Notawisseling tussen de Regering van het Koninkrijk der Nederlanden en de Regering van de Democratische Volksrepubliek Algerije houdende een overeenkomst betreffende een garantiefonds in verband met de beslechting van bepaalde geschillen tussen de Verenigde Staten van Amerika en Iran

Article I The Governments of the Islamic Republic of Iran and the United States of America, desiring to give effect to certain provisions of the Declaration of the Government of the Democratic and Popular Republic of Algeria of 19 January 1981, have selected, as a mutually agreeable central bank, De Nederlandsche Bank at Amsterdam, to assume the management of a bank which shall act as Depositary of the funds in the Security Account established by the foregoing Declaration. 1981 163 27-07-1981 13-07-1981 1981 163 27-07-1981 13-07-1981 13-07-1981

Article 2 Except as otherwise provided for in the present Agreement, or in Technical Agreements to which the Banque Centrale d'Algérie is a party, the Banque Centrale d'Algérie shall enjoy immunity from jurisdiction in the Netherlands, in accordance with Netherlands law, in respect of claims relating directly or indirectly to: a) the presence in the Netherlands of the funds in the Security Account; b) the function of the Banque Centrale d'Algérie as Escrow Agent. 1981 163 27-07-1981 13-07-1981 1981 163 27-07-1981 13-07-1981 13-07-1981

Article 4 1 If the Banque Centrale d'Algérie institutes or intervenes in proceedings before a court in the Netherlands, it submits, for the purpose of those proceedings, to the jurisdiction of the Netherlands courts. 2 In such case the Bank cannot claim immunity from the jurisdiction of the courts in respect of a counterclaim if the counterclaim arises from the legal relationship or the facts upon which the principal claim is based. 1981 163 27-07-1981 13-07-1981 1981 163 27-07-1981 13-07-1981 13-07-1981

Artikel 1 De Regeringen van de Islamitische Republiek Iran en de Verenigde Staten van Amerika, geleid door de wens een aantal bepalingen van de Verklaring van de Regering van de Democratische Volksrepubliek Algerije van 19 januari 1981 uit te voeren, hebben De Nederlandsche Bank te Amsterdam als een voor beide partijen aanvaardbare centrale bankinstelling uitgekozen om het beheer op zich te nemen van een bank die zal optreden als Depositaris van de gelden, gestort op het Garantiefonds dat bij bovengenoemde Verklaring is ingesteld. 1981 217 01-10-1981 1981 163 27-07-1981 13-07-1981 13-07-1981

Artikel 2 Behoudens in zoverre anders is bepaald in de onderhavige Overeenkomst of in de technische overeenkomsten waarbij de Banque Centrale d'Algérie partij is, geniet de Banque Centrale d'Algérie immuniteit van rechtsmacht in Nederland, overeenkomstig het Nederlandse recht, met betrekking tot vorderingen die direct of indirect verband houden met: (a) de aanwezigheid van de gelden van het Garantiefonds in Nederland; (b) de functie van de Banque Centrale d'Algérie als Gevolmachtigde (Escrow Agent). 1981 217 01-10-1981 1981 163 27-07-1981 13-07-1981 13-07-1981

Artikel 3 Rechterlijke uitspraken door buitenlandse rechters en deurwaardersexploten worden, voor zover zij betrekking hebben op vorderingen, ingesteld tegen de Banque Centrale d'Algérie, zoals deze zijn omschreven in Artikel 2, niet geëxecuteerd of anderszins ten uitvoer gelegd in Nederland. 1981 217 01-10-1981 1981 163 27-07-1981 13-07-1981 13-07-1981

Artikel 4 1 Indien de Banque Centrale d'Algérie rechtsgedingen aanhangig maakt voor een rechterlijke instantie in Nederland of in zodanige rechtsgedingen intervenieert, onderwerpt zij zich met betrekking tot deze rechtsgedingen aan de rechtsmacht van de Nederlandse rechterlijke instanties. 2 In een zodanig geval kan de Banque geen beroep doen op immuniteit van de rechtsmacht van de rechterlijke instanties met betrekking tot een tegenvordering, indien de tegenvordering voortvloeit uit de rechtsverhoudingen of uit de feiten waarop de hoofdvordering is gebaseerd. 1981 217 01-10-1981 1981 163 27-07-1981 13-07-1981 13-07-1981
