Article 1 Definitions 1 For the purposes of the present Convention, the following expressions shall have the meanings hereunder assigned to them: (a) “consular post” means any consulate-general, consulate, vice-consulate or consular agency; (b) “consular district” means the area assigned to a consular post for the exercise of consular functions; (c) “head of consular post” means the person charged with the duty of acting in that capacity; (d) “consular officer” means any person, including the head of a consular post, entrusted in that capacity with the exercise of consular functions; (e) “consular employee” means any person employed in the administrative or technical service of a consular post; (f) “member of the service staff” means any person employed in the domestic service of a consular post; (g) “members of the consular post" means consular officers, consular employees and members of the service staff; (h) “members of the consular staff” means consular officers, other than the head of a consular post, consular employees and members of the service staff; (i) “member of the private staff” means a person who is employed exclusively in the private service of a member of the consular post; (j) “consular premises” means the buildings or parts of buildings and the land ancillary thereto, irrespective of ownership, used exclusively for the purposes of the consular post; (k) “consular archives” includes all the papers, documents, correspondence, books, films, tapes and registers of the consular post, together with the ciphers and codes, the card-indexes and any article of furniture intended for their protection or safekeeping. 2 Consular officers are of two categories, namely career consular officers and honorary consular officers. The provisions of Chapter II of the present Convention apply to consular posts headed by career consular officers; the provisions of Chapter III govern consular posts headed by honorary consular officers. 3 The particular status of members of the consular posts who are nationals or permanent residents of the receiving State is governed by Article 71 of the present Convention. 1965 40 16-03-1965 1986 22 05-02-1986 16-01-1986

Article 2 Establishment of consular relations 1 The establishment of consular relations between States takes place by mutual consent. 2 The consent given to the establishment of diplomatic relations between two States implies, unless otherwise stated, consent to the establishment of consular relations. 3 ipso facto The severance of diplomatic relations shall notinvolve the severance of consular relations. 1965 40 16-03-1965 1986 22 05-02-1986 16-01-1986

Article 3 Exercise of consular functions Consular functions are exercised by consular posts. They are also exercised by diplomatic missions in accordance with the provisions of the present Convention. 1965 40 16-03-1965 1986 22 05-02-1986 16-01-1986

Article 4 Establisment of a consular post 1 A consular post may be established in the territory of the receiving State only with that State's consent. 2 The seat of the consular post, its classification and the consular district shall be established by the sending State and shall be subject to the approval of the receiving State. 3 Subsequent changes in the seat of the consular post, its classification or the consular district may be made by the sending State only with the consent of the receiving State. 4 The consent of the receiving State shall also be required if a consulate-general or a consulate desires to open a vice-consulate or a consular agency in a locality other than that in which it is itself established. 5 The prior express consent of the receiving State shall also be required for the opening of an office forming part of an existing consular post elsewhere than at the seat thereof. 1965 40 16-03-1965 1986 22 05-02-1986 16-01-1986

Article 5 Consular functions Consular functions consist in: (a) protecting in the receiving State the interests of the sending State and of its nationals, both individuals and bodies corporate, within the limits permitted by international law; (b) furthering the development of commercial, economic, cultural and scientific relations between the sending State and the receiving State and otherwise promoting friendly relations between them in accordance with the provisions of the present Convention; (c) ascertaining by all lawful means conditions and developments in the commercial, economic, cultural and scientific life of the receiving State, reporting thereon to the Government of the sending State and giving information to persons interested; (d) issuing passports and travel documents to nationals of the sending State, and visas or appropriate documents to persons wishing to travel to the sending State; (e) helping and assisting nationals, both individuals and bodies corporate, of the sending State; (f) acting as notary and civil registrar and in capacities of a similar kind, and performing certain functions of a administrative nature, provided that there is nothing contrary thereto in the laws and regulations of the receiving State; (g) mortis causa safeguarding the interests of nationals, both individuals and bodies corporate, of the sending State in cases of successionin the territory of the receiving State, in accordance with the laws and regulations of the receiving State; (h) safeguarding, within the limits imposed by the laws and regulations of the receiving State, the interests of minors and other persons lacking full capacity who are nationals of the sending State, particularly where any guardianship or trusteeship is required with respect to such persons; (i) subject to the practices and procedures obtaining in the receiving State, representing or arranging appropriate representation for nationals of the sending State before the tribunals and other authorities of the receiving State, for the purpose of obtaining, in accordance with the laws and regulations of the receiving State, provisional measures for the preservation of the rights and interests of these nationals, where, because of absence or any other reason, such nationals are unable at the proper time to assume the defence of their rights and interests; (j) transmitting judicial and extra-judicial documents or executing letters rogatory or commissions to take evidence for the courts of the sending State in accordance with international agreements in force or, in the absence of such international agreements, in any other manner compatible with the laws and regulations of the receiving State; (k) exercising rights of supervision and inspection provided for in the laws and regulations of the sending State in respect of vessels having the nationality of the sending State, and of aircraft registered in that State, and in respect of their crews; (l) k extending assistance to vessels and aircraft mentioned in subparagraph () of this Article and to their crews, taking statements regarding the voyage of a vessel, examining and stamping the ship's papers, and, without prejudice to the powers of the authorities of the receiving State, conducting investigations into any incidents which occurred during the voyage, and settling disputes of any kind between the master, the officers and the seamen in so far as this may be authorized by the laws and regulations of the sending State; (m) performing any other functions entrusted to a consular post by the sending State which are not prohibited by the laws and regulations of the receiving State or to which no objection is taken by the receiving State or which are referred to in the international agreements in force between the sending State and the receiving State. 1965 40 16-03-1965 1986 22 05-02-1986 16-01-1986

Article 6 Exercise of consular functions outside the consular district A consular officer may, in special circumstances, with the consent of the receiving State, exercise his functions outside his consular district. 1965 40 16-03-1965 1986 22 05-02-1986 16-01-1986

Article 7 Exercise of consular functions in a third State The sending State may, after notifying the States concerned, entrust a consular post established in a particular State with the exercise of consular functions in another State, unless there is express objection by one of the States concerned. 1965 40 16-03-1965 1986 22 05-02-1986 16-01-1986

Article 8 Exercise of consular functions on behalf of a third State Upon appropriate notification to the receiving State, a consular post of the sending State may, unless the receiving State objects, exercise consular functions in the receiving State on behalf of a third State. 1965 40 16-03-1965 1986 22 05-02-1986 16-01-1986

Article 9 Classes of heads of consular posts 1 Heads of consular posts are divided into four classes, namely: (a) consuls-general; (b) consuls; (c) vice-consuls; (d) consular agents. 2 Paragraph 1 of this Article in no way restricts the right of any of the Contracting Parties to fix the designation of consular officers other than the heads of consular posts. 1965 40 16-03-1965 1986 22 05-02-1986 16-01-1986

Article 10 Appointment and admission of heads of consular posts 1 Heads of consular posts are appointed by the sending State and are admitted to the exercise of their functions by the receiving State. 2 Subject to the provisions of the present Convention, the formalities for the appointment and for the admission of the head of a consular post are determined by the laws, regulations and usages of the sending State and of the receiving State respectively. 1965 40 16-03-1965 1986 22 05-02-1986 16-01-1986

Article 11 The consular commission or notification of appointment 1 The head of a consular post shall be provided by the sending State with a document, in the form of a commission or similar instrument, made out for each appointment, certifying his capacity and showing, as a general rule, his full name, his category and class, the consular district and the seat of the consular post. 2 The sending State shall transmit the commission or similar instrument through the diplomatic or other appropriate channel to the Government of the State in whose territory the head of a consular post is to exercise his functions. 3 If the receiving State agrees, the sending State may, instead of a commission or similar instrument, send to the receiving State a notification containing the particulars required by paragraph 1 of this Article. 1965 40 16-03-1965 1986 22 05-02-1986 16-01-1986

Article 13 Provisional admission of heads of consular posts exequatur Pending delivery of the, the head of a consular post may be admitted on a provisional basis to the exercise of his functions. Article 14 Notification to the authorities of the consular district As soon as the head of a consular post is admitted even provisionally to the exercise of his functions, the receiving State shall immediately notify the competent authorities of the consular district. It shall also ensure that the necessary measures are taken to enable the head of a consular post to carry out the duties of his office and to have the benefit of the provisions of the present Convention. 1965 40 16-03-1965 1986 22 05-02-1986 16-01-1986

Article 15 Temporary exercise of the functions of the head of a consular post 1 If the head of a consular post is unable to carry out his functions or the position of head of consular post is vacant, an acting head of post may act provisionally as head of the consular post. 2 The full name of the acting head of post shall be notified either by the diplomatic mission of the sending State or, if that State has no such mission in the receiving State, by the head of the consular post, or, if he is unable to do so, by any competent authority of the sending State, to the Ministry for Foreign Affairs of the receiving State or to the authority designated by that Ministry. As a general rule, this notification shall be given in advance. The receiving State may make the admission as acting head of post of a person who is neither a diplomatic agent nor a consular officer of the sending State in the receiving State conditional on its consent. 3 The competent authorities of the receiving State shall afford assistance and protection to the acting head of post. While he is in charge of the post, the provisions of the present Convention shall apply to him on the same basis as to the head of the consular post concerned. The receiving State shall not, however, be obliged to grant to an acting head of post any facility, privilege or immunity which the head of the consular post enjoys only subject to conditions not fulfilled by the acting head of post. 4 When, in the circumstances referred to in paragraph 1 of this Article, a member of the diplomatic staff of the diplomatic mission of the sending State in the receiving State is designated by the sending State as an acting head of post, he shall, if the receiving State does not object thereto, continue to enjoy diplomatic privileges and immunities. 1965 40 16-03-1965 1986 22 05-02-1986 16-01-1986

Article 16 Precedence as between heads of consular posts 1 exequatur. Heads of consular posts shall rank in each class according to the date of the grant of the 2 exequatur exequatur. If, however, the head of a consular post before obtaining theis admitted to the exercise of his functions provisionally, his precedence shall be determined according to the date of the provisional admission; this precedence shall be maintained after the granting of the 3 exequatur The order of precedence as between two or more heads of consular posts who obtained theor provisional admission on the same date shall be determined according to the dates on which their commissions or similar instruments or the notifications referred to in paragraph 3 of Article 11 were presented to the receiving State. 4 Acting heads of posts shall rank after all heads of consular posts and, as between themselves, they shall rank according to the dates on which they assumed their functions as acting heads of posts as indicated in the notifications given under paragraph 2 of Article 15. 5 Honorary consular officers who are heads of consular posts shall rank in each class after career heads of consular posts, in the order and according to the rules laid down in the foregoing paragraphs. 6 Heads of consular posts shall have precedence over consular officers not having that status. 1965 40 16-03-1965 1986 22 05-02-1986 16-01-1986

Article 17 Performance of diplomatic acts by consular officers 1 In a State where the sending State has no diplomatic mission and is not represented by a diplomatic mission of a third State, a consular officer may, with the consent of the receiving State, and without affecting his consular status, be authorized to perform diplomatic acts. The performance of such acts by a consular officer shall not confer upon him any right to claim diplomatic privileges and immunities. 2 A consular officer may, after notification addressed to the receiving State, act as representative of the sending State to any inter-governmental organization. When so acting, he shall be entitled to enjoy any privileges and immunities accorded to such a representative by customary international law or by international agreements; however, in respect of the performance by him of any consular function, he shall not be entitled to any greater immunity from jurisdiction than that to which a consular officer is entitled under the present Convention. 1965 40 16-03-1965 1986 22 05-02-1986 16-01-1986

Article 18 Appointment of the same person by two or more States as a consular officer Two or more States may, with the consent of the receiving State, appoint the same person as a consular officer in that State. 1965 40 16-03-1965 1986 22 05-02-1986 16-01-1986

Article 19 Appointment of members of consular staff 1 Subject to the provisions of Articles 20, 22 and 23, the sending State may freely appoint the members of the consular staff. 2 The full name, category and class of all consular officers, other than the head of a consular post, shall be notified by the sending State to the receiving State in sufficient time for the receiving State, if it so wishes, to exercise its rights under paragraph 3 of Article 23. 3 exequatur The sending State may, if required by its laws and regulations, request the receiving State to grant anto a consular officer other than the head of a consular post. 4 exequatur The receiving State may, if required by its laws and regulations, grant anto a consular officer other than the head of a consular post. 1965 40 16-03-1965 1986 22 05-02-1986 16-01-1986

Article 20 Size of the consular staff In the absence of an express agreement as to the size of the consular staff, the receiving State may require that the size of the staff be kept within limits considered by it to be reasonable and normal, having regard to circumstances and conditions in the consular district and to the needs of the particular consular post. 1965 40 16-03-1965 1986 22 05-02-1986 16-01-1986

Article 21 Precedence as between consular officers of a consular post The order of precedence as between the consular officers of a consular post and any change thereof shall be notified by the diplomatic mission of the sending State or, if that State has no such mission in the receiving State, by the head of the consular post, to the Ministry for Foreign Affairs of the receiving State or to the authority designated by that Ministry. 1965 40 16-03-1965 1986 22 05-02-1986 16-01-1986

Article 22 Nationality of consular officers 1 Consular officers should, in principle, have the nationality of the sending State. 2 Consular officers may not be appointed from among persons having the nationality of the receiving State except with the express consent of that State which may be withdrawn at any time. 3 The receiving State may reserve the same right with regard to nationals of a third State who are not also nationals of the sending State. 1965 40 16-03-1965 1986 22 05-02-1986 16-01-1986

Article 23 Persons declared non grata 1 persona non grata The receiving State may at any time notify the sending State that a consular officer isor that any other member of the consular staff is not acceptable. In that event, the sending State shall, as the case may be, either recall the person concerned or terminate his functions with the consular post. 2 exequatur If the sending State refuses or fails within a reasonable time to carry out its obligations under paragraph 1 of this Article, the receiving State may, as the case may be, either withdraw thefrom the person concerned or cease to consider him as a member of the consular staff. 3 A person appointed as a member of a consular post may be declared unacceptable before arriving in the territory of the receiving State or, if already in the receiving State, before entering on his duties with the consular post. In any such case, the sending State shall withdraw his appointment. 4 In the cases mentioned in paragraphs 1 and 3 of this Article, the receiving State is not obliged to give to the sending State reasons for its decision. 1965 40 16-03-1965 1986 22 05-02-1986 16-01-1986

Article 24 Notification to the receiving State of appointments, arrivals and departures 1 The Ministry for Foreign Affairs of the receiving State or the authority designated by that Ministry shall be notified of: (a) appointment of members of a consular post, their arrival after appointment to the consular post, their final departure or the termination of their functions and any other changes affecting their status that may occur in the course of their service with the consular post; (b) the arrival and final departure of a person belonging to the family of a member of a consular post forming part of his household and, where appropriate, the fact that a person becomes or ceases to be such a member of the family; (c) the arrival and final departure of members of the private staff and, where appropriate, the termination of their service as such; (d) the engagement and discharge of persons resident in the receiving State as members of a consular post or as members of the private staff entitled to privileges and immunities. 2 When possible, prior notification of arrival and final departure shall also be given. 1965 40 16-03-1965 1986 22 05-02-1986 16-01-1986

Article 25 Termination of the functions of a member of a consular post inter alia: The functions of a member of a consular post shall come to an end (a) on notification by the sending State to the receiving State that his functions have come to an end; (b) exequatur on withdrawal of the; (c) on notification by the receiving State to the sending State that the receiving State has ceased to consider him as a member of the consular staff. 1965 40 16-03-1965 1986 22 05-02-1986 16-01-1986

Article 26 Departure from the territory of the receiving State The receiving State shall, even in case of armed conflict, grant to members of the consular post and members of the private staff, other than nationals of the receiving State, and to members of their families forming part of their households irrespective of nationality, the necessary time and facilities to enable them to prepare their departure and to leave at the earliest possible moment after the termination of the functions of the members concerned. In particular, it shall, in case of need, place at their disposal the necessary means of transport for themselves and their property other than property acquired in the receiving State the export of which is prohibited at the time of departure. 1965 40 16-03-1965 1986 22 05-02-1986 16-01-1986

Article 27 Protection of consular premises and archives and of the interests of the sending State in exceptional circumstances 1 In the event of the severance of consular relations between two States: (a) the receiving State shall, even in case of armed conflict, respect and protect the consular premises, together with the property of the consular post and the consular archives; (b) the sending State may entrust the custody of the consular premises, together with the property contained therein and the consular archives, to a third State acceptable to the receiving State; (c) the sending State may entrust the protection of its interests and those of its nationals to a third State acceptable to the receiving State. 2 a In the event of the temporary or permanent closure of a consular post, the provisions of sub-paragraph () of paragraph 1 of this Article shall apply. In addition, (a) if the sending State, although not represented in the receiving State by a diplomatic mission, has another consular post in the territory of that State, that consular post may be entrusted with the custody of the premises of the consular post which s been closed, together with the property contained therein and the consular archives, and, with the consent of the receiving State, with the exercise of consular functions in the district of that consular post; or (b) b c if the sending State has no diplomatic mission and no other consular post in the receiving State, the provisions of subparagraphs () and () of paragraph 1 of this Article shall apply. 1965 40 16-03-1965 1986 22 05-02-1986 16-01-1986

Article 28 Facilities for the work of the consular post The receiving State shall accord full facilities for the performance of the functions of the consular post. 1965 40 16-03-1965 1986 22 05-02-1986 16-01-1986

Article 29 Use of national flag and coat-of-arms 1 The sending State hall have the right to the use of its national flag and coat-of-arms in the receiving State in accordance with the provisions of this Article. 2 The national flag of the sending State may be flown and its coat-of-arms displayed on the building occupied by the consular post and at the entrance door thereof, on the residence of the head of the consular post and on his means of transport when used on official business. 3 In the exercise of the right accorded by this Article regard shall be had to the laws, regulations and usages of the receiving State. 1965 40 16-03-1965 1986 22 05-02-1986 16-01-1986

Article 30 Accommodation 1 The receiving State shall either facilitate the acquisition on its territory, in accordance with its laws and regulations, by the sending State of premises necessary for its consular post or assist the latter in obtaining accommodation in some other way. 2 It shall also, where necessary, assist the consular post in obtaining suitable accommodation for its members. 1965 40 16-03-1965 1986 22 05-02-1986 16-01-1986

Article 31 Inviolability of the consular premises 1 Consular premises shall be inviolable to the extent provided in this Article. 2 The authorities of the receiving State shall not enter that part of the consular premises which is used exclusively for the purpose of the work of the consular post except with the consent of the head of the consular post or of his designee or of the head of the diplomatic mission of the sending State. The consent of the head of die consular post may, however, be assumed in case of fire or other disaster requiring prompt protective action. 3 Subject to the provisions of paragraph 2 of this Article, the receiving State is under a special duty to take all appropriate steps to protect the consular premises against any intrusion or damage and to prevent any disturbance of the peace of the consular post or impairment of its dignity. 4 The consular premises, their furnishings, the property of the consular post and its means of transport shall be immune from any form of requisition for purposes of national defence or public utility. If expropriation is necessary for such purposes, all possible steps shall be taken to avoid impeding the performance of consular functions, and prompt, adequate and effective compensation shall be paid to the sending State. 1965 40 16-03-1965 1986 22 05-02-1986 16-01-1986

Article 32 Exemption from taxation of consular premises 1 Consular premises and the residence of the career head of consular post of which the sending State or any person acting on its behalf is the owner or lessee shall be exempt from all national, regional or municipal dues and taxes whatsoever, other than such as represent payment for specific services rendered. 2 The exemption from taxation referred to in paragraph 1 of this Article shall not apply to such dues and taxes if, under the law of the receiving State, they are payable by the person who contracted with the sending State or with the person acting on its behalf. 1965 40 16-03-1965 1986 22 05-02-1986 16-01-1986

Article 33 Inviolability of the consular archives and documents The consular archives and documents shall be inviolable at all times and wherever they may be. 1965 40 16-03-1965 1986 22 05-02-1986 16-01-1986

Article 34 Freedom of movement Subject to its laws and regulations concerning zones entry into which is prohibited or regulated for reasons of national security, the receiving State shall ensure freedom of movement and travel in its territory to all members of the consular post. 1965 40 16-03-1965 1986 22 05-02-1986 16-01-1986

Article 35 Freedom of communication 1 The receiving State shall permit and protect freedom of communication on the part of the consular post for all official purposes. In communicating with the Government, the diplomatic missions and other consular posts, wherever situated, of the sending State, the consular post may employ all appropriate means, including diplomatic or consular couriers, diplomatic or consular bags and messages in code or cipher. However, the consular post may install and use a wireless transmitter only with the consent of the receiving State. 2 The official correspondence of the consular post shall be inviolable. Official correspondence means all correspondence relating to the consular post and its functions. 3 The consular bag shall be neither opened nor detained. Nevertheless, if the competent authorities of the receiving State have serious reason to believe that the bag contains something other than the correspondence, documents or articles referred to in paragraph 4 of this Article, they may request that the bag be opened in their presence by an authorized representative of the sending State. If this request is refused by the authorities of the sending State, the bag shall be returned to its place of origin. 4 The packages constituting the consular bag shall bear visible external marks of their character and may contain only official correspondence and documents or articles intended exclusively for official use. 5 The consular courier shall be provided with an official document indicating his status and the number of packages constituting the consular bag. Except with the consent of the receiving State he shall be neither a national of the receiving State, nor, unless he is a national of the sending State, a permanent resident of the receiving State. In the performance of his functions he shall be protected by the receiving State. He shall enjoy personal inviolability and shall not be liable to any form of arrest or detention. 6 ad hoc The sending State, its diplomatic missions and its consular posts may designate consular couriers. In such cases the provisions of paragraph 5 of this Article shall also apply except that the immunities therein mentioned shall cease to apply when such a courier has delivered to the consignee the consular bag in his charge. 7 A consular bag may be entrusted to the captain of a ship or of a commercial aircraft scheduled to land at an authorized port of entry. He shall be provided with an official document indicating the number of packages constituting the bag, but he shall not be considered to be a consular courier. By arrangement with the appropriate local authorities, the consular post may send one of its members to take possession of the bag directly and freely from the captain of the ship or of the aircraft. 1965 40 16-03-1965 1986 22 05-02-1986 16-01-1986

Article 36 Communication and contact with nationals of the sending State 1 With a view to facilitating the exercise of consular functions relating to nationals of the sending State: (a) consular officers shall be free to communicate with nationals of the sending State and to have access to them. Nationals of the sending State shall have the same freedom with respect to communication with and access to consular officers of the sending State; (b) if he so requests, the competent authorities of the receiving State shall, without delay, inform the consular post of the sending State if, within its consular district, a national of that State is arrested or committed to prison or to custody pending trial or is detained in any other manner. Any communication addressed to the consular post by the person arrested, in prison, custody or detention shall also be forwarded by the said authorities without delay. The said authorities shall inform the person concerned without delay of his rights under this sub-paragraph; (c) consular officers shall have the right to visit a national of the sending State who is in prison, custody or detention, to converse and correspond with him and to arrange for his legal representation. They shall also have the right to visit any national of the sending State who is in prison, custody or detention in their district in pursuance of a judgment. Nevertheless, consular officers shall refrain from taking action on behalf of a national who is in prison, custody or detention if he expressly opposes such action. 2 The rights referred to in paragraph 1 of this Article shall be exercised in conformity with the laws and regulations of the receiving State, subject to the proviso, however, that the said laws and regulations must enable full effect to be given to the purposes for which the rights accorded under this Article are intended. 1965 40 16-03-1965 1986 22 05-02-1986 16-01-1986

Article 37 Information in cases of deaths, guardianship or trusteeship, wrecks and air accidents If the relevant information is available to the competent authorities of the receiving State, such authorities shall have the duty; (a) in the case of the death of a national of the sending State, to inform without delay the consular post in whose district the death occurred; (b) to inform the competent consular post without delay of any case where the appointment of a guardian or trustee appears to be in the interests of a minor or other person lacking full capacity who is a national of the sending State. The giving of this information shall, however, be without prejudice to the operation of the laws and regulations of the receiving State concerning such appointments; (c) if a vessel, having the nationality of the sending State, is wrecked or runs aground in the territorial sea or internal waters of the receiving State, or if an aircraft registered in the sending State suffers an accident on the territory of the receiving State, to inform without delay the consular post nearest to the scene of the occurrence. 1965 40 16-03-1965 1986 22 05-02-1986 16-01-1986

Article 41 Personal inviolability of consular officers 1 Consular officers shall not be liable to arrest or detention pending trial, except in the case of a grave crime and pursuant to a decision by the competent judicial authority. 2 Except in the case specified in paragraph 1 of this Article, consular officers shall not be committed to prison or liable to any other form of restriction on their personal freedom save in execution of a judicial decision of final effect. 3 If criminal proceedings are instituted against a consular officer, he must appear before the competent authorities. Nevertheless, the proceedings shall be conducted with the respect due to him by reason of official position and, except in the case specified in paragraph 1 of this Article, in a manner which will hamper the exercise of consular functions as little as possible. Article 42 Notification of arrest, detention or prosecution In the event of the arrest or detention, pending trial, of a member of the consular staff, or of criminal proceedings being instituted against him, the receiving State shall promptly notify the head of the consular post. Article 43 Immunity from jurisdiction 1 Consular officers and consular employees shall not be amenable to the jurisdiction of the judicial or administrative authorities of the receiving State in respect of acts performed in the exercise of consular functions. 2 The provisions of paragraph 1 of this Article shall not, however, apply in respect of a civil action either: (a) arising out of a contract concluded by a consular officer consular employee in which he did not contract expressly or impliedly as an agent of the sending State; or (b) by a third party for damage arising from an accident in the receiving State caused by a vehicle, vessel or aircraft. 1965 40 16-03-1965 1986 22 05-02-1986 16-01-1986

Article 44 Liability to give evidence 1 Members of a consular post may by called upon to attend as witnessses in the course of judicial or administrative proceedings. A consular employee or a member of the service staff shall not, except in the cases mentioned in paragraph 3 of this Article, decline to give evidence. If a consular officer should decline to do so, no coercive measure or penalty may be applied to him. 2 The authority requiring the evidence of a consular officer shall avoid interference with the performance of his functions. It may, when possible, take such evidence at his residence or at the consular post or accept a statement from him in writing. 3 Members of a consular post are under no obligation to give evidence concerning matters connected with the exercise of their functions or to produce official correspondence and documents relating thereto. Article 45 Waiver of privileges and immunities 1 The sending State may waive, with regard to a member of the consular post, any of the privileges and immunities provided for in Articles 41, 43 and 44. 2 The waiver shall in all cases be express, except as provided in paragraph 3 of this Article, and shall be communicated to the receiving State in writing. 3 The initiation of proceedings by a consular officer or a consular employee in a matter where he might enjoy immunity from jurisdiction under Article 43 shall preclude him from invoking immunity from jurisdiction in respect of any counter-claim directly connected with the principal claim. 4 The waiver of immunity from jurisdiction for the purposes of civil or administrative proceedings shall not be deemed to imply the waiver of immunity from the measures of execution resulting from the judicial decision; in respect of such measures, a separate waiver shall be necessary. 1965 40 16-03-1965 1986 22 05-02-1986 16-01-1986

Article 46 Exemption from registration of aliens and residence permits 1 Consular officers and consular employees and members of their families forming part of their households shall be exempt from all obligations under the laws and regulations of the receiving State in regard to the registration of aliens and residence permits. 2 The provisions of paragraph 1 of this Article shall not, however, apply to any consular employee who is not a permanent employee of the sending State or who carries on any private gainful occupation in the receiving State or to any member of the family of any such employee. 1965 40 16-03-1965 1986 22 05-02-1986 16-01-1986

Article 47 Exemption from work permits 1 Members of the consular post shall, with respect to services rendered for the sending State, be exempt from any obligations in regard to work permits imposed by the laws and regulations of the receiving State concerning the employment of foreign labour. 2 Members of the private staff of consular officers and of consular employees shall, if they do not carry on any other gainful occupation in the receiving State, be exempt from the obligations referred to in paragraph 1 of this Article. 1965 40 16-03-1965 1986 22 05-02-1986 16-01-1986

Article 48 Social security exemption 1 Subject to the provisions of paragraph 3 of this Article, members of the consular post with respect to services rendered by them for the sending State, and members of their families forming part of their households, shall be exempt from social security provisions which may be in force in the receiving State. 2 The exemption provided for in paragraph 1 of this Article shall apply also to members of the private staff who are in the sole employ of members of the consular post, on condition: (a) that they are not nationals of or permanently resident in the receiving State; and (b) that they are covered by the social security provisions which are in force in the sending State or a third State. 3 Members of the consular post who employ persons to whom the exemption provided for in paragraph 2 of this Article does not apply shall observe the obligations which the social security provisions of the receiving State impose upon employers. 4 The exemption provided for in paragraphs 1 and 2 of this Article shall not preclude voluntary participation in the social security system of the receiving State, provided that such participation is permitted by that State. 1965 40 16-03-1965 1986 22 05-02-1986 16-01-1986

Article 49 Exemption from taxation 1 Consular officers and consular employees and members of their families forming part of their households shall be exempt from all dues and taxes, personal or real, national, regional or municipal, except: (a) indirect taxes of a kind which are normally incorporated in the price of goods or services; (b) dues or taxes on private immovable property situated in the territory of the receiving State, subject to the provisions of Article 32; (c) b estate, succession or inheritance duties, and duties on transfers, levied by the receiving State, subject to the provisions of paragraph () of Article 51; (d) dues and taxes on private income, including capital gains, having its source in the receiving State and capital taxes relating to investments made in commercial or financial undertakings in the receiving State; (e) charges levied for specific services rendered; (f) registration, court or record fees, mortage dues and stamp duties, subject to the provisions of Article 32. 2 Members of the service staff shall be exempt from dues and taxes on the wages which they receive for their services. 3 Members of the consular post who employ persons whose wages or salaries are not exempt from income tax in the receiving State shall observe the obligations which the laws and regulations of that State impose upon employers concerning the levying of income tax. 1965 40 16-03-1965 1986 22 05-02-1986 16-01-1986

Article 50 Exemption from customs duties and inspection 1 The receiving State shall, in accordance with such laws and regulations as it may adopt, permit entry of and grant exemption from all customs duties, taxes, and related charges other than charges for storage, cartage and similar services, on: (a) articles for the official use of the consular post; (b) articles for the personal use of a consular officer or members of his family forming part of his household, including articles intended for his establishment. The articles intended for consumption shall not exceed the quantities necessary for direct utilization by the persons concerned. 2 Consular employees shall enjoy the privileges and exemptions specified in paragraph 1 of this Article in respect of articles imported at the time of first installation. 3 b Personal baggage accompanying consular officers and members of their families forming part of their households shall be exempt from inspection. It may be inspected only if there is serious reason to believe that it contains articles other than those referred to in sub-paragraph () of paragraph 1 of this Article, or articles the import or export of which is prohibited by the laws and regulations of the receiving State or which are subject to its quarantine laws and regulations. Article 51 Estate of a member of the consular post or of a member of his family In the event of the death of a member of the consular post or of a member of his family forming part of his household, the receiving State: (a) shaIl permit the export of the movable property of the deceased, with the exception of any such property acquired in the receiving State the export of which was prohibited at the time of his death; (b) shall not levy national, regional or municipal estate, succession or inheritance duties, and duties on transfers, on movable property the presence of which in the receiving State was due solely to the presence in that State of the deceased as a member of the consular post or as a member of the family of a member of the consular post. 1965 40 16-03-1965 1986 22 05-02-1986 16-01-1986

Article 52 Exemption from personal services and contributions The receiving State shall exempt members of the consular post and members of their families forming part of their households from all personal services, from all public service of any kind whatsoever, and from military obligations such as those connected with requisitioning, military contributions and billeting. 1965 40 16-03-1965 1986 22 05-02-1986 16-01-1986

Article 53 Beginning and end of consular privileges and immunities 1 Every member of the consular post shall enjoy the privileges and immunities provided in the present Convention from the moment he enters the territory of the receiving State on proceeding to take up his post or, if already in its territory, from the moment when he enters on his duties with the consular post. 2 Members, of the family of the consular post forming part of his household and members of his private staff shall receive the privileges and immunities provided in the present Convention from the date from which he enjoys privileges and immunities in accordance with paragraph 1 of this Article or from the date of their entry into the territory of the receiving State or from the date of their becoming a member of such family or private staff, whichever is the latest. 3 When the functions of a member of the consular post have come to an end, his privileges and immunities and those of a member of his family forming part of his household or a member of his private staff shall normally cease at the moment when the person concerned leaves the receiving State or on the expiry of a reasonable period in which to do so, whichever is the sooner, but shall subsist until that time, even in case of armed conflict. In the case of the persons referred to in paragraph 2 of this Article, their privileges and immunities shall come to an end when they cease to belong to the household or to be in the service of a member of the consular post provided, however, that if such persons intend leaving the receiving State within a reasonable period thereafter, their privileges and immunities shall subsist until the time of their departure. 4 However, with respect to acts performed by a consular officer or a consular employee in the exercise of his functions, immunity from jurisdiction shall continue to subsist without limitation of time. 5 In the event of the death of a member of the consular post, the members of his family forming part of his household shall continue to enjoy the privileges and immunities accorded to them until they leave the receiving State or until the expiry of a reasonable period enabling them to do so, whichever is the sooner. 1965 40 16-03-1965 1986 22 05-02-1986 16-01-1986

Article 54 Obligations of third States 1 If a consular officer passes through or is in the territory of a third State, which has granted him a visa if a visa was necessary, while proceeding to take up or return to his post or when returning to the sending State, the third State shall accord to him all immunities provided for by the other Articles of the present Convention as may be required to ensure his transit or return. The same shall apply in the case of any member of his family forming part of his household enjoying such privileges and immunities who are accompanying the consular officer or travelling separately to join him or to return to the sending State. 2 In circumstances similar to those specified in paragraph 1 of this Article, third States shall not hinder the transit through their territory of other members of the consular post or of members of their families forming part of their households. 3 Third States shall accord to official correspondence and to other official communications in transit, including message in code or cipher, the same freedom and protection as the receiving State is bound to accord under the present Convention. They shall accord to consular couriers who have been granted a visa, if a visa was necessary, and to consular bags in transit, the same inviolability and protection as the receiving State is bound to accord under the present Convention. 4 force majeure. Article 55 Respect for the laws and regulations of the receiving State 1 Without prejudice to their privileges and immunities, it is the duty of all persons enjoying such privileges and immunities to respect the laws and regulations of the receiving State. They also have a duty not to interfere in the internal affairs of that State. 2 The consular premises shall not be used in any manner incompatible with the exercise of consular functions. 3 The provisions of paragraph 2 of this Article shall not exclude the possibility of offices of other institutions or agencies being installed in part of the building in which the consular premises are situated, provided that the premises assigned to them are separate from those used by the consular post. Article 56 Insurance against third party risks Members of the consular post shall comply with any requirement imposed by the laws and regulations of the receiving State in respect of insurance against third party risks arising from the use of any vehicle, vessel or aircraft. 1965 40 16-03-1965 1986 22 05-02-1986 16-01-1986

Article 57 Special provisions concerning private gainful occupation 1 Career consular officers shall not carry on for personal profit any professional or commercial activity in the receiving State. 2 Privileges and immunities provided in this Chapter shall not be accorded: (a) to consular employees or to members of the service staff who carry on any private gainful occupation in the receiving State; (b) a to members of the family of a person referred to in subparagraph () of this paragraph or to members of his private staff; (c) to members of the family of a member of a consular post who themselves carry on any private gainful occupation in the receiving State. 1965 40 16-03-1965 1986 22 05-02-1986 16-01-1986

Article 58 General provisions relating to facilities, privileges and immunities 1 Articles 28, 29, 30, 34, 35, 36, 37, 38 and 39, paragraph 3 of Article 54 and paragraphs 2 and 3 of Article 55 shall apply to consular posts headed by an honorary consular officer. In addition, the facilities, privileges and immunities of such consular posts shall be governed by Articles 59, 60, 61 and 62. 2 Articles 42 and 43, paragraph 3 of Article 44, Articles 45 and 53 and paragraph 1 of Article 55 shall apply to honorary consular officers. In addition, the facilities, privileges and immunities: of such consular officers shall be governed by Articles 63, 64, 65, 66 and 67. 3 Privileges and immunities provided in the present Convention shall not be accorded to members of the family of an honorary consular officer or of a consular employee employed at a consular post headed by an honorary consular officer. 4 The exchange of consular bags between two consular posts headed by honorary consular officers in different States shall not be allowed without the consent of the two receiving States concerned. 1965 40 16-03-1965 1986 22 05-02-1986 16-01-1986

Article 59 Protection of the consular premises The receiving State shall take such steps as may be necessary to protect the consular premises of a consular post headed by an honorary consular officer against any intrusion or damage and to prevent any disturbance of the peace of the consular post or impairment of its dignity. 1965 40 16-03-1965 1986 22 05-02-1986 16-01-1986

Article 60 Exemption from taxation of consular premises 1 Consular premises of a consular post headed by an honorary consular officer of which the sending State is the owner or lessee shall be exempt from all national, regional or municipal dues and taxes whatsoever, other than such as represent payment for specific services rendered. 2 The exemption from taxation referred to in paragraph 1 of this Article shall not apply to such dues and taxes if, under the laws and regulations of the receiving State, they are payable by the person who contracted with the sending State. 1965 40 16-03-1965 1986 22 05-02-1986 16-01-1986

Article 61 Inviolability of consular archives and documents The consular archives and documents of a consular post headed by an honorary consular officer shall be inviolable at all times and wherever they may be, provided that they are kept separate from other papers and documents and, in particular, from the private correspondence of the head of a consular post and of any person working with him, and from the materials, books or documents relating to their profession or trade. 1965 40 16-03-1965 1986 22 05-02-1986 16-01-1986

Article 63 Criminal proceedings If criminal proceedings are instituted against an honorary consular officer, he must appear before the competent authorities. Nevertheless, the proceedings shall be conducted with the respect due to him by reason of his official position and, except when he is under arrest or detention, in a manner which will hamper the exercise of consular functions as little as possible. Article 69 Consular agents who are not heads of consular posts 1 Each State is free to decide whether it will establish or admit consular agencies conducted by consular agents not designated as heads of consular post by the sending State. 2 The conditions under which the consular agencies referred to in paragraph 1 of this Article may carry on their activities and the privileges and immunities which may be enjoyed by the consular agents in charge of them shall be determined by agreement between the sending State and the receiving State. 1965 40 16-03-1965 1986 22 05-02-1986 16-01-1986

Article 70 Exercise of consular functions by diplomatic missions 1 The provisions of the present Convention apply also, so far as the context permits, to the exercise of consular functions by a diplomatic mission. 2 The names of members of a diplomatic mission assigned to the consular section or otherwise charged with the exercise of the consular functions of the mission shall be notified to the Ministry for Foreign Affairs of the receiving State or to the authority designated by that Ministry. 3 In the exercise of consular functions a diplomatic mission may address: (a) the local authorities of the consular district; (b) the central authorities of the receiving State if this is allowed by the laws, regulations and usages of the receiving State or by relevant international agreements. 4 The privileges and immunities of the members of a diplomatic mission referred to in paragraph 2 of this Article shall continue to be governed by the rules of international law concerning diplomatic relations. 1965 40 16-03-1965 1986 22 05-02-1986 16-01-1986

Article 71 Nationals or permanent residents of the receiving State 1 Except in so far as additional facilities, privileges and immunities may be granted by the receiving State, consular officers who are nationals of or permanently resident in the receiving State shall enjoy only immunity from jurisdiction and personal inviolability in respect of official acts performed in the exercise of their functions, and the privilege provided in paragraph 3 of Article 44. So far as these consular officers are concerned, the receiving State shall likewise be bound by the obligation laid down in Article 42. If criminal proceedings are instituted against such a consular officer, the proceedings shall, except when he is under arrest or detention, be conducted in a manner which hamper the exercise of consular functions as little as possible. 2 Other members of the consular post who are nationals of or permanently resident in the receiving State and members of their families, as well as members of the families of consular officers referred to in paragraph 1 of this Article, shall enjoy facilities, privileges and immunities only in so far as these are granted to them by the receiving State. Those members of the families of members of the consular post and those members of the private staff who are themselves nationals of or permanently resident in the receiving State shall likewise enjoy facilities, privileges and immunities only in so far as these are granted to them by the receiving State. Article 72 Non-discrimination 1 In the application of the provisions of the present Convention the receiving State shall not discriminate as between States. 2 However, discrimination shall not be regarded as taking place: (a) where the receiving State applies any of the provisions of the present Convention restrictively because of a restrictive application of that provision to its consular posts in the sending State; (b) where by custom or agreement States extend to each other more favourable treatment than is required by the provisions of the present Convention. 1965 40 16-03-1965 1986 22 05-02-1986 16-01-1986

Article 74 Signature Statute of the International Court of Justice The present Convention shall be open for signature by all States Members of the United Nations or of any of the specialized agencies or Parties to the, and by any other State invited by the General Assembly of the United Nations to become a Party to the Convention, as follows until 31 October 1963 at the Federal Ministry for Foreign Affairs of the Republic of Austria and subsequently, until 31 March 1964, at the United Nations Headquarters in New York. 1965 40 16-03-1965 1986 22 05-02-1986 16-01-1986

Article 76 Accession The present Convention shall remain open for accession by any State belonging to any of the four categories mentioned in Article 74. Artikel 1 Begripsomschrijvingen 1 In dit Verdrag hebben de navolgende uitdrukkingen de hieronder aangegeven betekenissen: (a) „consulaire post”, elk consulaat-generaal, consulaat, vice-consulaat of consulair agentschap; (b) „consulair ressort”, het gebied dat is toegewezen aan een consulaire post ter uitoefening van de consulaire werkzaamheden; (c) „hoofd van een consulaire post”, de persoon die belast is met de taak om in die hoedanigheid op te treden; (d) „consulair ambtenaar”, iedere persoon, waaronder begrepen het hoofd van een consulaire post, aan wie in die hoedanigheid de uitoefening van consulaire werkzaamheden is opgedragen; (e) „consulair beambte”, iedere persoon die werkzaam is bij de administratieve of technische dienst van een consulaire post; (f) „lid van het bedienend personeel”, iedere persoon die werkzaam is bij de huishoudelijke dienst van een consulaire post; (g) „leden van de consulaire post”, consulaire ambtenaren, consulaire beambten en leden van het bedienend personeel; (h) „leden van het consulaire personeel”, consulaire ambtenaren, met uitzondering van het hoofd van een consulaire post, consulaire beambten en leden van het bedienend personeel; (i) „lid van het particuliere personeel”, een persoon die uitsluitend in particuliere dienst van een lid van de consulaire post werkzaam is; (j) „consulaire gebouwen”, de gebouwen of delen van gebouwen en de daarbij behorende terreinen, ongeacht wie daarvan de eigenaar is, die uitsluitend worden gebruikt voor de taakuitoefening van een consulaire post; (k) „consulair archief”, alle bescheiden, stukken, correspondentie, en, films, geluidsbanden en registers van de consulaire post, alsmede het codemateriaal, de kaartsystemen en de meubels bestemd voor het beschermen of opbergen van deze zaken. 2 Er bestaan twee categorieën consulaire ambtenaren, beroeps-consulaire ambtenaren en honoraire consulaire ambtenaren. Artikel 2 Aanknopen van consulaire betrekkingen 1 Het aanknopen van consulaire betrekkingen tussen de Staten geschiedt met wederzijds goedvinden. 2 Toestemming tot het aanknopen van diplomatieke betrekkingen tussen twee Staten houdt in toestemming tot het aanknopen van consulaire betrekkingen, tenzij anders is bepaald. 3 ipso facto Het verbreken der diplomatieke betrekkingen brengt niethet verbreken der consulaire betrekkingen mede. 1981 143 03-07-1981 1986 22 05-02-1986 16-01-1986

Artikel 4 Vestiging van een consulaire post 1 Een consulaire post mag slechts worden gevestigd op het grondgebied van de ontvangende Staat met toestemming van die Staat. 2 De zetel, de klasse en het consulaire ressort van de consulaire post worden vastgesteld door de zendstaat en onderworpen aan de goedkeuring van de ontvangende Staat. 3 Daarna mag de zendstaat slechts wijzigingen in de zetel, de klasse of het consulaire ressort van de consulaire post aanbrengen met toestemming van de ontvangende Staat. 4 De toestemming van de ontvangende Staat is eveneens vereist, indien een consulaat-generaal of een consulaat in een andere plaats dan die waar het is gevestigd een vice-consulaat of een consulair agentschap wenst te openen. 5 Voorafgaande uitdrukkelijke toestemming van de ontvangende Staat is eveneens vereist voor het openen van een kantoor dat deel uitmaakt van een bestaande consulaire post, buiten de zetel van deze consulaire post. 1981 143 03-07-1981 1986 22 05-02-1986 16-01-1986

Artikel 5 Consulaire werkzaamheden De consulaire werkzaamheden omvatten: (a) het behartigen van de belangen van de zendstaat en van zijn onderdanen, zowel natuurlijke als rechtspersonen, in de ontvangende Staat binnen de door het volkenrecht toegestane grenzen; (b) het bevorderen van de ontwikkeling van commerciële, economische, culturele en wetenschappelijke betrekkingen tussen de zendstaat en de ontvangende Staat, alsmede het op alle andere wijzen bevorderen van de vriendschappelijke betrekkingen tussen deze Staten overeenkomstig de bepalingen van dit Verdrag; (c) het zich met alle wettige middelen op de hoogte stellen van de omstandigheden en ontwikkelingen op commercieel, economisch, cultureel en wetenschappelijk gebied in de ontvangende Staat, het uitbrengen van verslag dienaangaande aan de Regering van de zendstaat en het geven van inlichtingen aan belanghebbenden; (d) het afgeven van paspoorten en reisdocumenten aan onderdanen van de zendstaat, alsmede van de benodigde visa en documenten aan personen die zich naar de zendstaat wensen te begeven; (e) het verlenen van hulp en bijstand aan onderdanen, hetzij natuurlijke, hetzij rechtspersonen, van de zendstaat; (f) het optreden als notaris en als ambtenaar van de burgerlijke stand, het verrichten van soortgelijke werkzaamheden, en het verrichten van bepaalde werkzaamheden van administratieve aard, voor zover de wetten en regelingen van de ontvangende Staat zich daartegen niet verzetten. (g) het beschermen van de belangen van onderdanen, zowel natuurlijke als rechtspersonen, van de zendstaat in gevallen van erfopvolging op het grondgebied van de ontvangende Staat, overeenkomstig de wetten en regelingen van de ontvangende Staat; (h) het binnen de door de wetten en regelingen van de ontvangende Staat bepaalde grenzen beschermen van de belangen van minderjarigen en andere handelingsonbekwame personen die onderdaan zijn van de zendstaat, in het bijzonder in gevallen waarin benoeming van een voogd of curator voor de personen is vereist; (i) het met inachtneming van de in de ontvangende Staat geldende gebruiken en procedures vertegenwoordigen van of het zorgen voor behoorlijke vertegenwoordiging van onderdanen van de zendstaat voor rechtbanken en andere autoriteiten van de ontvangende Staat ten einde overeenkomstig de wetten en regelingen van de ontvangende Staat te verzoeken om voorlopige maatregelen voor het behoud van de rechten en belangen van deze onderdanen in gevallen waarin deze onderdanen door afwezigheid of om welke andere reden ook, niet in staat zijn op de daarvoor bepaalde tijd de verdediging van hun rechten en belangen op zich te nemen; (j) het overbrengen van gerechtelijke en buitengerechtelijke documenten of het ten uitvoerleggen van rogatoire commissies overeenkomstig de bepalingen van van kracht zijnde internationale overeenkomsten gebreke van dergelijke overeenkomsten op een andere wijze die verenigbaar is met de wetten en regelingen van de ontvangende Staat; (k) het uitoefenen van het recht van toezicht en controle overeenkomstig de wetten en regelingen van de zendstaat, op zee- en binnenschepen die de nationaliteit van de zendstaat bezitten en op luchtvaartuigen die aldaar zijn geregistreerd alsmede op de bemanningen daarvan; (l) het verlenen van bijstand aan de onder letter k van dit artikel genoemde zeeschepen, binnenschepen en luchtvaartuigen, alsmede aan de bemanningen daarvan, het in ontvangst nemen van verklaringen betreffende de reis van deze vaartuigen, het controleren en afstempelen van de scheepspapieren en het zonder aantasting van de bevoegdheden van de autoriteiten van de ontvangende Staat instellen van een onderzoek naar incidenten die zich gedurende de reis hebben voorgedaan, alsmede het regelen van geschillen van allerlei aard tussen de kapitein, de officieren en de scheepsgezellen, voor zover de wetten en regelingen van de zendstaat zulks toelaten; (m) het verrichten van alle andere werkzaamheden door de zendstaat aan een consulaire post opgedragen, die niet verboden zijn door de wetten en regelingen van de ontvangende Staat of waartegen de ontvangende Staat geen bezwaar maakt of die zijn vermeld in de tussen de zendstaat en de ontvangende Staat van kracht zijnde internationale overeenkomsten. 1981 143 03-07-1981 1986 22 05-02-1986 16-01-1986

Artikel 6 Uitoefening van consulaire werkzaamheden buiten het consulaire ressort Een consulaire ambtenaar kan in bijzondere omstandigheden met toestemming van de ontvangende Staat zijn werkzaamheden uitoefenen buiten het consulair ressort. 1981 143 03-07-1981 1986 22 05-02-1986 16-01-1986

Artikel 7 Uitoefening van consulaire werkzaamheden in een derde Staat De zendstaat kan, na hiervan de betrokken Staten in kennis te hebben gesteld, een consulaire post die in één bepaalde Staat is gevestigd opdragen consulaire werkzaamheden in een andere Staat uit te oefenen, tenzij een der betrokken Staten zich hiertegen uitdrukkelijk verzet. 1981 143 03-07-1981 1986 22 05-02-1986 16-01-1986

Artikel 8 Uitoefening van consulaire werkzaamheden ten behoeve van een derde Staat Nadat hiervan op passende wijze kennis is gegeven aan de ontvangende Staat, kan, tenzij de ontvangende Staat hiertegen bezwaar maakt, een consulaire post van de zendstaat in de ontvangende Staat consulaire werkzaamheden uitoefenen ten behoeve van een derde Staat. 1981 143 03-07-1981 1986 22 05-02-1986 16-01-1986

Artikel 9 Indeling van hoofden van consulaire posten 1 De hoofden van consulaire posten worden in vier klassen ingedeeld, namelijk: (a) consuls-generaal; (b) consuls; (c) vice-consuls; (d) consulaire agenten. 2 Het eerste lid van dit artikel beperkt in geen enkel opzicht het recht van de Verdragsluitende Partijen benamingen vast te stellen voor consulaire ambtenaren die geen hoofd van een consulaire post zijn. 1981 143 03-07-1981 1986 22 05-02-1986 16-01-1986

Artikel 10 Benoeming en toelating van hoofden van consulaire posten 1 De hoofden van consulaire posten worden benoemd door de zendstaat en worden door de ontvangende Staat tot de uitoefening van hun werkzaamheden toegelaten. 2 Met inachtneming van de bepalingen van dit Verdrag, worden de wijzen van benoeming en toelating van het hoofd van de consulaire post beheerst door de wetten, regelingen en gebruiken van de zendstaat, onderscheidenlijk de ontvangende Staat. 1981 143 03-07-1981 1986 22 05-02-1986 16-01-1986

Artikel 11 Benoemingsbrevet of kennisgeving van de benoeming 1 Het hoofd van de consulaire post wordt door de zendstaat voorzien van een voor elke benoeming opgesteld document in de vorm van een benoemingsbrevet of een soortgelijke akte, waaruit zijn hoedanigheid blijkt, alsmede als regel zijn naam en voornamen, zijn categorie en klasse, het consulaire ressort en de zetel van de consulaire post. 2 De zendstaat doet het benoemingsbrevet of een soortgelijke akte langs diplomatieke weg of op een andere passende wijze toekomen aan de Regering van de Staat op wiens grondgebied het hoofd van de consulaire post zijn werkzaamheden zal gaan uitoefenen. 3 Indien de ontvangende Staat hiermede instemt, kan de zendstaat de ontvangende Staat in plaats van een benoemingsbrevet of soortgelijke akte een kennisgeving doen toekomen waarin de in het eerste lid van dit artikel vereiste gegevens zijn vervat. 1981 143 03-07-1981 1986 22 05-02-1986 16-01-1986

Artikel 12 Exequatur 1 Het hoofd van een consulaire post wordt tot de uitoefening van zijn werkzaamheden toegelaten door middel van een machtiging van de ontvangende Staat, die, ongeacht de vorm waarin deze machtiging is opgesteld, het exequatur wordt genoemd. 2 Een Staat die weigert een exequatur te verlenen is niet verplicht de zendstaat de redenen voor deze weigering mede te delen. 3 Met inachtneming van de bepalingen van de artikelen 13 en 15, kan het hoofd van een consulaire post zijn werkzaamheden niet aanvangen voordat hij het exequatur heeft ontvangen. 1981 143 03-07-1981 1986 22 05-02-1986 16-01-1986

Artikel 13 Voorlopige toelating van hoofden van consulaire posten In afwachting van de verlening van het exequatur, kan het hoofd van een consulaire post voorlopig tot de uitoefening van zijn werkzaamheden worden toegelaten. Artikel 14 Kennisgeving aan de autoriteiten van het consulaire ressort Zodra het hoofd van een consulaire post is toegelaten tot de uitoefening van zijn werkzaamheden, zelfs indien dit voorlopig is, stelt de ontvangende Staat de bevoegde autoriteiten van het consulaire ressort hiervan onmiddellijk in kennis. Deze zorgt er tevens voor dat de noodzakelijke maatregelen worden getroffen om het hoofd van de consulaire post in staat te stellen zijn ambtelijke werkzaamheden te verrichten en te genieten van de voordelen van de in de bepalingen van dit Verdrag voorziene behandeling. 1981 143 03-07-1981 22 05-02-1986 1986 22 05-02-1986 16-01-1986

Artikel 15 Tijdelijke uitoefening van de werkzaamheden van het hoofd van een consulaire post 1 Indien het hoofd van een consulaire post niet in staat is zijn werkzaamheden uit te oefenen of indien de post open staat, kan een tijdelijk waarnemer voorlopig optreden als hoofd van de consulaire post. 2 De naam en voornamen van de tijdelijk waarnemer van de post worden door de diplomatieke zending van de zendstaat of indien deze Staat in de ontvangende Staat niet over een dergelijke zending beschikt, door het hoofd van de consulaire post of indien deze daartoe niet in staat is, door een bevoegde autoriteit van de zendstaat, medegedeeld aan het Ministerie van Buitenlandse Zaken van de ontvangende Staat of aan een door dat Ministerie aangewezen autoriteit. Als regel dient deze mededeling van te voren te worden gedaan. De ontvangende Staat kan toelating als tijdelijk waarnemer van een post van een persoon die noch een diplomatiek ambtenaar noch een consulair ambtenaar van de zendstaat is in de ontvangende Staat, afhankelijk stellen van zijn goedkeuring. 3 De bevoegde autoriteiten van de ontvangende Staat verlenen de tijdelijk waarnemer van de post bijstand en bescherming. Zolang hij met de leiding van de post is belast, zijn de bepalingen van dit Verdrag op hem van toepassing op dezelfde grondslag als zij dit zijn op het hoofd van de desbetreffende consulaire post. De ontvangende Staat is evenwel niet verplicht een tijdelijk waarnemer van een post de faciliteiten, voorrechten of immuniteiten te verlenen, die het hoofd van de consulaire post slechts geniet onder voorwaarden waaraan de tijdelijk waarnemer van de post niet voldoet. 4 Wanneer in de in het eerste lid van dit artikel bedoelde omstandigheden, een lid van het diplomatieke personeel van de diplomatieke vertegenwoordiging van de zendstaat in de ontvangende Staat wordt aangewezen door de zendstaat als tijdelijk waarnemer van een consulaire post, blijft hij diplomatieke voorrechten en immuniteiten genieten indien de ontvangende Staat daartegen geen bezwaren heeft. 1981 143 03-07-1981 1986 22 05-02-1986 16-01-1986

Artikel 16 Rangorde van de hoofden van consulaire posten 1 De rangorde van de hoofden van consulaire posten wordt in elke klasse bepaald door de datum waarop het exequatur is verleend. 2 Indien het hoofd van een consulaire post evenwel voorlopig de uitoefening van zijn werkzaamheden wordt toegelaten voordat het exequatur is verkregen, wordt zijn rangorde bepaald door de datum van de voorlopige toelating; deze rangorde blijft gehandhaafd na de verlening van het exequatur. 3 De rangorde tussen twee of meer hoofden van consulaire posten die op dezelfde datum het exequatur of voorlopige toelating hebben verkregen, wordt bepaald door de datum waarop hun benoemingsbrevet of een soortgelijke akte dan wel de kennisgevingen bedoeld in het derde lid van artikel 11 aan de ontvangende Staat zijn aangeboden. 4 Tijdelijke waarnemers van posten komen in rangorde na alle hoofden van consulaire posten. Hun onderlinge rangorde wordt bepaald door de data waarop zij hun functie als tijdelijk waarnemer van een post hebben aangevangen, zoals die zijn aangegeven in de krachtens het tweede lid van artikel 15 gedane kennisgevingen. 5 Honoraire consulaire ambtenaren die hoofd van een consulaire post zijn, volgen in elke klasse in rang op hoofden van consulaire posten die beroepsambtenaar zijn, en wel in de volgorde en volgens de regels neergelegd in de voorgaande leden. 6 Hoofden van consulaire posten staan in rang boven consulaire ambtenaren die deze hoedanigheid niet bezitten. 1981 143 03-07-1981 1986 22 05-02-1986 16-01-1986

Artikel 17 Verrichten van diplomatieke handelingen door consulaire ambtenaren 1 In een Staat waar de zendstaat geen diplomatieke zending heeft en niet door een diplomatieke zending van een derde Staat wordt vertegenwoordigd, kan een consulaire ambtenaar, met toestemming van de ontvangende Staat, en zonder dat dit zijn consulaire status wijzigt, gemachtigd worden diplomatieke handelingen te verrichten. De verrichting van dergelijke handelingen door een consulaire ambtenaar geeft hem geen aanspraak op diplomatieke voorrechten en immuniteiten. 2 Een consulaire ambtenaar kan, nadat hiervan kennisgeving is gedaan aan de ontvangende Staat, worden belast met de vertegenwoordiging van de zendstaat bij iedere intergouvernementele organisatie. Wanneer hij in deze hoedanigheid optreedt, heeft hij recht op alle voorrechten en immuniteiten die het internationale gewoonterecht of internationale overeenkomsten een dergelijke vertegenwoordiger toekennen; ten aanzien van door hem uitgeoefende consulaire werkzaamheden heeft hij evenwel geen recht op verdergaande immuniteit van rechtsmacht dan die waarop een consulaire ambtenaar krachtens dit Verdrag recht heeft. 1981 143 03-07-1981 1986 22 05-02-1986 16-01-1986

Artikel 18 Benoeming van eenzelfde persoon als consulair ambtenaar door twee of meer Staten Twee of meer Staten kunnen, met toestemming van de ontvangende Staat, eenzelfde persoon als consulair ambtenaar in die Staat benoemen. 1981 143 03-07-1981 1986 22 05-02-1986 16-01-1986

Artikel 19 Benoeming van leden van het consulaire personeel 1 Met inachtneming van de bepalingen van de artikelen 20, 22 en 23, is de zendstaat geheel vrij leden van het consulaire personeel te benoemen. 2 De naam en voornamen, de categorie en de klasse van alle consulaire ambtenaren met uitzondering van het hoofd van de consulaire post, worden door de zendstaat aan de ontvangende Staat medegedeeld op een zodanig tijdstip dat de ontvangende Staat, indien hij zulks wenst, de hem in artikel 23, derde lid, verleende rechten, kan uitoefenen. 3 De zendstaat kan, indien zijn wetten en regelingen zulks vereisen, de ontvangende Staat verzoeken een exequatur te verlenen aan een consulaire ambtenaar die geen hoofd van een consulaire post is. 4 De ontvangende Staat kan, indien zijn wetten en regelingen zulks vereisen, een exequatur verlenen aan een consulaire ambtenaar die geen hoofd van een consulaire post is. 1981 143 03-07-1981 1986 22 05-02-1986 16-01-1986

Artikel 20 Omvang van het consulaire personeel Indien er geen uitdrukkelijke overeenkomst bestaat ten aanzien van de omvang van het consulaire personeel, kan de ontvangende Staat eisen dat de omvang van dit personeel wordt gehouden binnen de grenzen die deze Staat als redelijk en normaal beschouwt, waarbij de in het consulaire ressort heersende omstandigheden en de behoeften van de betrokken consulaire post in aanmerking worden genomen. 1981 143 03-07-1981 1986 22 05-02-1986 16-01-1986

Artikel 21 Rangorde van consulaire ambtenaren van een consulaire post De rangorde tussen de consulaire ambtenaren van een consulaire post en alle wijzigingen daarin, worden door de diplomatieke zending van de zendstaat of, indien die Staat in de ontvangende Staat niet over een zodanige zending beschikt, door het hoofd van de consulaire post, aan het Ministerie van Buitenlandse Zaken van de ontvangende Staat, of aan de door dat Ministerie aangewezen autoriteit, medegedeeld. 1981 143 03-07-1981 1986 22 05-02-1986 16-01-1986

Artikel 22 De nationaliteit van consulaire ambtenaren 1 In beginsel dienen consulaire ambtenaren de nationaliteit van de zendstaat te bezitten. 2 Personen die de nationaliteit bezitten van de ontvangende Staat kunnen slechts als consulair ambtenaar worden benoemd met de uitdrukkelijke toestemming van die Staat, die de toestemming te allen tijde kan intrekken. 3 De ontvangende Staat kan zich hetzelfde recht voorbehouden ten aanzien van onderdanen van een derde Staat die niet tevens onderdaan van de zendstaat zijn. 1981 143 03-07-1981 1986 22 05-02-1986 16-01-1986

Artikel 23 Tot persona non grata verklaarde personen 1 De ontvangende Staat kan te allen tijde de zendstaat ervan verwittigen dat een consulaire ambtenaar persona non grata is of dat een ander lid van het consulaire personeel niet aanvaardbaar is. De zendstaat roept in dergelijke gevallen de betrokken persoon terug of beëindigt zijn werkzaamheden bij de consulaire post. 2 Indien de zendstaat weigert of in gebreke blijft binnen een redelijke termijn aan zijn verplichtingen krachtens het eerste lid van dit artikel te voldoen, kan de ontvangende Staat het exequatur van de desbetreffende persoon intrekken of deze niet langer beschouwen als lid van het consulaire personeel. 3 Een persoon die is benoemd als lid van een consulaire post kan onaanvaardbaar worden verklaard voordat hij op het grondgebied van de ontvangende Staat aankomt of, indien hij zich reeds in de ontvangende Staat bevindt, voordat hij zijn werkzaamheden bij de consulaire post ontvangt. In zulke gevallen trekt de zendstaat zijn benoeming in. 4 In de in het eerste en het derde lid van dit artikel vermelde gevallen, is de ontvangende Staat niet verplicht de zendstaat de redenen voor zijn beslissing mede te delen. 1981 143 03-07-1981 1986 22 05-02-1986 16-01-1986

Artikel 24 Kennisgeving van benoeming, aankomst en vertrek aan de ontvangende Staat 1 Aan het Ministerie van Buitenlandse Zaken van de ontvangende Staat of aan de door dat Ministerie aangewezen autoriteit wordt mededeling gedaan van: a. de benoeming van leden van een consulaire post, hun aankomst na benoeming bij de consulaire post, hun definitief vertrek of de beëindiging van hun werkzaamheden en alle andere eventuele wijzigingen in hun status gedurende de periode dat zij bij de consulaire post werkzaam zijn; b. de aankomst en het definitieve vertrek van een persoon die tot het gezin van een lid van een consulaire post behoort en bij hem inwoont en in daarvoor in aanmerking komende gevallen, het feit dat een persoon een zodanig gezinslid wordt of ophoudt dit te zijn; c. de aankomst en het definitieve vertrek van leden van het particuliere personeel en, in daarvoor in aanmerking komende gevallen, de beëindiging van hun dienstverband als zodanig; d. het aannemen en ontslaan van ingezetenen van de ontvangende Staat als leden van een consulaire post of als leden van het particuliere personeel die recht hebben op voorrechten en immuniteiten. 2 Indien mogelijk dient tevens van tevoren kennis te worden gegeven van aankomst en definitief vertrek. 1981 143 03-07-1981 1986 22 05-02-1986 16-01-1986

Artikel 25 Beëindiging van de werkzaamheden van een lid van een consulaire post De werkzaamheden van een lid van een consulaire post worden onder meer beëindigd door: a. kennisgeving door de zendstaat aan de ontvangende Staat dat zijn werkzaamheden zijn beëindigd; b. intrekking van het exequatur; c. kennisgeving door de ontvangende Staat aan de zendstaat dat de ontvangende Staat hem niet meer als lid van het consulaire personeel beschouwt. 1981 143 03-07-1981 1986 22 05-02-1986 16-01-1986

Artikel 26 Vertrek van het grondgebied van de ontvangende Staat De ontvangende Staat moet, zelfs in het geval van een gewapend conflict, de leden van de consulaire post en de leden van het particuliere personeel die geen onderdanen van de ontvangende Staat zijn, alsmede bij hen inwonende gezinsleden, ongeacht hun nationaliteit, de nodige tijd en faciliteiten verlenen ten einde hen in staat te stellen hun vertrek voor te bereiden en binnen de kortst mogelijke tijd na beëindiging van hun werkzaamheden te vertrekken. In het bijzonder moet de ontvangende Staat hun, in geval van nood, de nodige vervoermiddelen ter beschikking stellen voor henzelf zowel als voor hun goederen, met uitzondering van goederen die in de ontvangende Staat verworven zijn en waarvan uitvoer ten tijde van het vertrek is verboden. 1981 143 03-07-1981 1986 22 05-02-1986 16-01-1986

Artikel 27 Bescherming van de consulaire gebouwen en archieven en van de belangen van de zendstaat in uitzonderlijke omstandigheden 1 Indien de consulaire betrekkingen tussen twee Staten worden verbroken: a. dient de ontvangende Staat, zelfs in het geval van een gewapend conflict, de consulaire gebouwen, alsmede de zich aldaar bevindende goederen en de consulaire archieven te eerbiedigen en te beschermen; b. kan de zendstaat de zorg voor de consulaire gebouwen, alsmede voor de zich aldaar bevindende goederen en de consulaire archieven, toevertrouwen aan een derde Staat die voor de ontvangende Staat aanvaardbaar is; c. kan de zendstaat de behartiging van zijn belangen en van die van zijn onderdanen toevertrouwen aan een derde Staat die voor de ontvangende Staat aanvaardbaar is. 2 Indien een consulaire post tijdelijk of voor goed wordt opgeheven, zijn de bepalignen onder letter a van het eerste lid van dit artikel van toepassing. Bovendien: a. kan de zendstaat, alhoewel hij niet in de ontvangende Staat door een diplomatieke zending is vertegenwoordigd, indien hij een andere consulaire post op het grondgebied van die Staat heeft, aan die consulaire post de zorg voor de gebouwen van de opgeheven consulaire post, alsmede voor de zich aldaar bevindende goederen en consulaire archieven opdragen en, met toestemming van de ontvangende Staat, aan die consulaire post de uitoefening van de consulaire werkzaamheden in het ressort van de opgeheven consulaire post opdragen; of b. zijn, indien de zendstaat geen diplomatieke zending en geen andere consulaire post in de ontvangende Staat heeft, de bepalingen van letters b en c van het eerste lid van dit artikel van toepassing. 1981 143 03-07-1981 1986 22 05-02-1986 16-01-1986

Artikel 28 Faciliteiten voor de werkzaamheden van de consulaire post De ontvangende Staat verleent alle faciliteiten voor de verrichting van de werkzaamheden van de consulaire post. 1981 143 03-07-1981 1986 22 05-02-1986 16-01-1986

Artikel 29 Gebruik van de nationale vlag en het nationale wapen 1 De zendstaat heeft het recht op het gebruik van zijn nationale vlag en zijn nationaal wapen in de ontvangende Staat overeenkomstig de bepalingen van dit artikel. 2 De nationale vlag van de zendstaat mag worden uitgestoken van en zijn nationaal wapen mag worden aangebracht op het gebouw dat de consulaire post huisvest, alsmede bij de toegangsdeur daarvan, alsook op de ambtswoning van het hoofd van de consulaire post en op zijn vervoermiddel wanneer dit voor officiële doeleinden wordt gebruikt. 3 Bij de uitoefening van het door dit artikel toegekende recht wordt rekening gehouden met de wetten, regelingen en gebruiken van de ontvangende Staat. 1981 143 03-07-1981 1986 22 05-02-1986 16-01-1986

Artikel 30 Huisvesting 1 De ontvangende Staat dient de zendstaat behulpzaam te zijn bij het op zijn grondgebied, in overeenstemming met zijn wetten en regelingen, verwerven van gebouwen voor de consulaire post, of de zendstaat op andere wijze bij het verkrijgen van kantoorruimte te helpen. 2 De ontvangende Staat dient, indien nodig, de consulaire post eveneens behulpzaam te zijn bij het verkrijgen van geschikte woonruimte voor de leden van de post. 1981 143 03-07-1981 1986 22 05-02-1986 16-01-1986

Artikel 31 Onschendbaarheid van de consulaire gebouwen 1 De consulaire gebouwen zijn onschendbaar voor zover zulks in dit artikel is bepaald. 2 De autoriteiten van de ontvangende Staat mogen het gedeelte van de consulaire gebouwen dat uitsluitend voor de werkzaamheden van de consulaire post wordt gebruikt slechts betreden met toestemming van het hoofd van de consulaire post of van zijn gemachtigde of van het hoofd van de diplomatieke zending van de zendstaat. De toestemming van het hoofd van de consulaire post wordt echter geacht stilzwijgend te zijn gegeven in geval van brand of een andere ramp die onmiddellijk beschermend optreden noodzakelijk maakt. 3 Met inachtneming van de bepalingen van het tweede lid van dit artikel, rust op de ontvangende Staat de bijzondere verplichting alle passende maatregelen te nemen om de consulaire gebouwen tegen indringers en tegen het toebrengen van schade te beschermen en te verhinderen dat de rust van de consulaire post op enigerlei wijze wordt verstoord of aan zijn waardigheid afbreuk wordt gedaan. 4 De consulaire gebouwen, het meubilair en de goederen, alsmede de vervoermiddelen van de consulaire post, zijn gevrijwaard tegen enigerlei vordering ter wille van de landsverdediging of het openbaar welzijn. Indien onteigening voor zulke doeleinden noodzakelijk is, dienen alle mogelijke maatregelen te worden genomen ten einde te vermijden dat de uitoefening van de consulaire werkzaamheden daarvan hinder ondervindt, en aan de zendstaat dient terstond toereikende en doelmatige schadevergoeding te worden betaald. 1981 143 03-07-1981 1986 22 05-02-1986 16-01-1986

Artikel 32 Vrijstelling van belasting van consulaire gebouwen 1 De consulaire gebouwen en de ambtswoning van het hoofd van een consulaire post, indien deze beroepsambtenaar is, waarvan de zendstaat, of een persoon die in naam van de zendstaat optreedt, eigenaar of huurder is, zijn vrijgesteld van alle landelijke, gewestelijke of gemeentelijke belastingen en rechten, tenzij het belastingen en rechten betreft, geheven wegens de verlening van bijzondere diensten. 2 De vrijstelling van belasting bedoeld in het eerste lid van dit artikel is niet van toepassing op deze belastingen en rechten indien zij krachtens de wetten en regelingen van de ontvangende Staat verschuldigd zijn door de persoon die met de zendstaat, of met de persoon die in naam van de zendstaat optreedt, een overeenkomst heeft gesloten. 1981 143 03-07-1981 1986 22 05-02-1986 16-01-1986

Artikel 33 Onschendbaarheid van de consulaire archieven en documenten De consulaire archieven en documenten zijn te allen tijde en waar zij zich ook mogen bevinden onschendbaar. 1981 143 03-07-1981 1986 22 05-02-1986 16-01-1986

Artikel 34 Vrijheid van beweging Met inachtneming van de wetten en regelingen van de ontvangende Staat met betrekking tot gebieden waarvan de toegang om redenen van nationale veiligheid verboden of aan beperkingen onderhevig is, draagt de ontvangende Staat er zorg voor dat alle leden van de consulaire post zich vrijelijk op zijn grondgebied kunnen bewegen en er vrijelijk kunnen reizen. 1981 143 03-07-1981 1986 22 05-02-1986 16-01-1986

Artikel 35 Vrijheid van verbindingen 1 Door de ontvangende Staat wordt aan de consulaire post toegestaan voor alle officiële doeleinden onbelemmerd verbindingen te onderhouden; deze verbindingen worden door de ontvangende Staat beschermd. Bij zijn verbindingen met de regering, de diplomatieke zendingen en de andere consulaire posten waar deze zich ook mogen bevinden, van de zendstaat, mag de consulaire post alle daarvoor in aanmerking komende middelen gebruiken, diplomatieke of consulaire koeriers, diplomatieke of consulaire koerierzendingen en codeberichten daarbij inbegrepen. De consulaire post mag evenwel geen radiozender installeren en gebruiken zonder toestemming van de ontvangende Staat. 2 De officiële briefwisseling van de consulaire post is onschendbaar. Onder officiële briefwisseling wordt verstaan alle op de consulaire post en zijn werkzaamheden betrekking hebbende briefwisseling. 3 De consulaire koerierzending mag niet worden geopend of vastgehouden. Indien de bevoegde autoriteiten van de ontvangende Staat echter ernstige redenen hebben om aan te nemen dat de zending iets anders bevat dan de briefwisseling, de documenten of de goederen bedoeld in het vierde lid van dit artikel, kunnen zij verzoeken dat de zending in hun aanwezigheid door een daartoe gemachtigd vertegenwoordiger van de zendstaat wordt geopend. Indien de autoriteiten van de zendstaat weigeren aan dit verzoek te voldoen, wordt de zending teruggestuurd naar de plaats van herkomst. 4 De pakketten welke de consulaire koerierzending vormen moeten aan de buitenkant duidelijk zichtbare kentekenen dragen, waaruit hun aard blijkt en mogen slechts officiële briefwisseling en documenten of uitsluitend voor officieel gebruik bestemde goederen bevatten. 5 De consulaire koerier dient een officiel document bij zich te dragen waaruit zijn hoedanigheid en het aantal pakketten dat de consulaire koerierzending vormt, blijken. Tenzij de ontvangende Staat erin toestemt, mag hij noch onderdaan van de ontvangende Staat zijn, noch, tenzij hij onderdaan van de zendstaat is, ingezetene van de ontvangende Staat zijn. Bij de uitoefening van zijn werkzaamheden, wordt hij door de ontvangende Staat beschermd. Hij geniet persoonlijke onschendbaarheid en is gevrijwaard tegen elke vorm van aanhouding of vrijheidsbeneming. 6 De zendstaat, zijn diplomatieke zendingen en zijn consulaire posten kunnen consulaire koeriers ad hoc aanwijzen. In deze gevallen zijn de bepalingen van het vijfde lid van dit artikel eveneens van toepassing, met dien verstande dat de daarin genoemde immuniteiten niet meer van toepassing zijn wanneer deze koerier de zich onder zijn hoede bevindende consulaire koerierzending aan de geadresseerde heeft afgeleverd. 7 Een consulaire zending kan worden toevertrouwd aan de gezagvoerder van een schip of van een burgerluchtvaartuig met als bestemming een officieel erkende landingsplaats. Hij dient te worden voorzien van een officieel document waaruit het aantal pakketten waaruit de consulaire zending is samengesteld blijkt, doch hij wordt niet als consulair koerier beschouwd. Na overleg met de bevoegde plaatselijke autoriteiten, kan de consulaire post een van haar leden zenden om de zending rechtstreeks en onbelemmerd uit handen van de gezagvoerder van het schip of het luchtvaartuig in ontvangst te nemen. 1981 143 03-07-1981 1986 22 05-02-1986 16-01-1986

Artikel 36 Contact met onderdanen van de zendstaat 1 Ten einde de uitoefening van de consulaire werkzaamheden met betrekking tot onderdanen van de zendstaat te vergemakkelijken: (a) moeten de consulaire ambtenaren zich vrijelijk in verbinding kunnen stellen met de onderdanen van de zendstaat en hen vrijelijk kunnen bezoeken. Onderdanen van de zendstaat moeten dezelfde vrijheid genieten met betrekking tot het contact met en het bezoeken van consulaire ambtenaren van de zendstaat; (b) moeten de bevoegde autoriteiten van de ontvangende Staat de consulaire post van de zendstaat onverwijld ervan in kennis stellen, dat binnen zijn ressort een onderdaan van die Staat is gearresteerd, gevangengenomen of in voorarrest is geplaatst of op enigerlei andere wijze in verzekerde bewaring wordt gesteld, indien de betrokkene zulks verzoekt. Elke mededeling aan de consulaire post gericht door de gearresteerde, zich in gevangenschap of in voorlopige hechtenis bevindende of anderszins vastgehouden persoon wordt door bovengenoemde autoriteiten eveneens onverwijld overgebracht. Bovengenoemde autoriteiten dienen de betrokken persoon onverwijld van zijn rechten krachtens deze alinea in kennis te stellen; (c) moeten de consulaire ambtenaren het recht hebben een onderdaan van de zendstaat die zich in arrest of in voorlopige hechtenis bevindt of op enigerlei andere wijze wordt vastgehouden, te bezoeken, met hem te spreken en met hem brieven te wisselen en te zorgen voor zijn vertegenwoordiging in rechte. Zij hebben eveneens het recht een onderdaan van de zendstaat te bezoeken, die zich in hun ressort in gevangenschap of in hechtenis bevindt voor de tenuitvoerlegging van een vonnis. De consulaire ambtenaren onthouden zich er evenwel van ten behoeve van een onderdaan op te treden, die zich in arrest of in voorlopige hechtenis bevindt of op enigerlei andere wijze wordt vastgehouden indien deze zich uitdrukkelijk daartegen verzet. 2 De in het eerste lid van dit artikel bedoelde rechten worden uitgeoefend overeenkomstig de wetten en regelingen van de ontvangende Staat, met dien verstande evenwel dat deze wetten en regelingen de verwezenlijking van de oogmerken waarvoor de in dit artikel verleende rechten zijn bedoeld, volledig moeten waarborgen. 1981 143 03-07-1981 1986 22 05-02-1986 16-01-1986

Artikel 37 Inlichtingen in geval van overlijden, voogdij of curatele, schipbreuk en vliegtuigongelukken Indien de bevoegde autoriteiten van de ontvangende Staat in het bezit zijn van de desbetreffende inlichtingen, zijn deze autoriteiten verplicht: (a) in geval van overlijden van een onderdaan van de zendstaat, de consulaire post in het ressort waarvan het overlijden plaatsvond hiervan onverwijld in kennis te stellen; (b) de bevoegde consulaire post onverwijld in kennis te stellen van alle gevallen waarin aanleiding bestaat tot benoeming van een voogd of curator over een minderjarige of handelingsonbekwame onderdaan van de zendstaat. Het verstrekken van deze inlichtingen mag evenwel de werking van de wetten en regelingen van de ontvangende Staat ten aanzien van zulke benoemingen niet aantasten; (c) indien een vaartuig dat de nationaliteit van de zendstaat bezit schipbreuk lijdt of aan de grond loopt in de territoriale zee of in de binnenwateren van de ontvangende Staat of indien een in de zendstaat ingeschreven luchtvaartuig op het grondgebied van de ontvangende Staat een ongeluk overkomt, de consulaire post die zich het dichtst bij de plaats waar het ongeluk heeft plaatsgevonden bevindt, hiervan onverwijld in kennis te stellen. 1981 143 03-07-1981 1986 22 05-02-1986 16-01-1986

Artikel 38 Contact met de autoriteiten van de ontvangende Staat Bij de uitoefening van hun werkzaamheden, kunnen de consulaire ambtenaren zich wenden tot: (a) de bevoegde plaatselijke autoriteiten van hun consulaire ressort; (b) de bevoegde centrale overheid van de ontvangende Staat indien en voor zover dit is toegestaan door de wetten, regelingen en gebruiken van de ontvangende Staat of door de desbetreffende internationale overeenkomsten. 1981 143 03-07-1981 1986 22 05-02-1986 16-01-1986

Artikel 39 Consulaire leges en heffingen 1 De consulaire post kan op het grondgebied van de ontvangende Staat de leges en heffingen waarin de wetten en regelingen van de zendstaat voor consulaire handelingen voorzien, heffen. 2 De in de vorm van leges en heffingen, als bedoeld in het eerste lid van dit artikel, geheven bedragen, alsmede de ontvangstbewijzen voor die leges en heffingen, zijn vrijgesteld van alle belastingen en rechten in de ontvangende Staat. 1981 143 03-07-1981 1986 22 05-02-1986 16-01-1986

Artikel 40 Bescherming van consulaire ambtenaren 1 De ontvangende Staat behandelt de consulaire ambtenaren met al de eerbied die hun verschuldigd is en neemt alle passende maatregelen om te verhinderen dat hun persoon, vrijheid of waardigheid in gevaar wordt gebracht. 1981 143 03-07-1981 1986 22 05-02-1986 16-01-1986

Artikel 41 Persoonlijke onschendbaarheid van de consulaire ambtenaren 1 Consulaire ambtenaren zijn gevrijwaard tegen arrestatie of voorlopige hechtenis, behalve in geval van een ernstig misdrijf en ingevolge een beslissing genomen door de bevoegde rechterlijke autoriteit. 2 Behalve in het in het eerste lid van dit artikel bedoelde geval, mogen consulaire ambtenaren niet gearresteerd worden of aan enigerlei andere vorm van beperking van hun persoonlijke vrijheid worden onderworpen, behalve bij de tenuitvoerlegging van een onherroepelijke rechterlijke uitspraak. 3 Indien tegen een consulaire ambtenaar een strafvervolging aanhangig wordt gemaakt, moet hij voor de bevoegde autoriteiten verschijnen. Het proces dient evenwel te worden gevoerd met de eerbied die hem uit hoofde van zijn officiële positie toekomt en, behalve in het in het eerste lid van dit artikel bedoelde geval, op een wijze die aan de uitoefening van de consulaire werkzaamheden zo weinig mogelijk afbreuk doet. Wanneer het in de in het eerste lid van dit artikel bedoelde omstandigheden noodzakelijk is een consulaire ambtenaar in voorlopige hechtenis te nemen, dient met het proces tegen hem zo spoedig mogelijk een aanvang te worden gemaakt. 1981 143 03-07-1981 1986 22 05-02-1986 16-01-1986

Artikel 42 Kennisgeving van arrestatie, inhechtenisneming of gerechtelijke vervolging Indien een lid van het consulaire personeel wordt gearresteerd of in voorlopige hechtenis wordt genomen, of indien tegen hem een strafvervolging aanhangig wordt gemaakt, dient de ontvangende Staat het hoofd van de consulaire post hiervan onmiddellijk in kennis te stellen. Mocht deze laatste zelf het voorwerp van een dergelijke maatregel zijn, dan dient de ontvangende Staat dit langs diplomatieke weg aan de zendstaat mede te delen. 1981 143 03-07-1981 1986 22 05-02-1986 16-01-1986

Artikel 43 Immuniteit van rechtsmacht 1 Consulaire ambtenaren en consulaire beambten zijn niet onderworpen aan de rechtsmacht van de rechterlijke of administratieve autoriteiten van de ontvangende Staat ten aanzien van handelingen verricht bij de uitoefening van hun consulaire taak. 2 De bepalingen van het eerste lid van dit artikel zijn evenwel niet van toepassing met betrekking tot een civiele procedure die: a. hetzij voortvloeit uit een overeenkomst gesloten door een consulaire ambtenaar of een consulaire beambte waarbij hij niet uitdrukkelijk of stilzwijgend als gevolmachtigde van de zendstaat optrad; b. hetzij is ingesteld door een derde in verband met schade voortvloeiende uit een ongeval in de ontvangende Staat veroorzaakt door een voertuig, vaartuig of luchtvaartuig. 1981 143 03-07-1981 1986 22 05-02-1986 16-01-1986

Artikel 44 Verplichting om als getuige op te treden 1 De leden van een consulaire post kunnen worden opgeroepen om als getuige op te treden bij gerechtelijke of administratieve procedures. Een consulaire beambte of een lid van het bedienend personeel mag, behalve in de gevallen genoemd in het derde lid van dit artikel niet weigeren als getuige op te treden. Indien een consulaire ambtenaar weigert dit te doen, mag er geen dwang op hem worden uitgeoefend of een strafmaatregel tegen hem worden genomen. 2 De autoriteit die de getuigenis van een consulaire ambtenaar verzoekt, draagt er zorg voor dat deze daardoor in de uitoefening van zijn werkzaamheden niet wordt belemmerd. Zij kan hem waar mogelijk een verhoor als getuige afnemen te zijnen huize of op de consulaire post of van hem een schriftelijke verklaring aanvaarden. 3 De leden van een consulaire post zijn niet gehouden als getuigen op te treden inzake aangelegenheden verband houdende met de uitoefening van hun werkzaamheden of officiële briefwisseling en documenten die daarop betrekking hebben over te leggen. Zij hebben eveneens het recht te weigeren als getuige-deskundige met betrekking tot het recht van de zendstaat op te treden. 1981 143 03-07-1981 1986 22 05-02-1986 16-01-1986

Artikel 45 Afstand van voorrechten en immuniteiten 1 De zendstaat kan, met betrekking tot een lid van de consulaire post, afstand doen van de in de artikelen 41, 43 en 44 bedoelde voorrechten en immuniteiten. 2 Het afstand doen dient steeds uitdrukkelijk kenbaar te worden gemaakt, behoudens het bepaalde in het derde lid, van dit artikel, en dient schriftelijk ter kennis van de ontvangende Staat te worden gebracht. 3 Indien een consulaire ambtenaar of een consulaire beambte een rechtsgeding aanhangig maakt in een zaak waarin hij immuniteit van rechtsmacht zou kunnen genieten krachtens artikel 43, kan hij zich ten aanzien van een eis in reconventie die rechtstreeks verband houdt met de eis in conventie niet beroepen op immuniteit van rechtsmacht. 4 Afstand van immuniteit van rechtsmacht ten aanzien van burgerrechtelijke of administratiefrechtelijke procedures wordt niet geacht afstand van immuniteit ten aanzien van de maatregelen genomen ter uitvoering van een gerechtelijke beslissing in te houden; met betrekking tot dergelijke maatregelen is een afzonderlijk afstand doen van immuniteit noodzakelijk. 1981 143 03-07-1981 1986 22 05-02-1986 16-01-1986

Artikel 46 Vrijstelling van vreemdelingenregistratie en van verblijfsvergunningen 1 Consulaire ambtenaren en consulaire beambten en hun inwonende gezinsleden zijn vrijgesteld van alle verplichtingen krachtens de wetten en regelingen van de ontvangende Staat met betrekking tot vreemdelingenregistratie en verblijfsvergunningen. 2 De bepalingen van het eerste lid van dit artikel zijn evenwel niet van toepassing op een consulaire beambte die niet in vaste dienst van de zendstaat is of die in de ontvangende Staat een eigen winstgevend beroep uitoefent of op een gezinslid van zulk een beambte. 1981 143 03-07-1981 1986 22 05-02-1986 16-01-1986

Artikel 47 Vrijstelling van werkvergunning 1 De leden van de consulaire post zijn ten aanzien van voor de zendstaat verrichte diensten, vrijgesteld van elke verplichting met betrekking tot werkvergunningen opgelegd door de wetten en regelingen van de ontvangende Staat betreffende de tewerkstelling van buitenlandse arbeidskrachten. 2 Leden van het particuliere personeel van consulaire ambtenaren en van consulaire beambten zijn, indien zij geen ander op winst gericht beroep in de ontvangende Staat uitoefenen, vrijgesteld van de verplichtingen bedoeld in het eerste lid van dit artikel. 1981 143 03-07-1981 1986 22 05-02-1986 16-01-1986

Artikel 48 Vrijstelling van verplichte deelname aan sociale verzekeringen 1 Met inachtneming van de bepalingen van het derde lid van dit artikel zijn de leden van de consulaire post ten aanzien van door hen voor de zendstaat verrichte diensten, alsmede hun inwonende gezinsleden, vrijgesteld van de eventueel in de ontvangende Staat van kracht zijnde voorschriften op het gebied van de sociale verzekering. 2 De in het eerste lid van dit artikel bedoelde vrijstelling geldt ook voor leden van het particuliere personeel die uitsluitend in dienst zijn van leden van de consulaire post, op voorwaarde: (a) dat zij geen onderdaan zijn van of duurzaam verblijf houden in de ontvangende Staat: en (b) dat op hen de voorschriften op het gebied van de sociale verzekering van toepassing zijn, die in de zendstaat of in een derde Staat van kracht zijn. 3 Leden van de consulaire post die personen in dienst hebben waarop de in het tweede lid van dit artikel bedoelde vrijstelling niet van toepassing is, dienen de verplichtingen in acht te nemen, die de voorschriften op het gebied van de sociale verzekering van de ontvangende Staat aan werkgevers opleggen. 4 De in het eerste en het tweede lid van dit artikel bedoelde vrijstelling sluit vrijwillige deelneming aan het stelsel van sociale verzekering van de ontvangende Staat niet uit, mits deze Staat deelneming toestaat. 1981 143 03-07-1981 1986 22 05-02-1986 16-01-1986

Artikel 49 Vrijstelling van belasting 1 Consulaire ambtenaren en consulaire beambten alsmede hun inwonende gezinsleden zijn vrijgesteld van alle belastingen en rechten, zowel persoonlijke als zakelijke, hetzij landelijke, dan wel gewestelijke of gemeentelijke belastingen met uitzondering van: (a) indirecte belastingen die normaal in de prijs van de goederen of diensten begrepen zijn; (b) belastingen of rechten op particulier onroerend goed dat gelegen is op het grondgebied van de ontvangende Staat, met inachtneming van de bepalingen van artikel 32; (c) door de ontvangende Staat met inachtneming van de bepalingen van lid (b) van artikel 51 geheven successierechten en overdrachtsrechten; (d) belastingen en rechten op particulier inkomen, daaronder begrepen vermogenswinsten, welks bron is gelegen in de ontvangende Staat en vermogensbelastingen op in commerciële of financiële ondernemingen in de ontvangende Staat belegd vermogen; (e) heffingen wegens bepaalde verleende diensten; (f) registratie-, griffie- en hypotheekrechten en zegelrecht, behoudens het bepaalde in artikel 32. 2 Leden van het bedienend personeel zijn vrijgesteld van rechten en belastingen op het loon dat zij voor hun diensten ontvangen. 3 Leden van de consulaire post die personen in dienst hebben wier loon of salaris niet vrijgesteld is van inkomstenbelasting in de ontvangende Staat houden zich aan de verplichtingen welke de wetten en regelingen van die Staat met betrekking tot de heffing van inkomstenbelasting opleggen aan werkgevers. 1981 143 03-07-1981 1986 22 05-02-1986 16-01-1986

Artikel 50 Vrijstelling van douanerechten en douaneonderzoek 1 De ontvangende Staat laat de binnenkomst toe van: (a) goederen voor het officiële gebruik van de consulaire post; (b) goederen voor het persoonlijke gebruik van een consulaire ambtenaar of inwonende gezinsleden, daaronder begrepen goederen voor zijn inrichting. De goederen bedoeld voor verbruik mogen de hoeveelheden die noodzakelijk zijn voor het direct gebruik door de betrokken personen niet te boven gaan en verleent vrijstelling van alle douanerechten, belastingen en daarmee verband houdende heffingen, met uitzondering van heffingen voor opslag, vervoer en dergelijke diensten, ten aanzien van die goederen, een en ander in overeenstemming met eventueel door deze Staat aan te nemen wetten en regelingen. 2 Consulaire beambten genieten de in het eerste lid van dit artikel omschreven voorrechten en vrijstellingen met betrekking tot goederen, ingevoerd op het tijdstip waarop zij zich de eerste keer inrichten. 3 De persoonlijke bagage die consulaire ambtenaren en hun inwonende gezinsleden vergezelt, is vrijgesteld van douaneonderzoek. Zij mag slechts worden onderzocht indien er ernstige redenen bestaan om aan te nemen dat zij andere goederen bevat dan die bedoeld in letter (b) van het eerste lid van dit artikel, of goederen waarvan de in- of uitvoer verboden is door de wetten en regelingen van de ontvangende Staat, ofwel goederen die onderworpen zijn aan wetten en regelingen van die Staat met betrekking tot quarantaine. Onderzoek mag slechts plaats vinden in aanwezigheid van de betrokken consulaire ambtenaar of het betrokken gezinslid. 1981 143 03-07-1981 1986 22 05-02-1986 16-01-1986

Artikel 51 Nalatenschap van een lid van de consulaire post of van een gezinslid In geval van overlijden van een lid van de consulaire post of van een inwonend gezinslid, dient de ontvangende Staat: (a) de uitvoer toe te staan van de roerende goederen van de overledene, met uitzondering van in die Staat verworven goederen waarvan de uitvoer op het tijdstip van zijn overlijden verboden is; (b) geen landelijke, gewestelijke of gemeentelijke successierechten en overdrachtsrechten te heffen op roerende goederen, waarvan de aanwezigheid in de ontvangende Staat uitsluitend het gevolg was van de aanwezigheid aldaar van de overledene als lid van de consulaire post of als gezinslid van een lid van de consulaire post. 1981 143 03-07-1981 1986 22 05-02-1986 16-01-1986

Artikel 52 Vrijstelling van persoonlijk dienstbetoon en persoonlijke bijdragen De ontvangende Staat stelt leden van de consulaire post en hun inwonende gezinsleden vrij van elk persoonlijk dienstbetoon, van elk openbaar dienstbetoon van welke aard dan ook, en van militaire verplichtingen zoals vordering, militaire bijdragen en inkwartiering. 1981 143 03-07-1981 1986 22 05-02-1986 16-01-1986

Artikel 53 Begin en beëindiging van consulaire voorrechten en immuniteiten 1 Ieder lid van de consulaire post geniet de voorrechten en immuniteiten waarin dit Verdrag voorziet vanaf het ogenblik waarop hij het grondgebied van de ontvangende Staat betreedt om zijn functie te aanvaarden, of, indien hij zich reeds op het grondgebied van die Staat bevindt, vanaf het ogenblik waarop hij zijn werkzaamheden bij de consulaire post aanvaardt. 2 Inwonende gezinsleden van een lid van de consulaire post en leden van zijn particuliere personeel genieten de voorrechten en immuniteiten waarin dit Verdrag voorziet met ingang van de datum waarop hij voorrechten en immuniteiten geniet overeenkomstig het eerste lid van dit artikel of met ingang van de datum dat zij het grondgebied van de ontvangende Staat binnentreden of met ingang van de datum dat zij lid worden van het gezin of van het particuliere personeel, al naar gelang welke van deze data de laatste is. 3 Wanneer de werkzaamheden van een lid van de consulaire post zijn beëindigd, houden zijn voorrechten en immuniteiten en die van een inwonend gezinslid of van een lid van zijn particuliere personeel als regel op te bestaan op het ogenblik waarop hij de ontvangende Staat verlaat, of na het verstrijken van een redelijke termijn om deze Staat te verlaten, al naar gelang welke van deze twee data de eerste is, doch zij blijven tot dat tijdstip van kracht, zelfs in geval van een gewapend conflict. De voorrechten en immuniteiten van de in het tweede lid van dit artikel bedoelde personen vervallen wanneer deze personen niet meer inwonend zijn of niet meer in dienst zijn van een lid van de consulaire post, met dien verstande evenwel dat indien zulke personen van plan zijn de ontvangende Staat binnen een redelijke termijn daarna te verlaten, hun voorrechten en immuniteiten van kracht blijven tot het tijdstip van vertrek. 4 Met betrekking evenwel tot handelingen verricht door een consulaire ambtenaar of een consulaire beambte bij de uitoefening van zijn werkzaamheden, blijft de immuniteit van rechtsmacht zonder tijdslimiet van kracht. 5 Ingeval van het overlijden van een lid van de consulaire post, blijven de inwonende gezinsleden de hun verleende voorrechten en immuniteiten genieten totdat zij de ontvangende Staat verlaten of tot het verstrijken van een redelijke termijn die hun voor dit doel is toegestaan, al naar gelang welke van deze twee data de eerste is. 1981 143 03-07-1981 1986 22 05-02-1986 16-01-1986

Artikel 54 Verplichtingen van derde Staten 1 Indien een consulaire ambtenaar op doorreis is door, of zich bevindt op het grondgebied van een derde Staat, die hem een visum heeft verleend indien zulk een visum vereist was, terwijl hij op weg is om zijn werkzaamheden op zijn post te aanvaarden of om naar zijn post terug te keren, of wanneer hij naar de zendstaat terugkeert, verleent de derde Staat hem alle immuniteiten waarin de andere artikelen van dit Verdrag voorzien voor zijn doorreis of terugkeer. Hetzelfde geldt voor de inwonende gezinsleden die voorrechten en immuniteiten genieten en die de consulaire ambtenaar vergezellen of afzonderlijk reizen of zich bij hem te voegen of naar de zendstaat terug te keren. 2 In omstandigheden die van dezelfde aard zijn als die omschreven in het tweede lid van dit artikel, belemmeren derde Staten niet de doorreis door hun grondgebied van andere leden van de consulaire post of van inwonende gezinsleden. 3 Derde Staten verlenen aan officiële briefwisseling en aan andere officiële berichten die via hun grondgebied worden geleid, waaronder begrepen codeberichten, dezelfde vrijheid en bescherming als de ontvangende Staat krachtens dit Verdrag moeten verlenen. Zij verlenen de consulaire koeriers aan wie een visum is verleend indien zulk een visum vereist was, en consulaire koerierszendingen die via hun grondgebied worden geleid, dezelfde onschendbaarheid en bescherming als de ontvangende Staat krachtens dit Verdrag moet verlenen. 4 De verplichtingen van derde Staten krachtens het eerste, tweede en derde lid van dit artikel zijn ook van toepassing op de in deze leden onderscheidenlijk genoemde personen, alsmede op officiële berichten en consulaire koerierszendingen, waarvan de aanwezigheid op het grondgebied van de derde Staat aan overmacht te wijten is. 1981 143 03-07-1981 1986 22 05-02-1986 16-01-1986

Artikel 55 Eerbiediging van de wetten en regelingen van de ontvangende Staat 1 Onverminderd hun voorrechten en immuniteiten is het de plicht van alle personen die deze voorrechten en immuniteiten genieten de wetten en regelingen van de ontvangende Staat te eerbiedigen. Zij hebben ook de plicht zich niet te mengen in de binnenlandse aangelegenheden van die Staat. 2 De gebouwen van de consulaire post mogen niet worden gebruikt op een wijze die onverenigbaar is met de consulaire werkzaamheden. 3 De bepalingen van het tweede lid van dit artikel sluiten de mogelijkheid niet uit dat kantoren van andere instellingen of agentschappen worden ondergebracht in een gedeelte van het bouwwerk waarin de consulaire gebouwen zijn ondergebracht, mits de hun toegewezen gebouwen gescheiden zijn van die welke worden gebruikt door de consulaire post. In zulke gevallen worden deze kantoren, wat dit Verdrag betreft, niet geacht deel uit te maken van de consulaire gebouwen. 1981 143 03-07-1981 1986 22 05-02-1986 16-01-1986

Artikel 56 Wettelijke aansprakelijkheidsverzekering De leden van de consulaire post dienen zich te houden aan alle verplichtingen opgelegd door de wetten en regelingen van de ontvangende Staat met betrekking tot wettelijke aansprakelijkheidsverzekering in verband met het gebruik van een voertuig, vaartuig of luchtvaartuig. 1981 143 03-07-1981 1986 22 05-02-1986 16-01-1986

Artikel 57 Bijzondere bepalingen betreffende de uitoefening van een particulier op winst gericht beroep of bedrijf 1 Beroeps-consulaire ambtenaren mogen in de ontvangende Staat geen beroeps- of bedrijfsbezigheid uitoefenen gericht op persoonlijk gewin. 2 De voorrechten en immuniteiten waarin dit hoofdstuk voorziet worden niet toegekend: (a) aan consulaire beambten of aan leden van het bedienend personeel die in de ontvangende Staat een particulier winstgevend beroep of bedrijf uitoefenen; (b) aan leden van het gezin van een in alinea (a) van dit lid bedoelde persoon of aan leden van zijn particulier personeel; (c) aan leden van het gezin van een lid van een consulaire post die zelf een particulier winstgevend beroep of bedrijf in de ontvangende Staat uitoefenen. 1981 143 03-07-1981 1986 22 05-02-1986 16-01-1986

Artikel 58 Algemene bepalingen met betrekking tot faciliteiten, voorrechten en immuniteiten 1 De artikelen 28, 29, 30, 34, 35, 36, 37, 38, 39, 54, derde lid, en 55, tweede en derde lid, zijn van toepassing op consulaire posten die geleid worden door een honoraire consulaire ambtenaar. Bovendien worden de faciliteiten, voorrechten en immuniteiten van dergelijke consulaire posten beheerst door de artikelen 59, 60, 61 en 62. 2 De artikelen 42 en 43, 44, derde lid, 45, 53 en 55, eerste lid, zijn van toepassing op honoraire consulaire ambtenaren. Bovendien worden de faciliteiten, voorrechten en immuniteiten van dergelijke consulaire ambtenaren beheerst door de artikelen 63, 64, 65, 66 en 67. 3 De voorrechten en immuniteiten waarin dit Verdrag voorziet worden niet toegekend aan gezinsleden van een honoraire consulaire ambtenaar of van een consulaire beambte die werkzaam is bij een consulaire post die wordt geleid door een honoraire consulaire ambtenaar. 4 De uitwisseling van consulaire koerierszendingen tussen twee consulaire posten die geleid worden door honoraire consulaire ambtenaren en gelegen zijn in verschillende Staten is slechts toegestaan met toestemming van de twee betrokken ontvangende Staten. 1981 143 03-07-1981 1986 22 05-02-1986 16-01-1986

Artikel 59 Bescherming van de consulaire gebouwen De ontvangende Staat neemt de maatregelen die noodzakelijk zijn om de consulaire gebouwen van een consulaire post die geleid wordt door een honoraire consulaire ambtenaar te beschermen tegen indringers en tegen het toebrengen van schade en te verhinderen dat de rust van de consulaire post op enigerlei wijze wordt verstoord of aan zijn waardigheid afbreuk wordt gedaan. 1981 143 03-07-1981 1986 22 05-02-1986 16-01-1986

Artikel 60 Vrijstelling van belasting van consulaire gebouwen 1 De consulaire gebouwen van een consulaire post die geleid wordt door een honoraire consulaire ambtenaar waarvan de zendstaat de eigenaar of huurder is, zijn vrijgesteld van alle landelijke, gewestelijke of gemeentelijke belastingen en rechten, tenzij zij worden geheven wegens het verlenen van bepaalde diensten. 2 De vrijstelling van belasting bedoeld in het eerste lid van dit artikel is niet van toepassing op deze belastingen en rechten indien zij krachtens de wetten en regelingen van de ontvangende Staat moeten worden betaald door de persoon die met de zendstaat een overeenkomst heeft gesloten. 1981 143 03-07-1981 1986 22 05-02-1986 16-01-1986

Artikel 61 Onschendbaarheid der consulaire archieven en documenten De consulaire archieven en documenten van een consulaire post die geleid wordt door een honoraire consulaire ambtenaar zijn te allen tijde en waar deze zich ook mogen bevinden onschendbaar, mits zij gescheiden worden gehouden van andere papieren en documenten en in het bijzonder van de particuliere correspondentie van het hoofd van een consulaire post en van iedere persoon die met hem samenwerkt, alsmede van de goederen, boeken of documenten die betrekking hebben op hun beroep of bedrijf. 1981 143 03-07-1981 1986 22 05-02-1986 16-01-1986

Artikel 62 Vrijstelling van douanerechten De ontvangende Staat laat in overeenstemming met eventueel door deze Staat aan te nemen wetten en regelingen, de binnenkomst toe van, en verleent vrijstelling van alle douanerechten, belastingen en daarmee verband houdende heffingen, met uitzondering van heffingen voor opslag, vervoer en dergelijke diensten, voor de volgende goederen, mits deze bestemd zijn voor het officiële gebruik van een consulaire post die geleid wordt door een honoraire consulaire ambtenaar: wapenschilden, vlaggen, naamborden, zegels en stempels, boeken, officieel drukwerk, kantoormeubilair, kantoorbenodigdheden en dergelijke door of op verzoek van de zendstaat aan de consulaire post verstrekte goederen. 1981 143 03-07-1981 1986 22 05-02-1986 16-01-1986

Artikel 63 Strafprocedure Indien tegen een honoraire consulaire ambtenaar een strafprocedure wordt ingesteld, moet hij voor de bevoegde autoriteiten verschijnen. Deze procedure moet evenwel worden gevoerd met de eerbied die hem vanwege zijn officiële positie toekomt en, behalve wanneer hij gearresteerd is of zich in hechtenis bevindt, op een wijze die de uitoefening van de consulaire werkzaamheden zo weinig mogelijk bemoeilijkt. Wanneer het noodzakelijk is geworden een honoraire consulaire ambtenaar in voorlopige hechtenis te nemen, dient de procedure tegen hem zo spoedig mogelijk te worden aangevangen. 1981 143 03-07-1981 1986 22 05-02-1986 16-01-1986

Artikel 65 Vrijstelling van vreemdelingenregistratie en verblijfsvergunning Honoraire consulaire ambtenaren, met uitzondering van hen die in de ontvangende Staat een op winst gericht beroep of bedrijf uitoefenen, zijn vrijgesteld van alle verplichtingen krachtens de wetten en regelingen van de ontvangende Staat met betrekking tot vreemdelingenregistratie en verblijfsvergunning. 1981 143 03-07-1981 1986 22 05-02-1986 16-01-1986

Artikel 67 Vrijstelling van persoonlijk dienstbetoon en persoonlijke bijdragen De ontvangende Staat stelt honoraire consulaire ambtenaren vrij van elk persoonlijk dienstbetoon, van elk openbaar dienstbetoon van welke aard dan ook, en van militaire verplichtingen zoals vordering, militaire bijdragen en inkwartiering. 1981 143 03-07-1981 1986 22 05-02-1986 16-01-1986

Artikel 69 Consulaire agenten die geen hoofd van een consulaire post zijn 1 Het staat elke Staat vrij te beslissen of hij consulaire agentschappen wil oprichten of toelaten, die worden geleid door consulaire agenten die door de zendstaat niet zijn aangewezen als hoofd van een consulaire post. 2 De voorwaarden waaronder de in het eerste lid van dit artikel bedoelde consulaire agentschappen hun werkzaamheden kunnen uitoefenen en de voorrechten en immuniteiten die de consulaire agenten die er de leiding van hebben kunnen genieten, worden vastgesteld in overeenstemming tussen de zendstaat en de ontvangende Staat. 1981 143 03-07-1981 1986 22 05-02-1986 16-01-1986

Artikel 70 De uitoefening van consulaire werkzaamheden door diplomatieke zendingen 1 De bepalingen van dit Verdrag zijn eveneens van toepassing op de uitoefening van consulaire werkzaamheden door een diplomatieke zending, en wel voor zover dit Verdrag zulks toelaat. 2 De namen van de leden van een diplomatieke zending die zijn verbonden aan de consulaire afdeling of anderszins zijn belast met de uitoefening van de consulaire werkzaamheden van de zending, worden medegedeeld aan het Ministerie van Buitenlandse Zaken van de ontvangende Staat of aan de door dat Ministerie aangewezen autoriteit. 3 Bij de uitoefening van consulaire werkzaamheden kan een diplomatieke zending zich richten tot: (a) de plaatselijke autoriteiten van het consulaire ressort; (b) de centrale overheid van de ontvangende Staat, indien zulks is toegestaan door de wetten, regelingen en gebruiken van de ontvangende Staat of door hierop betrekking hebbende internationale overeenkomsten. 4 De voorrechten en immuniteiten van de leden van een in het tweede lid van dit artikel bedoelde diplomatieke zending blijven beheerst door de regels van het internationale recht betreffende diplomatieke betrekkingen. 1981 143 03-07-1981 1986 22 05-02-1986 16-01-1986

Artikel 71 Onderdanen of ingezetenen van de ontvangende Staat 1 Behalve voor zover bijkomende faciliteiten, voorrechten en immuniteiten door de ontvangende Staat worden verleend, genieten consulaire ambtenaren die onderdaan zijn van, of duurzaam verblijf houden in de ontvangende Staat slechts immuniteit van rechtsmacht en persoonlijke onschendbaarheid met betrekking tot officiële handelingen verricht in de uitoefening van hun werkzaamheden, alsmede het in het derde lid van artikel 44 bedoelde voorrecht. Voor zover het deze consulaire ambtenaren betreft, is de ontvangende Staat eveneens gebonden door de in artikel 42 neergelegde verplichting. Indien tegen zulk een consulaire ambtenaar een strafprocedure wordt aanhangig gemaakt, wordt deze procedure, behalve wanneer hij is gearresteerd of zich in hechtenis bevindt, gevoerd op een wijze die de uitoefening van de consulaire werkzaamheden zo weinig mogelijk bemoeilijkt. 2 Andere leden van de consulaire post die onderdaan zijn van, of duurzaam verblijf houden in de ontvangende Staat en hun gezinsleden, alsmede de gezinsleden van de consulaire ambtenaren bedoeld in het eerste lid van dit artikel, genieten slechts faciliteiten, voorrechten en immuniteiten voor zover deze hun door de ontvangende Staat worden verleend. Die gezinsleden van leden van de consulaire post en die leden van het particuliere personeel die zelf onderdaan zijn van, of duurzaam verblijf houden in de ontvangende Staat genieten eveneens slechts faciliteiten, voorrechten en immuniteiten voor zover deze hun door de ontvangende Staat worden verleend. De ontvangende Staat oefent echter zijn rechtsmacht over deze personen uit op een wijze die de uitoefening van de werkzaamheden van de consulaire post niet onnodig hindert. 1981 143 03-07-1981 1986 22 05-02-1986 16-01-1986

Artikel 72 Non-discriminatie 1 Bij de toepassing van de bepalingen van dit Verdrag maakt de ontvangende Staat geen onderscheid tussen de Staten. 2 Onderscheid wordt evenwel niet geacht te zijn gemaakt: (a) indien de ontvangende Staat enigerlei bepaling van dit Verdrag op beperkte wijze toepast omdat die bepaling op zijn consulaire posten in de zendstaat beperkt wordt toegepast; (b) indien krachtens gewoonterecht of overeenkomst de Staten elkaar een gunstiger behandeling toekennen dan bij dit Verdrag is voorgeschreven. 1981 143 03-07-1981 1986 22 05-02-1986 16-01-1986

Artikel 73 De verhouding tussen dit Verdrag en andere internationale overeenkomsten 1 De bepalingen van dit Verdrag laten andere internationale overeenkomsten die van kracht zijn tussen de Staten die daarbij partij zijn, onverlet. 2 Geen enkele bepaling van dit Verdrag verhindert de Staten internationale overeenkomsten te sluiten die de bepalingen van dit Verdrag bevestigen, aanvullen of uitbreiden of de werkingssfeer daarvan vergroten. 1981 143 03-07-1981 1986 22 05-02-1986 16-01-1986

Artikel 74 Ondertekening statuut van het Internationale Gerechtshof Dit Verdrag staat open ter ondertekening door alle Staten die lid zijn van de Verenigde Naties of van een der gespecialiseerde organisaties, dan wel Partij zijn bij het, alsmede door elke andere Staat die door de Algemene Vergadering van de Verenigde Naties wordt uitgenodigd Partij bij dit Verdrag te worden, en wel: tot 31 oktober 1963 bij het Bondsministerie van Buitenlandse Zaken van de Republiek Oostenrijk en na die datum, tot 31 maart 1964, bij de zetel der Verenigde Naties te New York. 1981 143 03-07-1981 1986 22 05-02-1986 16-01-1986

Artikel 77 Inwerkingtreding 1 Dit Verdrag treedt in werking op de dertigste dag na de datum van nederlegging van de tweeëntwintigste akte van bekrachtiging of toetreding bij de Secretaris-Generaal van de Verenigde Naties. 2 Ten aanzien van elke Staat die dit Verdrag bekrachtigt of ertoe toetreedt na de nederlegging van de tweeëntwintigste akte van bekrachtiging of toetreding, treedt het Verdrag in werking op de dertigste dag na de datum waarop die Staat zijn akte van bekrachtiging of toetreding heeft nedergelegd. 1981 143 03-07-1981 1986 22 05-02-1986 16-01-1986

Artikel 78 Kennisgeving door de Secretaris-Generaal De Secretaris-Generaal van de Verenigde Naties stelt alle Staten die tot een van de vier in artikel 74 bedoelde categorieën behoren, in kennis van: (a) de ondertekening van dit Verdrag, en de nederlegging van akten van bekrachtiging of toetreding overeenkomstig de artikelen 74, 75 en 76; (b) de datum waarop dit Verdrag overeenkomstig artikel 77 in werking zal treden. 1981 143 03-07-1981 1986 22 05-02-1986 16-01-1986
