Article 1 General provision and scope of application 1 Charter of the United Nations In conformity with theand of the rules of the international law of armed conflict applicable to them, High Contracting Parties agree to comply with the obligations specified in this Protocol, both individually and in co-operation with other High Contracting Parties, to minimise the risks and effects of explosive remnants of war in post-conflict situations. 2 This Protocol shall apply to explosive remnants of war on the land territory including internal waters of High Contracting Parties. 3 This Protocol shall apply to situations resulting from conflicts referred to in Article 1, paragraphs 1 to 6, of the Convention, as amended on 21 December 2001. 4 Articles 3, 4, 5 and 8 of this Protocol apply to explosive remnants of war other than existing explosive remnants of war as defined in Article 2, paragraph 5 of this Protocol. 2004 227 27-09-2004 18-07-2005 2006 136 30-06-2006 12-11-2006

Article 2 Definitions For the purpose of this Protocol, 1. Explosive ordnance means conventional munitions containing explosives, with the exception of mines, booby traps and other devices as defined in Protocol II of this Convention as amended on 3 May 1996. 2. Unexploded ordnance means explosive ordnance that has been primed, fused, armed, or otherwise prepared for use and used in an armed conflict. It may have been fired, dropped, launched or projected and should have exploded but failed to do so. 3. Abandoned explosive ordnance means explosive ordnance that has not been used during an armed conflict, that has been left behind or dumped by a party to an armed conflict, and which is no longer under control of the party that left it behind or dumped it. Abandoned explosive ordnance may or may not have been primed, fused, armed or otherwise prepared for use. 4. Explosive remnants of war means unexploded ordnance and abandoned explosive ordnance. 5. Existing explosive remnants of war means unexploded ordnance and abandoned explosive ordnance that existed prior to the entry into force of this Protocol for the High Contracting Party on whose territory it exists. 2004 227 27-09-2004 18-07-2005 2006 136 30-06-2006 12-11-2006

Article 3 Clearance, removal or destruction of explosive remnants of war 1 Each High Contracting Party and party to an armed conflict shall bear the responsibilities set out in this Article with respect to all explosive remnants of war in territory under its control. In cases where a user of explosive ordnance which has become explosive remnants of war, does not exercise control of the territory, the user shall, after the cessation of active hostilities, provide where feasible, inter alia technical, financial, material or human resources assistance, bilaterally or through a mutually agreed third party, including inter alia through the United Nations system or other relevant organisations, to facilitate the marking and clearance, removal or destruction of such explosive remnants of war. 2 After the cessation of active hostilities and as soon as feasible, each High Contracting Party and party to an armed conflict shall mark and clear, remove or destroy explosive remnants of war in affected territories under its control. Areas affected by explosive remnants of war which are assessed pursuant to paragraph 3 of this Article as posing a serious humanitarian risk shall be accorded priority status for clearance, removal or destruction. 3 After the cessation of active hostilities and as soon as feasible, each High Contracting Party and party to an armed conflict shall take the following measures in affected territories under its control, to reduce the risks posed by explosive remnants of war: a) survey and assess the threat posed by explosive remnants of war; b) assess and prioritise needs and practicability in terms of marking and clearance, removal or destruction; c) mark and clear, remove or destroy explosive remnants of war; d) take steps to mobilise resources to carry out these activities. 4 In conducting the above activities High Contracting Parties and parties to an armed conflict shall take into account international standards, including the International Mine Action Standards. 5 High Contracting Parties shall co-operate, where appropriate, both among themselves and with other states, relevant regional and international organisations and non-governmental organisations on the provision of inter alia technical, financial, material and human resources assistance including, in appropriate circumstances, the undertaking of joint operations necessary to fulfil the provisions of this Article. 2004 227 27-09-2004 18-07-2005 2006 136 30-06-2006 12-11-2006

Article 4 Recording, retaining and transmission of information 1 High Contracting Parties and parties to an armed conflict shall to the maximum extent possible and as far as practicable record and retain information on the use of explosive ordnance or abandonment of explosive ordnance, to facilitate the rapid marking and clearance, removal or destruction of explosive remnants of war, risk education and the provision of relevant information to the party in control of the territory and to civilian populations in that territory. 2 High Contracting Parties and parties to an armed conflict which have used or abandoned explosive ordnance which may have become explosive remnants of war shall, without delay after the cessation of active hostilities and as far as practicable, subject to these parties' legitimate security interests, make available such information to the party or parties in control of the affected area, bilaterally or through a mutually agreed third party including inter alia the United Nations or, upon request, to other relevant organisations which the party providing the information is satisfied are or will be undertaking risk education and the marking and clearance, removal or destruction of explosive remnants of war in the affected area. 3 In recording, retaining and transmitting such information, the High Contracting Parties should have regard to Part 1 of the Technical Annex. 2004 227 27-09-2004 18-07-2005 2006 136 30-06-2006 12-11-2006

Article 5 Other precautions for the protection of the civilian population, individual civilians and civilian objects from the risks and effects of explosive remnants of war 1 High Contracting Parties and parties to an armed conflict shall take all feasible precautions in the territory under their control affected by explosive remnants of war to protect the civilian population, individual civilians and civilian objects from the risks and effects of explosive remnants of war. Feasible precautions are those precautions which are practicable or practicably possible, taking into account all circumstances ruling at the time, including humanitarian and military considerations. These precautions may include warnings, risk education to the civilian population, marking, fencing and monitoring of territory affected by explosive remnants of war, as set out in Part 2 of the Technical Annex. 2004 227 27-09-2004 18-07-2005 2006 136 30-06-2006 12-11-2006

Article 6 Provisions for the protection of humanitarian missions and organisations from the effects of explosive remnants of war 1 Each High Contracting Party and party to an armed conflict shall: a) Protect, as far as feasible, from the effects of explosive remnants of war, humanitarian missions and organisations that are or will be operating in the area under the control of the High Contracting Party or party to an armed conflict and with that party's consent. b) Upon request by such a humanitarian mission or organisation, provide, as far as feasible, information on the location of all explosive remnants of war that it is aware of in territory where the requesting humanitarian mission or organisation will operate or is operating. 2 The provisions of this Article are without prejudice to existing International Humanitarian Law or other international instruments as applicable or decisions by the Security Council of the United Nations which provide for a higher level of protection. 2004 227 27-09-2004 18-07-2005 2006 136 30-06-2006 12-11-2006

Article 7 Assistance with respect to existing explosive remnants of war 1 Each High Contracting Party has the right to seek and receive assistance, where appropriate, from other High Contracting Parties, from states non-party and relevant international organisations and institutions in dealing with the problems posed by existing explosive remnants of war. 2 Each High Contracting Party in a position to do so shall provide assistance in dealing with the problems posed by existing explosive remnants of war, as necessary and feasible. In so doing, High Contracting Parties shall also take into account the humanitarian objectives of this Protocol, as well as international standards including the International Mine Action Standards. 2004 227 27-09-2004 18-07-2005 2006 136 30-06-2006 12-11-2006

Article 8 Co-operation and assistance 1 Each High Contracting Party in a position to do so shall provide assistance for the marking and clearance, removal or destruction of explosive remnants of war, and for risk education to civilian populations and related activities inter alia through the United Nations system, other relevant international, regional or national organisations or institutions, the International Committee of the Red Cross, national Red Cross and Red Crescent societies and their International Federation, non-governmental organisations, or on a bilateral basis. 2 Each High Contracting Party in a position to do so shall provide assistance for the care and rehabilitation and social and economic reintegration of victims of explosive remnants of war. Such assistance may be provided inter alia through the United Nations system, relevant international, regional or national organisations or institutions, the International Committee of the Red Cross, national Red Cross and Red Crescent societies and their International Federation, non-governmental organisations, or on a bilateral basis. 3 Each High Contracting Party in a position to do so shall contribute to trust funds within the United Nations system, as well as other relevant trust funds, to facilitate the provision of assistance under this Protocol. 4 Each High Contracting Party shall have the right to participate in the fullest possible exchange of equipment, material and scientific and technological information other than weapons related technology, necessary for the implementation of this Protocol. High Contracting Parties undertake to facilitate such exchanges in accordance with national legislation and shall not impose undue restrictions on the provision of clearance equipment and related technological information for humanitarian purposes. 5 Each High Contracting Party undertakes to provide information to the relevant databases on mine action established within the United Nations system, especially information concerning various means and technologies of clearance of explosive remnants of war, lists of experts, expert agencies or national points of contact on clearance of explosive remnants of war and, on a voluntary basis, technical information on relevant types of explosive ordnance. 6 High Contracting Parties may submit requests for assistance substantiated by relevant information to the United Nations, to other appropriate bodies or to other states. These requests may be submitted to the Secretary-General of the United Nations, who shall transmit them to all High Contracting Parties and to relevant international organisations and non-governmental organisations. 7 In the case of requests to the United Nations, the Secretary-General of the United Nations, within the resources available to the Secretary-General of the United Nations, may take appropriate steps to assess the situation and in co-operation with the requesting High Contracting Party and other High Contracting Parties with responsibility as set out in Article 3 above, recommend the appropriate provision of assistance. The Secretary-General may also report to High Contracting Parties on any such assessment as well as on the type and scope of assistance required, including possible contributions from the trust funds established within the United Nations system. 2004 227 27-09-2004 18-07-2005 2006 136 30-06-2006 12-11-2006

Article 9 Generic preventive measures 1 Bearing in mind the different situations and capacities, each High Contracting Party is encouraged to take generic preventive measures aimed at minimising the occurrence of explosive remnants of war, including, but not limited to, those referred to in part 3 of the Technical Annex. 2 Each High Contracting Party may, on a voluntary basis, exchange information related to efforts to promote and establish best practices in respect of paragraph 1 of this Article. 2004 227 27-09-2004 18-07-2005 2006 136 30-06-2006 12-11-2006

Article 10 Consultations of High Contracting Parties 1 The High Contracting Parties undertake to consult and co-operate with each other on all issues related to the operation of this Protocol. For this purpose, a Conference of High Contracting Parties shall be held as agreed to by a majority, but no less than eighteen High Contracting Parties. 2 The work of the conferences of High Contracting Parties shall include: a) review of the status and operation of this Protocol; b) consideration of matters pertaining to national implementation of this Protocol, including national reporting or updating on an annual basis. c) preparation for review conferences. 3 The costs of the Conference of High Contracting Parties shall be borne by the High Contracting Parties and States not parties participating in the Conference, in accordance with the United Nations scale of assessment adjusted appropriately. 2004 227 27-09-2004 18-07-2005 2006 136 30-06-2006 12-11-2006

Article 11 Compliance 1 Each High Contracting Party shall require that its armed forces and relevant agencies or departments issue appropriate instructions and operating procedures and that its personnel receive training consistent with the relevant provisions of this Protocol. 2 The High Contracting Parties undertake to consult each other and to co-operate with each other bilaterally, through the Secretary-General of the United Nations or through other appropriate international procedures, to resolve any problems that may arise with regard to the interpretation and application of the provisions of this Protocol. 2004 227 27-09-2004 18-07-2005 2006 136 30-06-2006 12-11-2006

1 RECORDING, STORAGE AND RELEASE OF INFORMATION FOR UNEXPLODED ORDNANCE (UXO) AND ABANDONED EXPLOSIVE ORDNANCE (AXO) a) Recording of information: Regarding explosive ordnance which may have become UXO a State should endeavour to record the following information as accurately as possible: Where a State has been obliged to abandon explosive ordnance in the course of operations, it should endeavour to leave AXO in a safe and secure manner and record information on this ordnance as follows: (i) the location of areas targeted using explosive ordnance; (ii) the approximate number of explosive ordnance used in the areas under (i); (iii) the type and nature of explosive ordnance used in areas under (i); (iv) the general location of known and probable UXO; (v) the location of AXO; (vi) the approximate amount of AXO at each specific site; (vii) the types of AXO at each specific site. b) Storage of information: Where a State has recorded information in accordance with paragraph (a), it should be stored in such a manner as to allow for its retrieval and subsequent release in accordance with paragraph (c). c) Release of information: Information recorded and stored by a State in accordance with paragraphs (a) and (b) should, taking into account the security interests and other obligations of the State providing the information, be released in accordance with the following provisions: (i) Content: On UXO the released information should contain details on: On AXO the released information should contain details on: (1) the general location of known and probable UXO; (2) the types and approximate number of explosive ordnance used in the targeted areas; (3) the method of identifying the explosive ordnance including colour, size and shape and other relevant markings; (4) the method for safe disposal of the explosive ordnance. (5) the location of the AXO; (6) the approximate number of AXO at each specific site; (7) the types of AXO at each specific site; (8) the method of identifying the AXO, including colour, size and shape; (9) information on type and methods of packing for AXO; (10) state of readiness; (11) the location and nature of any booby traps known to be present in the area of AXO. (ii) Recipient: The information should be released to the party or parties in control of the affected territory and to those persons or institutions that the releasing State is satisfied are, or will be, involved in UXO or AXO clearance in the affected area, in the education of the civilian population on the risks of UXO or AXO. (iii) Mechanism: A State should, where feasible, make use of those mechanisms established internationally or locally for the release of information, such as through UNMAS, IMSMA, and other expert agencies, as considered appropriate by the releasing State. (iv) Timing: The information should be released as soon as possible, taking into account such matters as any ongoing military and humanitarian operations in the affected areas, the availability and reliability of information and relevant security issues. 2004 227 27-09-2004 18-07-2005 2006 136 30-06-2006 12-11-2006

2 WARNINGS, RISK EDUCATION, MARKING, FENCING AND MONITORING Key terms Best practice elements of warnings and risk education Marking, fencing, and monitoring of an explosive remnants of war affected area a) Warnings are the punctual provision of cautionary information to the civilian population, intended to minimise risks caused by explosive remnants of war in affected territories. b) Risk education to the civilian population should consist of risk education programmes to facilitate information exchange between affected communities, government authorities and humanitarian organisations so that affected communities are informed about the threat from explosive remnants of war. Risk education programmes are usually a long term activity. c) All programmes of warnings and risk education should, where possible, take into account prevailing national and international standards, including the International Mine Action Standards. d) Warnings and risk education should be provided to the affected civilian population which comprises civilians living in or around areas containing explosive remnants of war and civilians who transit such areas. e) Warnings should be given, as soon as possible, depending on the context and the information available. A risk education programme should replace a warnings programme as soon as possible. Warnings and risk education always should be provided to the affected communities at the earliest possible time. f) Parties to a conflict should employ third parties such as international organisations and non-governmental organisations when they do not have the resources and skills to deliver efficient risk education. g) Parties to a conflict should, if possible, provide additional resources for warnings and risk education. Such items might include: provision of logistical support, production of risk education materials, financial support and general cartographic information. h) When possible, at any time during the course of a conflict and thereafter, where explosive remnants of war exist the parties to a conflict should, at the earliest possible time and to the maximum extent possible, ensure that areas containing explosive remnants of war are marked, fenced and monitored so as to ensure the effective exclusion of civilians, in accordance with the following provisions. i) Warning signs based on methods of marking recognised by the affected community should be utilised in the marking of suspected hazardous areas. Signs and other hazardous area boundary markers should as far as possible be visible, legible, durable and resistant to environmental effects and should clearly identify which side of the marked boundary is considered to be within the explosive remnants of war affected area and which side is considered to be safe. j) An appropriate structure should be put in place with responsibility for the monitoring and maintenance of permanent and temporary marking systems, integrated with national and local risk education programmes. 2004 227 27-09-2004 18-07-2005 2006 136 30-06-2006 12-11-2006

3 GENERIC PREVENTIVE MEASURES States producing or procuring explosive ordnance should to the extent possible and as appropriate endeavour to ensure that the following measures are implemented and respected during the life-cycle of explosive ordnance. a) (i) Production processes should be designed to achieve the greatest reliability of munitions. (ii) Production processes should be subject to certified quality control measures. (iii) During the production of explosive ordnance, certified quality assurance standards that are internationally recognised should be applied. (iv) Acceptance testing should be conducted through live-fire testing over a range of conditions or through other validated procedures. (v) High reliability standards should be required in the course of explosive ordnance transactions and transfers. b) Munitions management In order to ensure the best possible long-term reliability of explosive ordnance, States are encouraged to apply best practice norms and operating procedures with respect to its storage, transport, field storage, and handling in accordance with the following guidance. (i) Explosive ordnance, where necessary, should be stored in secure facilities or appropriate containers that protect the explosive ordnance and its components in a controlled atmosphere, if necessary. (ii) A State should transport explosive ordnance to and from production facilities, storage facilities and the field in a manner that minimises damage to the explosive ordnance. (iii) Appropriate containers and controlled environments, where necessary, should be used by a State when stockpiling and transporting explosive ordnance. (iv) The risk of explosions in stockpiles should be minimised by the use of appropriate stockpile arrangements. (v) States should apply appropriate explosive ordnance logging, tracking and testing procedures, which should include information on the date of manufacture of each number, lot or batch of explosive ordnance, and information on where the explosive ordnance has been, under what conditions it has been stored, and to what environmental factors it has been exposed. (vi) Periodically, stockpiled explosive ordnance should undergo, where appropriate, live-firing testing to ensure that munitions function as desired. (vii) Sub-assemblies of stockpiled explosive ordnance should, where appropriate, undergo laboratory testing to ensure that munitions function as desired. (viii) Where necessary, appropriate action, including adjustment to the expected shelf-life of ordnance, should be taken as a result of information acquired by logging, tracking and testing procedures, in order to maintain the reliability of stockpiled explosive ordnance. c) Training The proper training of all personnel involved in the handling, transporting and use of explosive ordnance is an important factor in seeking to ensure its reliable operation as intended. States should therefore adopt and maintain suitable training programmes to ensure that personnel are properly trained with regard to the munitions with which they will be required to deal. d) Transfer A State planning to transfer explosive ordnance to another State that did not previously possess that type of explosive ordnance should endeavour to ensure that the receiving State has the capability to store, maintain and use that explosive ordnance correctly. e) Future production A State should examine ways and means of improving the reliability of explosive ordnance that it intends to produce or procure, with a view to achieving the highest possible reliability. 2004 227 27-09-2004 18-07-2005 2006 136 30-06-2006 12-11-2006

Artikel 1 Algemene bepaling en toepassingsgebied 1 Handvest van de Verenigde Naties In overeenstemming met heten met de op hen van toepassing zijnde regels van het internationaal recht inzake gewapende conflicten, komen de Hoge Verdragsluitende Partijen overeen de in dit Protocol vervatte verplichtingen na te komen, zowel individueel als in samenwerking met andere Hoge Verdragsluitende Partijen, teneinde de risico's en gevolgen van ontplofbare oorlogsresten in post-conflictsituaties te minimaliseren. 2 Dit Protocol is van toepassing op ontplofbare oorlogsresten te land, met inbegrip van de binnenwateren van de Hoge Verdragsluitende Partijen. 3 Dit Protocol is van toepassing op situaties die voortvloeien uit conflicten als bedoeld in artikel 1, eerste tot en met zesde lid, van het Verdrag, zoals gewijzigd op 21 december 2001. 4 De artikelen 3, 4, 5 en 8 van dit Protocol zijn van toepassing op andere ontplofbare oorlogsresten dan bestaande ontplofbare oorlogsresten als gedefinieerd in artikel 2, vijfde lid, van dit Protocol. 2004 227 27-09-2004 18-07-2005 2006 136 30-06-2006 12-11-2006

Artikel 2 Begripsomschrijvingen Voor de toepassing van dit Protocol wordt verstaan onder: 1. Ontplofbare munitie , conventionele munitie die explosieve stoffen bevat, met uitzondering van mijnen, valstrikken en andere mechanismen als gedefinieerd in Protocol II van dit Verdrag zoals gewijzigd op 3 mei 1996. 2. Niet-gesprongen munitie , ontplofbare munitie die ontstekingsgereed is, van een ontsteking is voorzien, op scherp is gezet of anderszins voor gebruik is voorbereid, en is gebruikt in een gewapend conflict. De munitie kan zijn afgevuurd, afgeworpen, gelanceerd of afgeschoten en had tot ontploffing behoren te komen, maar weigerde zulks te doen. 3. Achtergelaten ontplofbare munitie , ontplofbare munitie die tijdens een gewapend conflict niet is gebruikt, die is achtergelaten of gedumpt door een partij bij een gewapend conflict, en die niet langer onder het gezag staat van de partij die deze heeft achtergelaten of gedumpt. Achtergelaten ontplofbare munitie kan al dan niet voor ontsteking zijn geprepareerd, van een ontsteking zijn voorzien, op scherp zijn gezet of anderszins voor gebruik zijn voorbereid. 4. Ontplofbare oorlogsresten , niet-gesprongen munitie en achtergelaten ontplofbare munitie. 5. Bestaande ontplofbare oorlogsresten , niet-gesprongen munitie en achtergelaten ontplofbare munitie die aanwezig was vóór de inwerkingtreding van dit Protocol ten aanzien van de Hoge Verdragsluitende Partij op wier grondgebied dit aanwezig is. 2004 227 27-09-2004 18-07-2005 2006 136 30-06-2006 12-11-2006

Artikel 3 Ruiming, verwijdering of vernietiging van ontplofbare oorlogsresten 1 Elke Hoge Verdragsluitende Partij en partij bij een gewapend conflict draagt de in dit artikel vervatte verantwoordelijkheden ten aanzien van alle ontplofbare oorlogsresten binnen het grondgebied dat onder haar gezag valt. In gevallen waarin een gebruiker van ontplofbare munitie die ontplofbare oorlogsresten is geworden, geen gezag uitoefent over het grondgebied, verstrekt waar haalbaar de gebruiker, na de beëindiging van de feitelijke vijandelijkheden onder andere technische, financiële, materiële of personele bijstand, bilateraal of via een onderling overeengekomen derde partij, onder andere via organen van de Verenigde Naties of andere relevante organisaties, ter vergemakkelijking van het markeren en ruimen, verwijderen of vernietigen van deze ontplofbare oorlogsresten. 2 Na de beëindiging van de feitelijke vijandelijkheden en zo snel als haalbaar, markeert en ruimt, verwijdert of vernietigt elke Hoge Verdragsluitende Partij en partij bij een gewapend conflict de ontplofbare oorlogsresten in de getroffen gebieden die onder haar gezag staan. Aan gebieden die getroffen zijn door ontplofbare oorlogsresten die op grond van het derde lid van dit artikel worden beoordeeld als een ernstig humanitair gevaar opleverend, wordt prioriteit verleend op het gebied van ruiming, verwijdering of vernietiging. 3 Na de beëindiging van de feitelijke vijandelijkheden en zo snel als haalbaar, neemt elke Hoge Verdragsluitende Partij en partij bij een gewapend conflict in de getroffen gebieden die onder haar gezag staan, de volgende maatregelen teneinde de door de ontplofbare oorlogsresten gevormde risico's te beperken: a het onderzoeken en beoordelen van het gevaar dat van de ontplofbare oorlogsresten uitgaat; b het beoordelen en een prioriteit toekennen aan de behoefte en uitvoerbaarheid wat betreft markering en ruiming, verwijdering of vernietiging; c het markeren en ruimen, verwijderen of vernietigen van ontplofbare oorlogsresten; d het nemen van maatregelen voor het verkrijgen van middelen om deze activiteiten uit te voeren. 4 Bij de uitvoering van bovengenoemde activiteiten houden de Hoge Verdragsluitende Partijen en partijen bij een gewapend conflict rekening met internationale normen, waaronder de International Mine Action Standards. 5 Waar dienstig werken de Hoge Verdragsluitende Partijen, zowel onderling als met andere staten, relevante regionale en internationale organisaties en niet-gouvernementele organisaties, samen bij het verlenen van bijstand in de vorm van, onder andere, technische, financiële, materiële en personele middelen, waaronder, in daarvoor in aanmerking komende omstandigheden, het ondernemen van gezamenlijke operaties ter nakoming van de bepalingen van dit artikel. 2004 227 27-09-2004 18-07-2005 2006 136 30-06-2006 12-11-2006

Artikel 4 Het registreren, bijhouden en overdragen van informatie 1 De Hoge Verdragsluitende Partijen en partijen bij een gewapend conflict zullen, in zo groot mogelijke mate en voor zover praktisch uitvoerbaar, informatie inzake het gebruik van ontplofbare munitie of het achterlaten van ontplofbare munitie registreren en behouden, ter vergemakkelijking van de snelle markering en ruiming, verwijdering of vernietiging van ontplofbare oorlogsresten, gevarenvoorlichting en de verstrekking van relevante informatie aan de partij die het gezag heeft over het grondgebied en aan de burgerbevolking in dat grondgebied. 2 De Hoge Verdragsluitende Partijen en partijen bij een gewapend conflict die ontplofbare munitie hebben gebruikt of achtergelaten, die ontplofbare oorlogsresten kunnen zijn geworden, stellen informatie hieromtrent na de beëindiging van de feitelijke vijandelijkheden en voor zover praktisch uitvoerbaar, met inachtneming van de legitieme veiligheidsbelangen van deze partijen, onverwijld beschikbaar aan de partij of partijen die het gezag hebben over het getroffen gebied, op bilaterale basis of via een onderling overeengekomen derde partij, met inbegrip van, onder andere de Verenigde Naties of, op verzoek, aan andere relevante organisaties die naar de overtuiging van de partij die de informatie verstrekt gevarenvoorlichting geven of zullen geven en de markering en de ruiming, verwijdering of vernietiging van ontplofbare oorlogsresten in het getroffen gebied uitvoeren of zullen uitvoeren. 3 Bij het registreren, behouden en verzenden van deze informatie moeten de Hoge Verdragsluitende Partijen Deel 1 van de Technische Bijlage in acht nemen. 2004 227 27-09-2004 18-07-2005 2006 136 30-06-2006 12-11-2006

Artikel 5 Andere voorzorgsmaatregelen voor de bescherming van de burgerbevolking, individuele burgers en burgerobjecten tegen de risico's en gevolgen van ontplofbare oorlogsresten 1 De Hoge Verdragsluitende Partijen en partijen bij een gewapend conflict treffen in het door ontplofbare oorlogsresten getroffen grondgebied dat onder hun gezag valt alle haalbare voorzorgsmaatregelen om de burgerbevolking, individuele burgers en burgerobjecten tegen de risico's en gevolgen van ontplofbare oorlogsresten te beschermen. Haalbare voorzorgsmaatregelen zijn die voorzorgsmaatregelen welke uitvoerbaar of praktisch mogelijk zijn, met inachtneming van alle omstandigheden die op dat tijdstip gelden, met inbegrip van humanitaire en militaire overwegingen. Deze voorzorgsmaatregelen kunnen bestaan uit waarschuwingen, gevarenvoorlichting aan de burgerbevolking en het markeren, met hekken afzetten en bewaken van het door ontplofbare oorlogsresten getroffen gebied, zoals vermeld in Deel 2 van de Technische Bijlage. 2004 227 27-09-2004 18-07-2005 2006 136 30-06-2006 12-11-2006

Artikel 6 Bepalingen voor de bescherming van humanitaire missies en organisaties tegen de gevolgen van ontplofbare oorlogsresten 1 Elke Hoge Verdragsluitende Partij en partij bij een gewapend conflict zijn gehouden: a Humanitaire missies en organisaties die in het gebied dat onder het gezag staat van de Hoge Verdragsluitende Partij of van de partij bij een gewapend conflict, met de instemming van die partij werkzaam zijn of zullen zijn, voor zover haalbaar, te beschermen tegen de gevolgen van ontplofbare oorlogsresten. b Op verzoek van een dergelijke humanitaire missie of organisatie, voor zover haalbaar, informatie te verstrekken met betrekking tot de locatie van alle bij haar bekende ontplofbare oorlogsresten in het grondgebied waar de verzoekende humanitaire missie of organisatie werkzaam is of zal zijn. 2 De bepalingen van dit artikel doen geen afbreuk aan het geldende Internationaal Humanitair Recht of andere toepasselijke internationale instrumenten of aan besluiten van de Veiligheidsraad van de Verenigde Naties die voorzien in een hoger niveau van bescherming. 2004 227 27-09-2004 18-07-2005 2006 136 30-06-2006 12-11-2006

Artikel 7 Bijstand ten aanzien van bestaande ontplofbare oorlogsresten 1 Elke Hoge Verdragsluitende Partij heeft het recht, desgewenst, te trachten bijstand te verkrijgen van andere Hoge Verdragsluitende Partijen, van staten die geen partij zijn en van relevante internationale organisaties en instellingen, en deze te ontvangen bij het aanpakken van de problemen die worden gevormd door bestaande ontplofbare oorlogsresten. 2 Elke Hoge Verdragsluitende Partij die daartoe in staat is, verleent, waar nodig en haalbaar, bijstand bij het aanpakken van de problemen die worden gevormd door bestaande ontplofbare oorlogsresten. Hierbij houden de Hoge Verdragsluitende Partijen ook rekening met de humanitaire doeleinden van dit Protocol, alsmede met internationale normen, waaronder de International Mine Action Standards. 2004 227 27-09-2004 18-07-2005 2006 136 30-06-2006 12-11-2006

Artikel 8 Samenwerking en bijstand 1 Elke Hoge Verdragsluitende Partij die daartoe in staat is, verleent bijstand ten behoeve van de markering en ruiming, verwijdering of vernietiging van ontplofbare oorlogsresten, en ten behoeve van gevarenvoorlichting aan de burgerbevolking en daaraan gerelateerde activiteiten, onder meer via organen van de Verenigde Naties, of andere relevante internationale, regionale of nationale organisaties of instellingen, het Internationaal Comité van het Rode Kruis, nationale afdelingen van het Rode Kruis en de Rode Halve Maan of de internationale federatie hiervan, niet-gouvernementele organisaties, of op bilaterale basis. 2 Elke Hoge Verdragsluitende Partij die daartoe in staat is, verleent bijstand voor de zorg en rehabilitatie en de sociale en economische reïntegratie van slachtoffers van ontplofbare oorlogsresten. Deze bijstand kan onder meer worden verleend via organen van de Verenigde Naties, of andere relevante internationale, regionale of nationale organisaties of instellingen, het Internationaal Comité van het Rode Kruis, nationale afdelingen van het Rode Kruis en de Rode Halve Maan of de internationale federatie hiervan, niet-gouvernementele organisaties, of op bilaterale basis. 3 Elke Hoge Verdragsluitende Partij die daartoe in staat is, levert, ter vergemakkelijking van het verstrekken van bijstand ingevolge dit Protocol, een financiële bijdrage aan fondsen van de Verenigde Naties alsmede andere relevante fondsen. 4 Elke Hoge Verdragsluitende Partij heeft het recht deel te nemen aan een zo volledig mogelijke uitwisseling van apparatuur, materieel en wetenschappelijke en technologische informatie, anders dan wapengerelateerde technologie, benodigd voor de uitvoering van dit Protocol. De Hoge Verdragsluitende Partijen verplichten zich ertoe deze uitwisselingen in overeenstemming met de nationale wetgeving te vergemakkelijken en leggen geen onnodige beperkingen op ten aanzien van de verstrekking van ruimingsapparatuur en daaraan gerelateerde technologische informatie voor humanitaire doeleinden. 5 Elke Hoge Verdragsluitende Partij verbindt zich ertoe informatie te verstrekken ten behoeve van de relevante databanken inzake mijnactie die in het kader van de Verenigde Naties zijn ingesteld, in het bijzonder informatie betreffende diverse middelen en technieken voor het ruimen van ontplofbare oorlogsresten, lijsten van deskundigen, gespecialiseerde instanties of nationale contactpunten inzake het ruimen van ontplofbare oorlogsresten en, op vrijwillige basis, technische informatie betreffende de relevante soorten ontplofbare munitie. 6 De Hoge Verdragsluitende Partijen kunnen verzoeken om bijstand, onderbouwd met relevante informatie, richten tot de Verenigde Naties, tot andere daarvoor in aanmerking komende instellingen of tot andere staten. Deze verzoeken kunnen worden ingediend bij de Secretaris-Generaal van de Verenigde Naties, die deze doorzendt naar alle Hoge Verdragsluitende Partijen en naar de bevoegde internationale organisaties en niet-gouvernementele organisaties. 7 Wanneer verzoeken tot de Verenigde Naties worden gericht, kan de Secretaris-Generaal van de Verenigde Naties, binnen de hem ter beschikking staande mogelijkheden, de passende maatregelen nemen om de situatie te beoordelen en, in samenwerking met de verzoekende Hoge Verdragsluitende Partij en met andere Hoge Verdragsluitende Partijen met verantwoordelijkheid als vervat in artikel 3, de passende verlening van bijstand aanbevelen. De Secretaris-Generaal kan tevens verslag uitbrengen aan de Hoge Verdragsluitende Partijen over elk van deze beoordelingen en over de aard en de omvang van de verzochte bijstand, met inbegrip van eventuele bijdragen uit de fondsen die in het kader van de Verenigde Naties zijn ingesteld. 2004 227 27-09-2004 18-07-2005 2006 136 30-06-2006 12-11-2006

Artikel 9 Algemene preventieve maatregelen 1 Indachtig de verschillende situaties en capaciteiten wordt elke Hoge Verdragsluitende Partij aangemoedigd algemene preventieve maatregelen te nemen gericht op het beperken van het vóórkomen van ontplofbare oorlogsresten, waaronder, doch niet beperkt tot, die welke worden genoemd in deel 3 van de Technische Bijlage. 2 best practices Elke Hoge Verdragsluitende Partij kan, op vrijwillige basis, informatie uitwisselen betreffende inspanningen ter bevordering en instelling van deten aanzien van het eerste lid van dit artikel. 2004 227 27-09-2004 18-07-2005 2006 136 30-06-2006 12-11-2006

Artikel 10 Overleg van de Hoge Verdragsluitende Partijen 1 De Hoge Verdragsluitende Partijen verplichten zich ertoe onderling overleg te plegen en samen te werken inzake alle kwesties betreffende de werking van dit Protocol. Hiertoe wordt een conferentie van de Hoge Verdragsluitende Partijen gehouden, als een meerderheid, doch ten minste achttien Hoge Verdragsluitende Partijen, daartoe besluit. 2 De werkzaamheden van de conferenties van de Hoge Verdragsluitende Partijen houden onder andere in: a toetsing van de status en werking van dit Protocol; b bestudering van aangelegenheden betreffende de nationale implementatie van dit Protocol, met inbegrip van nationale verslaglegging of actualisering op jaarlijkse basis; c voorbereiding van toetsingsconferenties. 3 De kosten van de conferentie van de Hoge Verdragsluitende Partijen worden gedragen door de Hoge Verdragsluitende Partijen en door de staten die geen partij zijn en die deelnemen aan de conferentie, volgens de aan de op passende wijze aangepaste verdeelsleutel van de Verenigde Naties. 2004 227 27-09-2004 18-07-2005 2006 136 30-06-2006 12-11-2006

Artikel 11 Naleving 1 Elke Hoge Verdragsluitende Partij vereist dat haar strijdkrachten en daarvoor in aanmerking komende instanties of departementen instructies en handelingsvoorschriften opstellen en bekendmaken en dat de personeelsleden van de strijdkrachten een opleiding krijgen die verenigbaar is met de desbetreffende bepalingen van dit Protocol. 2 De Hoge Verdragsluitende Partijen verplichten zich ertoe met elkaar overleg te plegen en bilateraal met elkaar samen te werken, door tussenkomst van de Secretaris-Generaal van de Verenigde Naties of volgens andere geschikte internationale procedures, om problemen op te lossen die zich kunnen voordoen met betrekking tot de interpretatie en toepassing van de bepalingen van dit Protocol. 2004 227 27-09-2004 18-07-2005 2006 136 30-06-2006 12-11-2006

1 REGISTRATIE, OPSLAG EN VRIJGAVE VAN INFORMATIE BETREFFENDE NIET-GESPRONGEN MUNITIE (UXO) EN ACHTERGELATEN ONTPLOFBARE MUNITIE (AXO) a Registratie van informatie: Met betrekking tot ontplofbare munitie die UXO kan zijn geworden, dient een staat ernaar te streven de volgende informatie zo nauwkeurig mogelijk te registreren: Wanneer een staat er gedurende operaties toe gedwongen is ontplofbare munitie achter te laten, dient hij ernaar te streven de AXO op een veilige en zekere wijze achter te laten en informatie betreffende deze munitie als volgt te registreren: i de ligging van gebieden die getroffen zijn door het gebruik van ontplofbare munitie; ii de geraamde hoeveelheid ontplofbare munitie die in de onder i. bedoelde gebieden is gebruikt; iii de soort en aard van de ontplofbare munitie die in de onder i. bedoelde gebieden is gebruikt; iv de globale locatie van bekende en vermoedelijke UXO; v de locatie van de AXO; vi de geraamde hoeveelheid AXO op elke specifieke locatie; vii de soorten AXO op elke specifieke locatie. b Opslag van informatie: Wanneer een staat informatie in overeenstemming met onderdeel a heeft geregistreerd, moet deze op zodanige wijze worden opgeslagen dat deze kan worden teruggevonden en vervolgens in overeenstemming met onderdeel c kan worden vrijgegeven. c Vrijgave van informatie: Informatie die in overeenstemming met de onderdelen a en b door een staat is geregistreerd en opgeslagen moet, met inachtneming van de veiligheidsbelangen en andere verplichtingen van de staat die de informatie verstrekt, worden vrijgegeven in overeenstemming met de volgende bepalingen: i Inhoud: Wanneer de vrijgegeven informatie UXO betreft, moeten de volgende gegevens worden verstrekt: Wanneer de vrijgegeven informatie AXO betreft, moeten de volgende gegevens worden verstrekt: 1. de globale locatie van bekende en waarschijnlijke UXO; 2. de soorten en de geraamde hoeveelheid ontplofbare munitie die in de getroffen gebieden is gebruikt; 3. de wijze van herkenning van de ontplofbare munitie, met inbegrip van kleur, omvang en vorm en andere relevante markeringen; 4. de wijze waarop de ontplofbare munitie veilig kan worden opgeruimd. 5. de locatie van de AXO; 6. de geraamde hoeveelheid AXO op elke specifieke locatie; 7. de soorten AXO op elke specifieke locatie; 8. de wijze van herkenning van de AXO, met inbegrip van kleur, omvang en vorm; 9. informatie met betrekking tot de soorten en wijzen van verpakking van AXO; 10. de staat van gereedheid; 11. de locatie en aard van eventuele valstrikken waarvan de aanwezigheid in het gebied waarin zich AXO bevindt, bekend is. ii Ontvanger: De informatie dient te worden vrijgegeven aan de partij of partijen die gezag hebben over het getroffen gebied en aan die personen of instellingen ten aanzien waarvan de vrijgevende staat ervan overtuigd is dat deze betrokken zijn, of zullen zijn, bij het ruimen van UXO of AXO in het getroffen gebied, of bij de voorlichting van de burgerbevolking met betrekking tot de risico's van UXO of AXO. iii Mechanisme: Een staat dient, wanneer haalbaar, voor de vrijgave van informatie gebruik te maken van daartoe internationaal of lokaal ingestelde mechanismen, bijvoorbeeld UNMAS, IMSMA of andere, door de vrijgevende staat geschikt geachte, gespecialiseerde instellingen. iv Timing: De informatie moet zo snel mogelijk worden vrijgegeven, met inachtneming van zaken als eventuele lopende militaire en humanitaire operaties in de getroffen gebieden, de beschikbaarheid en betrouwbaarheid van informatie en ter zake doende veiligheidskwesties. 2004 227 27-09-2004 18-07-2005 2006 136 30-06-2006 12-11-2006

2 WAARSCHUWINGEN, GEVARENVOORLICHTING, MARKERING, AFZETTING MET HEKKEN EN BEWAKING Kernbegrippen Best practice-onderdelen bij waarschuwing en gevarenvoorlichting Het markeren, met hekken afzetten en bewaken van een gebied waarin zich ontplofbare oorlogsresten bevinden a Waarschuwingen zijn de nauwgezette verstrekking van waarschuwingsinformatie aan de burgerbevolking, met het oogmerk de risico's die worden veroorzaakt door ontplofbare oorlogsresten in getroffen gebieden, tot een minimum te beperken. b Gevarenvoorlichting aan de burgerbevolking dient te bestaan uit gevarenvoorlichtingsprogramma's ter vergemakkelijking van de informatieuitwisseling tussen getroffen gemeenschappen, de overheid en humanitaire organisaties, zodat de getroffen gemeenschappen op de hoogte worden gebracht van het gevaar dat van de ontplofbare oorlogsresten uitgaat. Gevarenvoorlichtingsprogramma's zijn doorgaans lange-termijnactiviteiten. c Bij alle waarschuwings- en gevarenvoorlichtingsprogramma's dient, waar mogelijk, rekening te worden gehouden met de geldende nationale en internationale normen, met inbegrip van de International Mine Action Standards. d Waarschuwingen en gevarenvoorlichting moeten worden verschaft aan de getroffen burgerbevolking, waaronder burgers die in of aan de rand van gebieden wonen die ontplofbare oorlogsresten bevatten en aan burgers die zich door deze gebieden verplaatsen. e Waarschuwingen moeten zo snel mogelijk, afhankelijk van de omstandigheden en de beschikbare informatie, worden gegeven. Een waarschuwingsprogramma moet zo snel mogelijk worden vervangen door een gevarenvoorlichtingsprogramma. Waarschuwingen en gevarenvoorlichting moeten altijd in een zo vroeg mogelijk stadium aan de getroffen gemeenschappen worden gegeven. f Wanneer de partijen bij een conflict niet beschikken over de middelen en vaardigheden om doeltreffende gevarenvoorlichting te geven, moeten zij een beroep doen op derden, zoals internationale organisaties en niet-gouvernementele organisaties. g Partijen bij een conflict moeten, indien mogelijk, voorzien in aanvullende middelen voor waarschuwingen en gevarenvoorlichting. Dit kan onder andere bestaan uit de levering van logistieke ondersteuning, de vervaardiging van gevarenvoorlichtingsmaterialen, financiële ondersteuning en algemene cartografische informatie. h Wanneer mogelijk moeten de partijen bij een conflict er gedurende enig tijdstip gedurende het verloop van een conflict en daarna, wanneer sprake is van ontplofbare oorlogsresten, in een zo vroeg mogelijk stadium en in de grootst mogelijke mate ervoor zorgen dat gebieden met ontplofbare oorlogsresten, in overeenstemming met de volgende bepalingen worden gemarkeerd, met hekken worden afgezet en worden bewaakt om ervoor te zorgen dat burgers deze gebieden daadwerkelijk onmogelijk kunnen betreden. i Bij de markering van gebieden ten aanzien waarvan het vermoeden bestaat dat zij gevaarlijk zijn moeten waarschuwingstekens worden gebruikt op basis van markeringsmethoden die voor de getroffen gemeenschap herkenbaar zijn. Tekens en andere markeringen van de begrenzing van gevaarlijke gebieden moeten voor zover mogelijk zichtbaar, leesbaar, duurzaam en tegen omgevingsinvloeden bestand zijn en moeten duidelijk vermelden aan welke zijde van de gemarkeerde grens het door ontplofbare oorlogsresten getroffen gebied ligt en welke zijde als veilig wordt beschouwd. j Er moet een passende structuur in het leven worden geroepen die verantwoordelijk is voor de bewaking en het onderhoud van permanente en tijdelijke markeringssystemen, die deel moet gaan uitmaken van de nationale en lokale gevarenvoorlichtingsprogramma's. 2004 227 27-09-2004 18-07-2005 2006 136 30-06-2006 12-11-2006

3 ALGEMENE PREVENTIEVE MAATREGELEN Staten die ontplofbare munitie vervaardigen of aanschaffen moeten er voor zover mogelijk en op passende wijze naar streven te waarborgen dat de volgende maatregelen gedurende de levensduur van ontplofbare munitie worden geïmplementeerd en nageleefd. a Beheer van de vervaardiging van munitie i Productieprocessen moeten zodanig worden ontworpen dat een zo groot mogelijke betrouwbaarheid van de munitie wordt verkregen. ii Productieprocessen moeten worden onderworpen aan officiële maatregelen op het gebied van kwaliteitsbeheersing. iii Tijdens de productie van ontplofbare munitie moeten internationaal erkende officiële normen voor kwaliteitscontrole worden toegepast. iv Afnametesten moeten worden uitgevoerd door middel van afvuurbeproevingen met scherpe munitie onder een reeks van omstandigheden of door middel van andere goedgekeurde procedures. v Bij transacties en overdrachten van ontplofbare munitie moeten strenge betrouwbaarheidsnormen worden verlangd. b Beheer van munitie best practices Teneinde een zo goed mogelijke betrouwbaarheid van ontplofbare munitie op de lange termijn te waarborgen, worden de staten aangemoedigd normen vooren operationele procedures toe te passen met betrekking tot de opslag, het vervoer, de opslag te velde en het hanteren ervan, in overeenstemming met de volgende richtlijnen. i Ontplofbare munitie moet, waar nodig, in veilige voorzieningen of geschikte containers worden opgeslagen die de ontplofbare munitie en de onderdelen ervan, indien nodig, in een beheerste atmosfeer beschermen. ii Een staat moet ontplofbare munitie op zodanige wijze van en naar vervaardigings- of opslaglocaties en van en naar het inzetgebied vervoeren dat de ontplofbare munitie zo min mogelijk wordt beschadigd. iii Bij de aanleg van voorraden en het vervoer van ontplofbare munitie moeten, waar nodig, geschikte containers en geconditioneerde omgevingen worden gebruikt. iv De kans op explosies in opslagplaatsen moet tot een minimum worden beperkt door gebruikmaking van geschikte opslagvoorzieningen. v De staten moeten geschikte procedures toepassen voor het registreren, traceren en beproeven van ontplofbare munitie, waaronder informatie met betrekking tot de vervaardigingsdatum van elk afzonderlijk genummerd ontplofbaar munitiestuk of elke reeks of partij, en informatie met betrekking tot de locaties waar de ontplofbare munitie zich heeft bevonden, onder welke omstandigheden deze opgeslagen is geweest, en aan welke omgevingsinvloeden deze is blootgesteld. vi Opgeslagen ontplofbare munitie moet, waar dienstig, periodiek worden beproefd door middel van afvuren om te waarborgen dat de munitie naar wens functioneert. vii Submunitie van opgeslagen ontplofbare munitie moet, waar dienstig, in een laboratorium worden beproefd om te waarborgen dat de munitie naar wens functioneert. viii Teneinde de betrouwbaarheid van opgeslagen ontplofbare munitie te handhaven, moeten, waar nodig, naar aanleiding van informatie die is verkregen uit de registratie-, tracerings- en beproevingsprocedures, passende maatregelen worden genomen, waaronder aanpassing van de verwachte levensduur van de munitie. c Opleiding De juiste opleiding van al het personeel dat betrokken is bij het hanteren, vervoeren en gebruiken van ontplofbare munitie is een belangrijke factor bij het streven naar zekerheid omtrent de betrouwbaarheid van de beoogde werking ervan. Daarom moeten de staten geschikte opleidingsprogramma's invoeren en in stand houden, om ervoor te zorgen dat het personeel naar behoren is opgeleid op het gebied van de munitie waarmee zij moeten omgaan. d Overdracht Een staat die van plan is ontplofbare munitie naar een andere staat over te dragen die voordien die soort ontplofbare munitie niet bezat, moet ernaar streven te waarborgen dat de ontvangende staat de benodigde capaciteit heeft om die ontplofbare munitie op de juiste wijze op te slaan, in stand te houden en te gebruiken. e Toekomstige vervaardiging Met het oog op het bereiken van een zo groot mogelijke betrouwbaarheid moet een staat manieren en middelen onderzoeken ter verbetering van de betrouwbaarheid van ontplofbare munitie die hij voornemens is te vervaardigen of aan te schaffen. 2004 227 27-09-2004 18-07-2005 123 19-06-2014 2006 136 30-06-2006 12-11-2006
