Article 5 Signature, ratification, acceptance, approval and accession 1 Protocol of 1978 relating to the International Convention for the Prevention of Pollution from Ships, 1973 The present Protocol shall be open for signature at the Headquarters of the International Maritime Organization (hereinafter referred to as the “Organization”) from 1 January 1998 until 31 December 1998 and shall thereafter remain open for accession. Only Contracting States to the(hereinafter referred to as the “1978 Protocol”) may become Parties to the present Protocol by: a) signature without reservation as to ratification, acceptance or approval; or b) signature, subject to ratification, acceptance or approval, followed by ratification, acceptance or approval; or c) accession. 2 Ratification, acceptance, approval or accession shall be effected by the deposit of an instrument to that effect with the Secretary-General of the Organization (hereinafter referred to as the “Secretary-General”). 1999 169 13-09-1999 2007 29 19-02-2007 02-01-2007

Article 6 Entry into force 1 The present Protocol shall enter into force twelve months after the date on which not less than fifteen States, the combined merchant fleets of which constitute not less than 50 per cent of the gross tonnage of the world's merchant shipping, have become Parties to it in accordance with article 5 of the present Protocol. 2 Any instrument of ratification, acceptance, approval or accession deposited after the date on which the present Protocol enters into force shall take effect three months after the date of deposit. 3 article 16 of the Convention After the date on which an amendment to the present Protocol is deemed to have been accepted in accordance with, any instrument of ratification, acceptance, approval or accession deposited shall apply to the present Protocol as amended. 1999 169 13-09-1999 2007 29 19-02-2007 02-01-2007

Article 7 Denunciation 1 The present Protocol may be denounced by any Party to the present Protocol at any time after the expiry of five years from the date on which the Protocol enters into force for that Party. 2 Denunciation shall be effected by the deposit of an instrument of denunciation with the Secretary-General. 3 A denunciation shall take effect twelve months after receipt of the notification by the Secretary-General or after the expiry of any other longer period which may be indicated in the notification. 4 1978 Protocol article VII thereof A denunciation of thein accordance withshall be deemed to include a denunciation of the present Protocol in accordance with this article. Such denunciation shall take effect on the date on which denunciation of the 1978 Protocol takes effect in accordance with article VII of that Protocol. 1999 169 13-09-1999 2007 29 19-02-2007 02-01-2007

Article 8 Depositary 1 The present Protocol shall be deposited with the Secretary-General (hereinafter referred to as the “Depositary”). 2 The Depositary shall: a) inform all States which have signed the present Protocol or acceded thereto of: (i) each new signature or deposit of an instrument of ratification, acceptance, approval or accession, together with the date thereof; (ii) the date of entry into force of the present Protocol; and (iii) the deposit of any instrument of denunciation of the present Protocol, together with the date on which it was received and the date on which the denunciation takes effect; and b) transmit certified true copies of the present Protocol to all States which have signed the present Protocol or acceded thereto. 3 Article 102 of the Charter of the United Nations As soon as the present Protocol enters into force, a certified true copy thereof shall be transmitted by the Depositary to the Secretariat of the United Nations for registration and publication in accordance with. 1999 169 13-09-1999 2007 29 19-02-2007 02-01-2007

Artikel 3 Algemene verplichtingen 1 Verdrag Heten dit Protocol dienen, tussen de Partijen bij dit Protocol, tezamen te worden gelezen en geïnterpreteerd als een enkel verdrag. 2 Elke verwijzing naar dit Protocol houdt tegelijkertijd een verwijzing in naar de Bijlage hierbij. 2002 192 25-10-2002 2007 29 19-02-2007 02-01-2007

Artikel 4 Wijzigingsprocedure artikel 16 van het Verdrag Verdrag Bij toepassing vanop een wijziging van Bijlage VI en de aanhangsels daarbij, wordt de verwijzing „een Partij bij het” geacht een verwijzing te zijn naar een Partij gebonden door die Bijlage. 2002 192 25-10-2002 2007 29 19-02-2007 02-01-2007

Artikel 5 Ondertekening, bekrachtiging, aanvaarding, goedkeuring en toetreding 1 Protocol van 1978 bij het Internationaal Verdrag ter voorkoming van verontreiniging door schepen, 1973 Dit Protocol staat open voor ondertekening op de Hoofzetel van de Internationale Maritieme Organisatie (hierna te noemen de „Organisatie”) vanaf 1 januari 1998 tot en met 31 december 1998 en blijft daarna open voor toetreding. Alleen Verdragsluitende Staten die Partij zijn bij het, (hierna te noemen het Protocol van 1978) kunnen Partij worden bij dit Protocol door: a. ondertekening zonder voorbehoud van bekrachtiging, aanvaarding of goedkeuring; of b. ondertekening onder voorbehoud van bekrachtiging, aanvaarding of goedkeuring, gevolgd door bekrachtiging, aanvaarding of goedkeuring; of c. toetreding. 2 Bekrachtiging, aanvaarding, goedkeuring of toetreding geschiedt door nederlegging van een daartoe strekkende akte bij de Secretaris-Generaal van de Organisatie (hierna te noemen de „Secretaris-Generaal”). 2002 192 25-10-2002 2007 29 19-02-2007 02-01-2007

Artikel 6 Inwerkingtreding 1 Dit Protocol treedt in werking twaalf maanden na de datum waarop ten minste vijftien Staten waarvan de koopvaardijvloten tezamen ten minste vijftig procent vormen van de brutotonnage van de wereldkoopvaardijvloot Partij daarbij zijn geworden in overeenstemming met artikel 5 van dit Protocol. 2 Elke akte van bekrachtiging, aanvaarding, goedkeuring of toetreding nedergelegd na de datum waarop dit Protocol in werking treedt, wordt van kracht drie maanden na de datum van nederlegging. 3 artikel 16 van het Verdrag Na de datum waarop een wijziging van dit Protocol wordt geacht te zijn aanvaard in overeenstemming met, is iedere akte van bekrachtiging, aanvaarding, goedkeuring of toetreding van toepassing op dit Protocol zoals gewijzigd. 2002 192 25-10-2002 51 26-03-2019 2007 29 19-02-2007 02-01-2007

Artikel 7 Opzegging 1 Dit Protocol kan door elke Partij bij dit Protocol te allen tijde worden opgezegd na afloop van vijf jaar te rekenen vanaf de datum waarop het Protocol voor die Partij in werking trad. 2 Opzegging geschiedt door nederlegging van een akte van opzegging bij de Secretaris-Generaal. 3 Een opzegging wordt van kracht twaalf maanden na ontvangst van de kennisgeving door de Secretaris-Generaal dan wel na het verstrijken van een langer tijdvak indien dit in de kennisgeving wordt aangegeven. 4 Protocol van 1978 artikel VII daarvan Opzegging van hetin overeenstemming metwordt geacht opzegging te omvatten van dit Protocol in overeenstemming met dit artikel. Een dergelijke opzegging wordt van kracht op de datum waarop de opzegging van het Protocol van 1978 van kracht wordt in overeenstemming met artikel VII van dat Protocol. 2002 192 25-10-2002 2007 29 19-02-2007 02-01-2007

Artikel 8 Depositaris 1 Dit Protocol wordt nedergelegd bij de Secretaris-Generaal (hierna te noemen de „Depositaris”). 2 De Depositaris a. stelt alle Staten die dit Protocol hebben ondertekend of daartoe zijn toegetreden in kennis van: i. iedere nieuwe ondertekening of nederlegging van een akte van bekrachtiging, aanvaarding, goedkeuring of toetreding, alsmede de datum ervan; ii. de datum waarop dit Protocol in werking treedt; en iii. de nederlegging van elke akte van opzegging van dit Protocol, alsmede de datum van ontvangst ervan en de datum waarop de opzegging van kracht wordt. b. zendt voor eensluidend gewaarmerkte afschriften van dit Protocol toe aan alle Staten die dit Protocol hebben ondertekend of daartoe zijn toegetreden. 3 artikel 102 van het Handvest der Verenigde Naties Zodra dit Protocol in werking treedt, wordt een voor eensluidend gewaarmerkt afschrift ervan door de Depositaris gezonden aan het Secretariaat van de Verenigde Naties voor registratie en publicatie in overeenstemming met. 2002 192 25-10-2002 2007 29 19-02-2007 02-01-2007
