Protocol nr. 12 bij het Verdrag tot bescherming van de rechten van de mens en de fundamentele vrijheden

Article 1 General prohibition of discrimination 1 The enjoyment of any right set forth by law shall be secured without discrimination on any ground such as sex, race, colour, language, religion, political or other opinion, national or social origin, association with a national minority, property, birth or other status. 2 No one shall be discriminated against by any public authority on any ground such as those mentioned in paragraph 1. 2001 18 26-01-2001 28-07-2004 2005 184 10-08-2005 01-04-2005

Article 2 Territorial application 1 Any State may, at the time of signature or when depositing its instrument of ratification, acceptance or approval, specify the territory or territories to which this Protocol shall apply. 2 Any State may at any later date, by a declaration addressed to the Secretary General of the Council of Europe, extend the application of this Protocol to any other territory specified in the declaration. In respect of such territory the Protocol shall enter into force on the first day of the month following the expiration of a period of three months after the date of receipt by the Secretary General of such declaration. 3 Any declaration made under the two preceding paragraphs may, in respect of any territory specified in such declaration, be withdrawn or modified by a notification addressed to the Secretary General of the Council of Europe. The withdrawal or modification shall become effective on the first day of the month following the expiration of a period of three months after the date of receipt of such notification by the Secretary General. 4 paragraph 1 of Article 56 of the Convention A declaration made in accordance with this article shall be deemed to have been made in accordance with. 5 Article 34 of the Convention Any State which has made a declaration in accordance with paragraph 1 or 2 of this article may at any time thereafter declare on behalf of one or more of the territories to which the declaration relates that it accepts the competence of the Court to receive applications from individuals, non-governmental organisations or groups of individuals as provided byin respect of Article 1 of this Protocol. 2001 18 26-01-2001 28-07-2004 2005 184 10-08-2005 01-04-2005

Article 3 Relationship to the Convention Convention As between the States Parties, the provisions of Articles 1 and 2 of this Protocol shall be regarded as additional articles to the, and all the provisions of the Convention shall apply accordingly. 2001 18 26-01-2001 28-07-2004 2005 184 10-08-2005 01-04-2005

Article 4 Signature and ratification Convention This Protocol shall be open for signature by member States of the Council of Europe which have signed the. It is subject to ratification, acceptance or approval. A member State of the Council of Europe may not ratify, accept or approve this Protocol without previously or simultaneously ratifying the Convention. Article 5 Entry into force 1 This Protocol shall enter into force on the first day of the month following the expiration of a period of three months after the date on which ten member States of the Council of Europe have expressed their consent to be bound by the Protocol in accordance with the provisions of Article 4. 2 In respect of any member State which subsequently expresses its consent to be bound by it, the Protocol shall enter into force on the first day of the month following the expiration of a period of three months after the date of the deposit of the instrument of ratification, acceptance or approval. 2001 18 26-01-2001 28-07-2004 2005 184 10-08-2005 01-04-2005

Article 6 Depositary functions The Secretary General of the Council of Europe shall notify all the member States of the Council of Europe of: a) any signature; b) the deposit of any instrument of ratification, acceptance or approval; c) any date of entry into force of this Protocol in accordance with Articles 2 and 5; d) any other act, notification or communication relating to this Protocol. 2001 18 26-01-2001 28-07-2004 2005 184 10-08-2005 01-04-2005

Artikel 1 Algemeen verbod van discriminatie 1 Het genot van elk in de wet neergelegd recht moet worden verzekerd zonder enige discriminatie op welke grond dan ook, zoals geslacht, ras, kleur, taal, godsdienst, politieke of andere mening, nationale of maatschappelijke afkomst, het behoren tot een nationale minderheid, vermogen, geboorte of andere status. 2 Niemand mag worden gediscrimineerd door enig openbaar gezag op met name een van de in het eerste lid vermelde gronden. 2001 18 26-01-2001 28-07-2004 2005 184 10-08-2005 01-04-2005

Artikel 2 Territoriale werkingssfeer 1 Iedere Staat kan op het tijdstip van ondertekening of van nederlegging van zijn akte van bekrachtiging, aanvaarding of goedkeuring, het grondgebied of de grondgebieden aanwijzen waarop dit Protocol van toepassing is. 2 Iedere Staat kan op elk later tijdstip, door middel van een aan de Secretaris-Generaal van de Raad van Europa gerichte verklaring, de toepassing van dit Protocol uitbreiden tot ieder ander in de verklaring aangewezen. Met betrekking tot dat gebied treedt het Protocol in werking op de eerste dag van de maand volgende op het verstrijken van een tijdvak van drie maanden na de datum waarop die verklaring door de Secretaris-Generaal is ontvangen. 3 Iedere ingevolge de twee voorgaande leden afgelegde verklaring kan, met betrekking tot elk in die verklaring aangewezen grondgebied, worden ingetrokken of gewijzigd door middel van een aan de Secretaris-Generaal van de Raad van Europa gerichte kennisgeving De intrekking of wijziging wordt van kracht op de eerste dag van de maand volgende op het verstrijken van een tijdvak van drie maanden na de datum waarop die kennisgeving door de Secretaris-Generaal is ontvangen. 4 artikel 56, eerste lid, van het Verdrag. Een overeenkomstig dit artikel afgelegde verklaring wordt geacht te zijn afgelegd overeenkomstig 5 artikel 34 van het Verdrag Iedere Staat die een verklaring heeft afgelegd overeenkomstig het eerste of tweede lid van dit artikel kan op elk later tijdstip, met betrekking tot een of meer gebieden die in de verklaring worden bedoeld, verklaren dat hij de bevoegdheid van het Hof aanvaardt om kennis te nemen van verzoekschriften van particulieren, niet-gouvernementele organisaties of groepen van particulieren, zoals bepaald in, uit hoofde van artikel 1 van dit Protocol. 2001 18 26-01-2001 28-07-2004 2005 184 10-08-2005 01-04-2005

Artikel 3 Verhouding tot het Verdrag Verdrag De Staten die Partij zijn beschouwen de artikelen 1 en 2 van dit Protocol als aanvullende artikelen van het, en alle bepalingen van het Verdrag zijn dienovereenkomstig van toepassing. 2001 18 26-01-2001 28-07-2004 2005 184 10-08-2005 01-04-2005

Artikel 4 Ondertekening en bekrachtiging Verdrag Dit Protocol staat open voor ondertekening voor de lidstaten van de Raad van Europa voor wie hetis ondertekend. Het is onderworpen aan bekrachtiging, aanvaarding of goedkeuring. Een lidstaat van de Raad van Europa kan dit Protocol niet bekrachtigen, aanvaarden of goedkeuren, tenzij die Staat eerder of tegelijkertijd het Verdrag heeft bekrachtigd. De akten van bekrachtiging, aanvaarding of goedkeuring dienen te worden nedergelegd bij de Secretaris-Generaal van de Raad van Europa. 2001 18 26-01-2001 28-07-2004 2005 184 10-08-2005 01-04-2005

Artikel 5 Inwerkingtreding 1 Verdrag Dit Protocol treedt in werking op de eerste dag van de maand die volgt na het verstrijken van een tijdvak van drie maanden na de datum waarop tien lidstaten van de Raad van Europa het feit dat zij ermee instemmen door hette worden gebonden tot uitdrukking hebben gebracht overeenkomstig het bepaalde in artikel 4. 2 Met betrekking tot iedere lidstaat die later het feit dat hij ermee instemt door het Protocol te worden gebonden tot uitdrukking brengt, treedt het Protocol in werking op de eerste dag van de maand volgende op het verstrijken van een tijdvak van drie maanden na de datum van de nederlegging van de akte van bekrachtiging, aanvaarding of goedkeuring. 2001 18 26-01-2001 28-07-2004 2005 184 10-08-2005 01-04-2005

Artikel 6 Taken van de Depositaris De Secretaris-Generaal van de Raad van Europa geeft alle lidstaten van de Raad van Europa kennis van: a. iedere ondertekening; b. de nederlegging van iedere akte van bekrachtiging, aanvaarding of goedkeuring; c. iedere datum van inwerkingtreding van dit Protocol in overeenstemming met de artikelen 2 en 5; d. iedere andere handeling, kennisgeving of mededeling met betrekking tot dit Protocol. 2001 18 26-01-2001 28-07-2004 2005 184 10-08-2005 01-04-2005
