounce the present Convention on its own behalf or on behalf of any territory for whose international relations it is responsible. 2 The denunciation shall be notified by an instrument in writing, deposited with the Director-General of the United Nations Educational, Scientific and Cultural Organization. 3 The denunciation shall take effect twelve months after the receipt of the instrument of denunciation. 1973 60 15-05-1973 1975 142 08-12-1975 21-11-1976

Article 19 Notifications The Director-General of the United Nations Educational, Scientific and Cultural Organization shall inform the States members of the Organization, States not members of the Organization referred to in Article 15, as well as the United Nations, of the deposit of all the instruments of ratification, acceptance and accession provided for in Articles 14 and 15 and of the notifications and denunciations provided for respectively in Articles 17 and 18. 1973 60 15-05-1973 1975 142 08-12-1975 21-11-1976

Article 20 Revision of the Convention 1 The present Convention may be revised by the General Conference of the United Nations Educational, Scientific and Cultural Organization, any such revision, however, binding only those States which shall become parties to the revising convention. 2 Should the General Conference adopt a new convention revising the present Convention in whole or in part, and unless the new convention otherwise provides, the present Convention shall cease to be open to ratification, acceptance or accession as from the date when the new revising convention enters into force. 1973 60 15-05-1973 1975 142 08-12-1975 21-11-1976

Article 21 Registration Article 102 of the Charter of the United Nations In accordance with, the present Convention shall be registered with the Secretariat of the United Nations at the request of the Director-General of the United Nations Educational, Scientific and Cultural Organization. 1973 60 15-05-1973 1975 142 08-12-1975 21-11-1976

Artikel 1 Uitwisseling van publikaties De Overeenkomstsluitende Staten verbinden zich ertoe, overeenkomstig het bepaalde in deze Overeenkomst, de uitwisseling van publikaties zowel tussen gouvernementele organen als niet-gouvernementele instellingen van opvoedkundige, wetenschappelijke en technische of culturele aard, die het maken van geldelijk gewin niet beogen, aan te moedigen en te bevorderen. 1973 60 15-05-1973 1975 142 08-12-1975 21-11-1976

Artikel 2 Werkingssfeer 1 Voor de toepassing van deze Overeenkomst kunnen de volgende publikaties in aanmerking komen voor uitwisseling, voor eigen gebruik, niet voor wederverkoop, tussen de organen en instellingen bedoeld in artikel 1 van deze Overeenkomst: a) publikaties van opvoedkundige, juridische, wetenschappelijke en technische, culturele en voorlichtende aard, zoals boeken, kranten en tijdschriften, kaarten en plattegronden, prenten, foto's, microkopieën, muzikale werken, publikaties in brailleschrift en andere grafische documenten; b) publikaties bedoeld in de Overeenkomst inzake de uitwisseling van officiële publikaties en regeringsdocumenten tussen Staten, aangenomen door de Algemene Vergadering van de Organisatie der Verenigde Naties voor Onderwijs, Wetenschap en Cultuur op 3 december 1958. 2 Deze Overeenkomst is van geen enkele invloed op uitwisselingen krachtens de Overeenkomst inzake de uitwisseling van officiële publikaties en regeringsdocumenten tussen Staten, aangenomen door de Algemene Vergadering van de Organisatie der Verenigde Naties voor Onderwijs, Wetenschap en Cultuur op 3 december 1958. 3 Deze Overeenkomst is niet van toepassing op vertrouwelijke documenten, circulaires en andere stukken die niet zijn openbaar gemaakt. 1973 60 15-05-1973 1975 142 08-12-1975 21-11-1976

Artikel 3 Diensten voor uitwisseling 1 De Overeenkomstsluitende Staten kunnen aan de nationale dienst voor uitwisseling of, waar zulk een nationale dienst voor uitwisseling niet bestaat, aan de centrale instantie of instanties belast met de uitwisseling, de volgende taken toebedelen ter zake van de uitbreiding en coördinatie van de uitwisseling van publikaties tussen de organen en instellingen bedoeld in artikel 1 van deze Overeenkomst: a) het bevorderen van de internationale uitwisseling van publikaties, in het bijzonder door het te ruilen materiaal, waar mogelijk, door te zenden; b) het geven van advies en het verstrekken van inlichtingen inzake de mogelijkheden tot ruilen waarover organen en instellingen in eigen land en daarbuiten beschikken; c) het aanmoedigen, indien gepast, van de ruil van doubletten. 2 Indien het evenwel ongewenst wordt geacht de uitbreiding en coördinatie van de uitwisselingen tussen organen en instellingen als bedoeld in artikel 1 van deze Overeenkomst centraal onder te brengen bij de nationale dienst voor uitwisseling of bij de centrale instanties die belast zijn met de uitwisseling, kunnen alle of enkele van de in het eerste lid van dit artikel genoemde taken worden toevertrouwd aan een of meer andere instanties. 1973 60 15-05-1973 1975 142 08-12-1975 21-11-1976

Artikel 4 Wijze van overdracht Verzending kan hetzij rechtstreeks tussen de betrokken organen en instellingen plaatsvinden, hetzij door tussenkomst van de nationale dienst voor uitwisseling of de instanties die belast zijn met de uitwisseling. 1973 60 15-05-1973 1975 142 08-12-1975 21-11-1976

Artikel 5 Kosten van vervoer Indien verzending rechtstreeks tussen de partijen die tot uitwisseling overgaan, plaatsvindt, zijn de Overeenkomstsluitende Staten niet gehouden de kosten van vervoer te dragen. Indien verzending geschiedt door tussenkomst van de instantie of instanties belast met de uitwisseling, dragen de Overeenkomstsluitende Staten de kosten van vervoer tot de plaats van bestemming, doch bij vervoer overzee worden de kosten van verpakking en vervoer uitsluitend betaald tot aan het douanekantoor in de haven van aankomst. 1973 60 15-05-1973 1975 142 08-12-1975 21-11-1976

Artikel 6 Vervoerstarieven en -voorwaarden De Overeenkomstsluitende Staten nemen alle noodzakelijke maatregelen ter waarborging dat de instanties die belast zijn met de uitwisseling gebruik kunnen maken van de gunstigste vervoerstarieven en -voorwaarden, ongeacht of het vervoer geschiedt per post, over de weg, per spoor, per schip via de binnenvaart of de grote vaart, per luchtpost of als luchtvracht. 1973 60 15-05-1973 1975 142 08-12-1975 21-11-1976

Artikel 7 Douanefaciliteiten en andere faciliteiten Elke Overeenkomstsluitende Staat verleent zijn instanties die belast zijn met de uitwisseling vrijdom van douanerechten op materiaal dat krachtens de bepalingen van deze Overeenkomst of krachtens enige andere overeenkomst gesloten ter uitvoering hiervan, wordt ingevoerd of uitgevoerd en stelt hen in het genot van de meest gunstige behandeling op het punt van douanefaciliteiten en andere faciliteiten. 1973 60 15-05-1973 1975 142 08-12-1975 21-11-1976

Artikel 8 Internationale samenwerking ter zake van de uitwisseling Statuut Ten einde de Organisatie der Verenigde Naties voor Onderwijs, Wetenschap en Cultuur te helpen de haar ingevolge haaropgedragen taken inzake de internationale samenwerking ter zake van de uitwisseling te vervullen, brengen de Overeenkomstsluitende Staten aan de Organisatie jaarlijks verslag uit van de toepassing van deze Overeenkomst en sturen zij haar afschriften van de bilaterale Overeenkomsten gesloten overeenkomstig het bepaalde in artikel 12. 1973 60 15-05-1973 1975 142 08-12-1975 21-11-1976

Artikel 9 Inlichtingen en studies De Organisatie der Verenigde Naties voor Onderwijs, Wetenschap en Cultuur publiceert de inlichtingen haar door de Overeenkomstsluitende Staten verschaft ingevolge artikel 8, redigeert studies over de toepassing van deze Overeenkomst en publiceert deze. 1973 60 15-05-1973 1975 142 08-12-1975 21-11-1976

Artikel 10 Bijstand van de Organisatie der Verenigde Naties voor Onderwijs, Wetenschap en Cultuur 1 De Overeenkomstsluitende Staten kunnen een beroep doen op technische bijstand van de Organisatie der Verenigde Naties voor Onderwijs, Wetenschap en Cultuur ten aanzien van ieder vraagstuk dat zich in verband met de toepassing van deze Overeenkomst voordoet. De Organisatie verleent deze bijstand voor zover haar programma en mogelijkheden zulks toestaan, in het bijzonder waar het de oprichting en de organisatie van nationale diensten voor uitwisseling betreft. 2 De Organisatie kan op eigen initiatief de Overeenkomstsluitende Staten te dezen voorstellen doen. 1973 60 15-05-1973 1975 142 08-12-1975 21-11-1976

Artikel 11 Verhouding tot bestaande Overeenkomsten Deze Overeenkomst tast in geen enkel opzicht eerder door de Overeenkomstsluitende Staten aangegane verplichtingen krachtens internationale Overeenkomsten aan. 1973 60 15-05-1973 1975 142 08-12-1975 21-11-1976

Artikel 12 Bilaterale Overeenkomsten Telkens wanneer zij zulks nodig of wenselijk achten, sluiten de Overeenkomstsluitende Staten bilaterale Overeenkomsten ter aanvulling van de bepalingen van deze Overeenkomst en ter regeling van met de toepassing ervan verband houdende zaken van gemeenschappelijk belang. 1973 60 15-05-1973 1975 142 08-12-1975 21-11-1976

Artikel 13 Talen Deze Overeenkomst is opgesteld in de Engelse, de Franse, de Russische en de Spaanse taal, zijnde de vier teksten gelijkelijk gezaghebbend. 1973 60 15-05-1973 1975 142 08-12-1975 21-11-1976

Artikel 14 Bekrachtiging en aanvaarding 1 Deze Overeenkomst dient, overeenkomstig hun onderscheiden constitutionele procedures, door de Staten die lid zijn van de Organisatie der Verenigde Naties voor Onderwijs, Wetenschap en Cultuur, te worden bekrachtigd of aanvaard. 2 De akten van bekrachtiging of aanvaarding worden nedergelegd bij de Directeur-Generaal van de Organisatie der Verenigde Naties voor Onderwijs, Wetenschap en Cultuur. 1973 60 15-05-1973 1975 142 08-12-1975 21-11-1976

Artikel 15 Toetreding 1 Deze Overeenkomst staat open voor toetreding door alle Staten die geen lid zijn van de Organisatie der Verenigde Naties voor Onderwijs, Wetenschap en Cultuur en die hiertoe zijn uitgenodigd door het Dagelijks Bestuur van de Organisatie. 2 Toetreding geschiedt door nederlegging van een akte van toetreding bij de Directeur-Generaal van de Organisatie der Verenigde Naties voor Onderwijs, Wetenschap en Cultuur. 1973 60 15-05-1973 1975 142 08-12-1975 21-11-1976

Artikel 16 Inwerkingtreding Deze Overeenkomst treedt in werking 12 maanden na de datum van nederlegging van de derde akte van bekrachtiging, aanvaarding of toetreding, doch slechts ten aanzien van de Staten die hun onderscheiden akten op of voor dat tijdstip hebben nedergelegd. Ten aanzien van andere Staten die een akte van bekrachtiging, aanvaarding of toetreding hebben nedergelegd, treedt zij in werking twaalf maanden na de nederlegging van deze akte van bekrachtiging, aanvaarding of toetreding. 1973 60 15-05-1973 1975 142 08-12-1975 21-11-1976

Artikel 17 Territoriale uitbreiding van de Overeenkomst Elke Staat kan, hetzij ten tijde van de bekrachtiging, de aanvaarding of de toetreding, hetzij op elk later tijdstip, door middel van een aan de Directeur-Generaal van de Organisatie der Verenigde Naties voor Onderwijs, Wetenschap en Cultuur gerichte kennisgeving verklaren dat deze Overeenkomst zich zal uitstrekken tot alle of tot bepaalde gebieden voor welker buitenlandse betrekkingen hij verantwoordelijk is. Artikel 18 Opzegging 1 Elke Overeenkomstsluitende Staat kan deze Overeenkomst opzeggen zowel voor zichzelf als voor een grondgebied voor welks internationale betrekkingen hij verantwoordelijk is. 2 Van de opzegging wordt kennis gegeven door middel van een akte, die wordt nedergelegd bij de Directeur-Generaal van de Organisatie der Verenigde Naties voor Onderwijs, Wetenschap en Cultuur. 3 De opzegging wordt van kracht twaalf maanden na ontvangst van de akte van opzegging. 1973 60 15-05-1973 1975 142 08-12-1975 21-11-1976

Artikel 19 Kennisgevingen De Directeur-Generaal van de Organisatie der Verenigde Naties voor Onderwijs, Wetenschap en Cultuur stelt de lid-Staten van de Organisatie, de Staten die geen lid zijn van de Organisatie, zoals bedoeld in artikel 15, alsmede de Verenigde Naties, in kennis van de nederlegging van alle akten van bekrachtiging, aanvaarding en toetreding bedoeld in de artikelen 14 en 15, en van de kennisgevingen en opzeggingen bedoeld in de artikelen 17 en 18. 1973 60 15-05-1973 1975 142 08-12-1975 21-11-1976

Artikel 20 Herziening van de Overeenkomst 1 Deze Overeenkomst kan worden herzien door de Algemene Vergadering van de Organisatie der Verenigde Naties voor Onderwijs, Wetenschap en Cultuur; zodanige herzieningen binden evenwel slechts de Staten die partij worden bij de overeenkomst houdende herziening. 2 Indien de Algemene Vergadering een nieuwe overeenkomst aanvaardt ter gedeeltelijke of gehele herziening van deze Overeenkomst, zal deze Overeenkomst, tenzij de nieuwe overeenkomst anders bepaalt, met ingang van de datum waarop de nieuwe overeenkomst houdende herziening in werking treedt, niet langer openstaan voor bekrachtiging, aanvaarding of toetreding. 1973 60 15-05-1973 1975 142 08-12-1975 21-11-1976

Artikel 21 Registratie artikel 102 van het Handvest der Verenigde Naties Overeenkomstigwordt deze Overeenkomst op verzoek van de Directeur-Generaal van de Organisatie der Verenigde Naties voor Onderwijs, Wetenschap en Cultuur geregistreerd bij het Secretariaat van de Verenigde Naties. 1973 60 15-05-1973 1975 142 08-12-1975 21-11-1976
