Memorandum van Overeenstemming inzake het vermijden van overlappingen en geschillen met betrekking tot zeebodemgebieden

Article 1 1 Upon attribution by the Preparatory Commission, to the INTEROCEANMETAL Joint Organization certified by the Republic of Bulgaria, the Republic of Cuba, the Czech and Slovak Federal Republic, the Republic of Poland and the Union of Soviet Socialist Republics as a pioneer investor, of the area referred to in Annex I to this Memorandum, the Governments of Belgium, Canada, Germany, Italy, the Netherlands, and the United Kingdom shall respect that area. 2 The Governments of the Republic of Bulgaria, the Republic of Cuba, the Czech and Slovak Federal Republic, the Republic of Poland and the Union of Soviet Socialist Republics shall respect the areas referred to in Annex II to this Memorandum. 3 The obligations referred to in paragraphs 1 and 2 above shall not apply to those areas relinquished by the Parties in the future. 1992 64 15-04-1992 08-12-1992 1993 102 17-08-1993 09-04-1993

Article 2 1 The Governments of Belgium, Canada, Germany, Italy, the Netherlands, and the United Kingdom shall not act, themselves or in association with third parties, in a manner that could prevent registration of the application which has been submitted by the Republic of Poland acting on behalf of other certifying States of the INTEROCEANMETAL Joint Organization to the Preparatory Commission, for the area referred to in Annex I to this Memorandum. 2 The Governments of the Republic of Bulgaria, the Republic of Cuba, the Czech and Slovak Federal Republic, the Republic of Poland and the Union of Soviet Socialist Republics shall not act, themselves or in association with third parties, in a manner that could prevent registration of applications which may be submitted in the future by any or all the other Parties for any or all of the areas referred to in Annex II to this Memorandum. 1992 64 15-04-1992 08-12-1992 1993 102 17-08-1993 09-04-1993

Article 3 The Parties shall not engage in or support by action of their domestic authorities or in concert with third parties, the exploration and exploitation of hard mineral resources in the areas mentioned in Article 1 in a manner incompatible with the obligation contained in that Article. 1992 64 15-04-1992 08-12-1992 1993 102 17-08-1993 09-04-1993

Article 4 The Parties shall take all appropriate measures to ensure that there is no physical interference with the activities of each other relating to the exploration and exploitation of hard mineral resources in the areas referred to in Article 1. 1992 64 15-04-1992 08-12-1992 1993 102 17-08-1993 09-04-1993

Article 6 1 This Memorandum shall enter into force upon the signatures of the Government of the Kingdom of Belgium, the Government of Canada, the Government, of the Federal Republic of Germany, the Government of the Italian Republic, the Government of the Kingdom of the Netherlands and the Government of the United Kingdom of Great Britain and Northern Ireland, on the one hand, and the Government of the Republic of Bulgaria, the Government of the Republic of Cuba, the Government of the Czech and Slovak Federal Republic, the Government of the Republic of Poland and the Government of the Union of Soviet Socialist Republics, on the other hand, effective August 20, 1991, and shall remain in force until otherwise agreed by the Parties. The Annexes to this Memorandum are an integral part thereof. 2 Any Party may declare, upon signature, that this Memorandum shall enter into force for that Party only after notification to all other Parties that all legal requirements have been met. Artikel 1 1 Na toewijzing door de Voorbereidende Commissie aan het Consortium INTEROCEANMETAL - in zijn hoedanigheid van pionier-investeerder - erkend door de Republiek Bulgarije, de Republiek Cuba, de Republiek Polen, de Tsjechische en Slowaakse Federatieve Republiek en de Unie van Socialistische Sovjetrepublieken van het in bijlage I bij dit Memorandum genoemde gebied zullen de Regeringen van België, Canada, Duitsland, Italië, Nederland en het Verenigd Koninkrijk dat gebied eerbiedigen. 2 De Regeringen van de Republiek Bulgarije, de Republiek Cuba, de Republiek Polen, de Tsjechische en Slowaakse Federatieve Republiek en de Unie van Socialistische Sovjetrepublieken zullen de in bijlage II bij dit Memorandum genoemde gebieden eerbiedigen. 3 De in het eerste en tweede lid hierboven bedoelde verplichtingen zijn niet van toepassing op de gebieden waarvan in de toekomst door de Partijen afstand is gedaan. 1992 64 15-04-1992 08-12-1992 1993 102 17-08-1993 09-04-1993

Artikel 2 1 De Regeringen van België, Canada, Duitsland, Italië, Nederland en het Verenigd Koninkrijk zullen, zelf of samen met derden, niet zodanig handelen dat daardoor de registratie van het verzoek dat door de Republiek Polen, handelend namens de andere Staten in het Consortium INTEROCEANMETAL verenigd, bij de Voorbereidende Commissie is ingediend, voor enige of alle in bijlage I bij dit Memorandum genoemde gebieden wordt belet. 2 De Regeringen van de Republiek Bulgarije, de Republiek Cuba, de Republiek Polen, de Tsjechische en Slowaakse Federatieve Republiek en de Unie van Socialistische Sovjetrepublieken zullen, zelf of samen met derden, niet zodanig handelen dat daardoor de registratie van verzoeken die in de toekomst door enige of alle andere Partijen ten aanzien van enige of alle in bijlage II bij dit Memorandum genoemde gebieden kunnen worden ingediend, wordt belet. 1992 64 15-04-1992 08-12-1992 1993 102 17-08-1993 09-04-1993

Artikel 3 De Partijen zullen niet overgaan tot, of door optreden van hun eigen overheidsinstanties dan wel in samenwerking met derden ondersteuning bieden aan de exploratie en exploitatie van vaste minerale rijkdommen in de in artikel 1 bedoelde gebieden op een wijze die niet verenigbaar is met de in dat artikel vervatte verplichting. 1992 64 15-04-1992 08-12-1992 1993 102 17-08-1993 09-04-1993

Artikel 4 De Partijen zullen alle passende maatregelen nemen om te waarborgen dat er geen fysieke belemmering plaatsvindt van elkaars werkzaamheden die verband houden met de exploratie en exploitatie van vaste minerale rijkdommen in de in artikel 1 bedoelde gebieden. 1992 64 15-04-1992 08-12-1992 1993 102 17-08-1993 09-04-1993

Artikel 5 Indien noodzakelijk zullen de Partijen overleg plegen over vraagstukken die verband houden met de tenuitvoerlegging van dit Memorandum. 1992 64 15-04-1992 08-12-1992 1993 102 17-08-1993 09-04-1993

Artikel 6 1 Dit Memorandum wordt van kracht op de datum van ondertekening door de Regering van het Koninkrijk België, de Regering van de Bondsrepubliek Duitsland, de Regering van Canada, de Regering van de Italiaanse Republiek, de Regering van het Koninkrijk der Nederlanden en de Regering van het Verenigd Koninkrijk van Groot-Brittannië en Noord-Ierland, enerzijds, en de Regering van de Republiek Bulgarije, de Regering van de Republiek Cuba, de Regering van de Republiek Polen, de Regering van de Tsjechische en Slowaakse Federatieve Republiek en de Regering van de Unie van Socialistische Sovjetrepublieken, anderzijds, met ingang van 20 augustus 1991 en blijft van kracht tenzij anders overeengekomen door de Partijen. De bijlagen bij dit Memorandum vormen een integrerend onderdeel van het Memorandum. 2 Een Partij kan, bij ondertekening, verklaren dat dit Memorandum ten aanzien van die partij eerst in werking treedt na kennisgeving aan alle andere Partijen dat aan alle wettelijke vereisten is voldaan.
