Zesde Protocol bij het Verdrag tot bescherming van de rechten van de mens en de fundamentele vrijheden, inzake de afschaffing van de doodstraf

Article 2 Death penalty in time of war A State may make provision in its law for the death penalty in respect of acts committed in time of war or of imminent threat of war; such penalty shall be applied only in the instances laid down in the law and in accordance with its provisions. Article 5 Territorial application 1 Any State may at the time of signature or when depositing its instrument of ratification, acceptance or approval, specify the territory or territories to which this Protocol shall apply. 2 Any State may at any later date, by a declaration addressed to the Secretary General of the Council of Europe, extend the application of this Protocol to any other territory specified in the declaration. In respect of such territory the Protocol shall enter into force on the first day of the month following the date of receipt of such declaration by the Secretary General. 3 Any declaration made under the two preceding paragraphs may, in respect of any territory specified in such declaration, be withdrawn by a notification addressed to the Secretary General. Article 7 Signature and ratification Convention This Protocol shall be open for signature by the member States of the Council of Europe, signatories to the. It shall be subject to ratification, acceptance or approval. A member State of the Council of Europe may not ratify, accept or approve this Protocol unless it has, simultaneously or previously, ratified the Convention. Article 8 Entry into force 1 This Protocol shall enter into force on the first day of the month following the date on which five member States of the Council of Europe have expressed their consent to be bound by the Protocol in accordance with the provisions of Article 7. 2 In respect of any member State which subsequently expresses its consent to be bound by it, the Protocol shall enter into force on the first day of the month following the date of the deposit of the instrument of ratification, acceptance or approval. 1994 141 01-07-1994 21-01-1997 1998 95 17-04-1998 01-11-1998

Article 9 Depositary functions The Secretary General of the Council of Europe shall notify the member States of the Council of: a. any signature; b. the deposit of any instrument of ratification, acceptance or approval; c. any date of entry into force of this Protocol in accordance with Articles 5 and 8; d. any other act, notification or communication relating to this Protocol. 1994 141 01-07-1994 21-01-1997 1998 95 17-04-1998 01-11-1998

Artikel 2 Doodstraf in tijd van oorlog Een Staat kan bepalingen in zijn wetgeving opnemen waarin is voorzien in de doodstraf voor feiten, begaan in tijd van oorlog of onmiddellijke oorlogsdreiging; een dergelijke straf wordt alleen ten uitvoer gelegd in de gevallen die zijn neergelegd in de wet, en in overeenstemming met de bepalingen daarvan. Artikel 5 Territoriale werkingssfeer 1 Iedere Staat kan op het tijdstip van ondertekening of van nederlegging van zijn akte van bekrachtiging, aanvaarding of goedkeuring het grondgebied of de grondgebieden aanwijzen waarop dit Protocol van toepassing is. 2 Iedere Staat kan, op elk later tijdstip, door middel van een aan de Secretaris-Generaal van de Raad van Europa gerichte verklaring, de toepassing van dit Protocol uitbreiden tot ieder ander in de verklaring aangewezen grondgebied. Met betrekking tot dat grondgebied treedt het Protocol in werking op de eerste dag van de maand volgende op de datum waarop die verklaring door de Secretaris-Generaal is ontvangen. 3 Iedere overeenkomstig de twee vorige leden afgelegde verklaring kan, met betrekking tot elk in die verklaring aangewezen grondgebied, worden ingetrokken door middel van een aan de Secretaris-Generaal van de Raad van Europa gerichte kennisgeving. Artikel 6 Verhouding tot het Verdrag Verdrag Tussen de Staten die Partij zijn, worden de artikelen 1 tot en met 5 van dit Protocol als aanvullende artikelen op hetbeschouwd; alle bepalingen van het Verdrag zijn dienovereenkomstig van toepassing. 1994 165 11-08-1994 21-01-1997 1998 95 17-04-1998 01-11-1998

Artikel 7 Ondertekening en bekrachtiging Verdrag Dit Protocol staat open voor ondertekening door de Lid-Staten van de Raad van Europa die hethebben ondertekend. Het dient te worden bekrachtigd, aanvaard of goedgekeurd. Een Lid-Staat van de Raad van Europa kan dit Protocol niet bekrachtigen, aanvaarden of goedkeuren, tenzij die Staat tezelfder tijd of eerder het Verdrag heeft bekrachtigd. Artikel 8 Inwerkingtreding 1 Dit Protocol treedt in werking op de eerste dag van de maand volgend op de datum waarop vijf Lid-Staten van de Raad van Europa hun instemming door het Protocol gebonden te worden tot uitdrukking hebben gebracht overeenkomstig het bepaalde in artikel 7. 2 Met betrekking tot iedere Lid-Staat die later zijn instemming door het Protocol gebonden te worden tot uitdrukking brengt, treedt dit in werking op de eerste dag van de maand volgende op de datum waarop de akte van bekrachtiging, aanvaarding of goedkeuring is nedergelegd. 1994 165 11-08-1994 21-01-1997 1998 95 17-04-1998 01-11-1998

Artikel 9 Taken van de depositaris De Secretaris-Generaal van de Raad van Europa geeft de Lid-Staten van de Raad kennis van: a. iedere ondertekening; b. de nederlegging van iedere akte van bekrachtiging, aanvaarding of goedkeuring; c. iedere datum van inwerkingtreding van dit Protocol overeenkomstig de artikelen 5 en 8; d. iedere andere handeling, kennisgeving of mededeling met betrekking tot dit Protocol. 1994 165 11-08-1994 21-01-1997 1998 95 17-04-1998 01-11-1998
