Gezamenlijk Protocol betreffende de toepassing van het Verdrag van Wenen en het Verdrag van Parijs

Article I In this Protocol: (a) "Vienna Convention" means the Vienna Convention on Civil Liability for Nuclear Damage of 21 May 1963 and any amendment thereto which is in force for a Contracting Party to this Protocol; (b) Paris Convention "" means the Paris Convention on Third Party Liability in the Field of Nuclear Energy of 29 July 1960 and any amendment thereto which is in force for a Contracting Party to this Protocol. 1988 160 23-12-1988 01-08-1991 1992 57 10-04-1992 27-04-1992

Article II For the purpose of this Protocol: (a) Paris Convention The operator of a nuclear installation situated in the territory of a Party to the Vienna Convention shall be liable in accordance with that Convention for nuclear damage suffered in the territory of a Party to both theand this Protocol; (b) Paris Convention The operator of a nuclear installation situated in the territory of a Party to theshall be liable in accordance with that Convention for nuclear damage suffered in the territory of a Party to both the Vienna Convention and this Protocol. 1988 160 23-12-1988 01-08-1991 1992 57 10-04-1992 27-04-1992

Article III 1 Paris Convention Either the Vienna Convention or theshall apply to a nuclear incident to the exclusion of the other. 2 In the case of a nuclear incident occurring in a nuclear installation, the applicable Convention shall be that to which the State is a Party within whose territory that installation is situated. 3 Article 4(a) and (b) of the Paris Convention In the case of a nuclear incident outside a nuclear installation and involving nuclear material in the course of carriage, the applicable Convention shall be that to which the State is a Party within whose territory the nuclear installation is situated whose operator is liable pursuant to either Article II.1(b) and (c) of the Vienna Convention or. 1988 160 23-12-1988 01-08-1991 1992 57 10-04-1992 27-04-1992

Article VI 1 Paris Convention This Protocol is subject to ratification, acceptance, approval or accession. Instruments of ratification, acceptance or approval shall only be accepted from States Party to either the Vienna Convention or the. Any such State which has not signed this Protocol may accede to it. 2 The instruments of ratification, acceptance, approval or accession shall be deposited with the Director General of the International Atomic Energy Agency, who is hereby designated as the depositary of this Protocol. 1988 160 23-12-1988 01-08-1991 1992 57 10-04-1992 27-04-1992

Article VII 1 Paris Convention This Protocol shall come into force three months after the date of deposit of instruments of ratification, acceptance, approval or accession by at least five States Party to the Vienna Convention and five States Party to the. For each State ratifying, accepting, approving or acceding to this Protocol after the deposit of the above-mentioned instruments this Protocol shall enter into force three months after the date of deposit of the instrument of ratification, acceptance, approval or accession. 2 Paris Convention This Protocol shall remain in force as long as both the Vienna Convention and theare in force. 1988 160 23-12-1988 01-08-1991 1992 57 10-04-1992 27-04-1992

Article IX 1 Paris Convention Any Contracting Party which ceases to be a Party to either the Vienna Convention or theshall notify the depositary of the termination of the application of that Convention with respect to it and of the date such termination takes effect. 2 Paris Convention This Protocol shall cease to apply to a Contracting Party which has terminated application of either the Vienna Convention or theon the date such termination takes effect. 1988 160 23-12-1988 01-08-1991 1992 57 10-04-1992 27-04-1992

Article X Paris Convention The depositary shall promptly notify Contracting Parties and States invited to the Conference on the relationship between theand the Vienna Convention as well as the Secretary General of the Organisation for Economic Co-operation and Development of: (a) Each signature of this Protocol; (b) Each deposit of an instrument of ratification, acceptance, approval or accession concerning this Protocol; (c) The entry into force of this Protocol; (d) Any denunciation; and (e) Any information received pursuant to Article IX. 1988 160 23-12-1988 01-08-1991 1992 57 10-04-1992 27-04-1992

Artikel II Voor de toepassing van dit Protocol: (a) Verdrag van Parijs is de exploitant van een kerninstallatie gelegen op het grondgebied van een Partij bij het Verdrag van Wenen overeenkomstig dat Verdrag aansprakelijk voor kernschade geleden op het grondgebied van een Partij zowel bij hetals bij dit Protocol. Artikel III 1 Verdrag van Parijs Op een kernongeval is ofwel het Verdrag van Wenen, ofwel hetvan toepassing, met uitsluiting van het andere Verdrag. 2 In geval van een kernongeval dat zich voordoet in een kerninstallatie, is het van toepassing zijnde Verdrag het Verdrag waarbij de Staat partij is, op het grondgebied waarvan die kerninstallatie is gelegen. 3 artikel 4, letters a en b, van het Verdrag van Parijs In geval van een kernongeval buiten een kerninstallatie waarbij nucleaire stoffen betrokken zijn gedurende vervoer, is het van toepassing zijnde Verdrag het Verdrag waarbij de Staat partij is, op het grondgebied waarvan de kerninstallatie is gelegen waarvan de exploitant aansprakelijk is uit hoofde van artikel II, eerste lid, letters b en c, van het Verdrag van Wenen of. 1988 160 23-12-1988 01-08-1991 1992 57 10-04-1992 27-04-1992

Artikel IV 1 Verdrag van Parijs De artikelen I tot en met XV van het Verdrag van Wenen worden ten aanzien van de Verdragsluitende Partijen bij dit Protocol die Partij zijn bij hetop dezelfde wijze toegepast als tussen Partijen bij het Verdrag van Wenen. 2 artikelen 1 tot en met 14 van het Verdrag van Parijs Verdrag van Parijs Deworden ten aanzien van de Verdragsluitende Partijen bij dit Protocol die Partij zijn bij het Verdrag van Wenen op dezelfde wijze toegepast als tussen Partijen bij het. 1988 160 23-12-1988 01-08-1991 1992 57 10-04-1992 27-04-1992

Artikel V Verdrag van Parijs Dit Protocol staat van 21 september 1988 tot aan de datum van zijn inwerkingtreding op de zetel van de Internationale Organisatie voor Atoomenergie open voor ondertekening door alle Staten die het Verdrag van Wenen of hethebben ondertekend of bekrachtigd, dan wel daartoe zijn toegetreden. 1988 160 23-12-1988 01-08-1991 1992 57 10-04-1992 27-04-1992

Artikel VI 1 Verdrag van Parijs Dit Protocol is onderworpen aan bekrachtiging, aanvaarding, goedkeuring of toetreding. Akten van bekrachtiging, aanvaarding of goedkeuring worden slechts aanvaard van Staten die Partij zijn bij het Verdrag van Wenen of bij het. Bedoelde Staten die dit Protocol niet hebben ondertekend, kunnen hiertoe toetreden. 2 De akten van bekrachtiging, aanvaarding, goedkeuring of toetreding worden nedergelegd bij de Directeur-Generaal van de Internationale Organisatie voor Atoomenergie, die hierbij wordt aangewezen als depositaris van dit Protocol. 1988 160 23-12-1988 01-08-1991 1992 57 10-04-1992 27-04-1992

Artikel VII 1 Verdrag van Parijs Dit Protocol treedt in werking drie maanden na de datum van nederlegging van akten van bekrachtiging, aanvaarding, goedkeuring of toetreding door ten minste vijf Staten die Partij zijn bij het Verdrag van Wenen en vijf Staten die Partij zijn bij het. Voor elke Staat die dit Protocol bekrachtigt, aanvaardt of goedkeurt, dan wel hiertoe toetreedt na de nederlegging van de bovengenoemde akten treedt dit Protocol in werking drie maanden na de datum van nederlegging van de akte van bekrachtiging, aanvaarding, goedkeuring of toetreding. 2 Verdrag van Parijs Dit Protocol blijft van kracht zolang het Verdrag van Wenen en hetvan kracht zijn. 1988 160 23-12-1988 01-08-1991 1992 57 10-04-1992 27-04-1992

Artikel VIII 1 Elke Verdragsluitende Partij kan dit Protocol opzeggen door middel van een schriftelijke kennisgeving aan de depositaris. 2 De opzegging wordt van kracht één jaar na de datum waarop de kennisgeving door de depositaris werd ontvangen. 1988 160 23-12-1988 01-08-1991 1992 57 10-04-1992 27-04-1992

Artikel IX 1 Verdrag van Parijs Elke Verdragsluitende Partij die ophoudt Partij te zijn bij het Verdrag van Wenen of hetstelt de depositaris in kennis van de beëindiging van de toepassing van dat Verdrag ten aanzien van haar en van de datum waarop deze beëindiging van kracht wordt. 2 Verdrag van Parijs Dit Protocol houdt op van toepassing te zijn ten aanzien van een Verdragsluitende Partij die de toepassing van het Verdrag van Wenen of hetheeft beëindigd op de datum waarop deze beëindiging van kracht wordt. 1988 160 23-12-1988 01-08-1991 1992 57 10-04-1992 27-04-1992

Artikel X Verdrag van Parijs De depositaris stelt de Verdragsluitende Partijen en de Staten die waren uitgenodigd voor de Conferentie inzake het verband tussen heten het Verdrag van Wenen, alsmede de Secretaris-Generaal van de Organisatie voor Economische Samenwerking en Ontwikkeling onverwijld in kennis van: (a) Elke ondertekening van dit Protocol; (b) Elke nederlegging van een akte van bekrachtiging, aanvaarding, goedkeuring of toetreding betreffende dit Protocol; (c) De inwerkingtreding van dit Protocol; (d) Elke opzegging; en (e) Elke uit hoofde van artikel IX ontvangen inlichting. 1988 160 23-12-1988 01-08-1991 1992 57 10-04-1992 27-04-1992

Artikel XI Verdrag van Parijs Het origineel van dit Protocol, waarvan de Arabische, de Chinese, de Engelse, de Franse, de Russische en de Spaanse tekst gelijkelijk authentiek zijn, wordt nedergelegd bij de depositaris, die gewaarmerkte afschriften zal toezenden aan de Verdragsluitende Partijen en de Staten die waren uitgenodigd voor de Conferentie inzake het verband tussen heten het Verdrag van Wenen, alsmede de Secretaris-Generaal van de Organisatie voor Economische Samenwerking en Ontwikkeling. 1988 160 23-12-1988 01-08-1991 1992 57 10-04-1992 27-04-1992
