Verdrag inzake de toepassing van artikel 65 van het Verdrag inzake de verlening van Europese octrooien

Article 1 Dispensation with translation requirements 1 Article 65, paragraph 1 of the European Patent Convention Any State party to this Agreement having an official language in common with one of the official languages of the European Patent Office shall dispense with the translation requirements provided for in. 2 Article 65, paragraph 1 of the European Patent Convention Any State party to this Agreement having no official language in common with one of the official languages of the European Patent Office shall dispense with the translation requirements provided for in, if the European patent has been granted in the official language of the European Patent Office prescribed by that State, or translated into that language and supplied under the conditions provided for in Article 65, paragraph 1 of the European Patent Convention. 3 Article 65, paragraph 1 of the European Patent Convention The States referred to in paragraph 2 shall continue to have the right to require that a translation of the claims into one of their official languages be supplied under the conditions provided for in. 4 Nothing in this Agreement shall be construed as restricting the right of the States parties to this Agreement to dispense with any translation requirement or to apply more liberal translation requirements than those referred to in paragraphs 2 and 3. 2001 21 06-02-2001 2008 62 14-04-2008 01-05-2008

Article 2 Translations in case of dispute Nothing in this Agreement shall be construed as restricting the right of the States parties to this Agreement to prescribe that, in the case of a dispute relating to a European patent, the patent proprietor, at his own expense, a) shall supply, at the request of an alleged infringer, a full translation into an official language of the State in which the alleged infringement took place, b) shall supply, at the request of the competent court or quasi judicial authority in the course of legal proceedings, a full translation into an official language of the State concerned. 2001 21 06-02-2001 2008 62 14-04-2008 01-05-2008

Article 3 Signature – Ratification 1 European Patent Convention This Agreement shall be open for signature by any Contracting State to theuntil 30 June 2001. 2 This Agreement shall be subject to ratification. Article 4 Accession Article 3, paragraph 1 European Patent Convention This Agreement shall, on expiry of the term for signature mentioned in, be open to accession by any Contracting State to theand any State which is entitled to accede to that Convention. Article 6 Entry into force 1 European Patent Convention This Agreement shall enter into force on the first day of the fourth month after the deposit of the last instrument of ratification or accession by eight Contracting States to the, including the three States in which the most European patents took effect in 1999. 2 Any ratification or accession after the entry into force of this Agreement shall take effect on the first day of the fourth month after the deposit of the instrument of ratification or accession. 2001 21 06-02-2001 2008 62 14-04-2008 01-05-2008

Article 7 Duration of the Agreement This Agreement shall be concluded for an unlimited duration. 2001 21 06-02-2001 2008 62 14-04-2008 01-05-2008

Article 8 Denunciation Any State party to this Agreement may denounce it at any time, once it has been in force for three years. Notification of denunciation shall be given to the Government of the Federal Republic of Germany. The denunciation shall take effect one year after the date of receipt of such notification. No rights acquired pursuant to this Agreement before the denunciation took effect shall thereby be impaired. 2001 21 06-02-2001 2008 62 14-04-2008 01-05-2008

Article 9 Scope This Agreement shall apply to European patents in respect of which the mention of grant was published in the European Patent Bulletin after the Agreement entered into force for the State concerned. 2001 21 06-02-2001 2008 62 14-04-2008 01-05-2008

Article 10 Languages of the Agreement This Agreement, drawn up in a single original in the English, French and German languages shall be deposited with the Government of the Federal Republic of Germany, the three texts being equally authentic. 2001 21 06-02-2001 2008 62 14-04-2008 01-05-2008

Article 11 Transmissions and notifications 1 The Government of the Federal Republic of Germany shall draw up certified true copies of this Agreement and shall transmit them to the Governments of all signatory or acceding States. 2 The Government of the Federal Republic of Germany shall notify to the Governments of the States referred to in paragraph 1: a) any signature; b) the deposit of any instrument of ratification or accession; c) the date of entry into force of this Agreement; d) Article 8 any denunciation received pursuant toand the date on which it will take effect. 3 The Government of the Federal Republic of Germany shall register this Agreement with the Secretariat of the United Nations. 2001 21 06-02-2001 2008 62 14-04-2008 01-05-2008

Artikel 1 Vrijstelling van vertaalvereisten 1 artikel 65, eerste lid, van het Europese Octrooiverdrag Elke Staat die Partij is bij dit Verdrag en een officiële taal heeft die tevens een van de officiële talen van het Europees Octrooibureau is, verleent vrijstelling van de vertaalvereisten voorzien in. 2 artikel 65, eerste lid, van het Europese Octrooiverdrag Elke Staat die Partij is bij dit Verdrag en geen officiële taal heeft die tevens een van de officiële talen van het Europees Octrooibureau is, ziet af van de vertaalvereisten voorzien in, indien het Europese octrooi is verleend in de door die Staat voorgeschreven officiële taal van het Europees Octrooibureau, of in die taal is vertaald en verstrekt overeenkomstig de in artikel 65, eerste lid, van het Europese Octrooiverdrag, genoemde voorwaarden. 3 artikel 65, eerste lid, van het Europese Octrooiverdrag De in het tweede lid bedoelde Staten behouden het recht te eisen dat een vertaling van de conclusies in een van hun officiële talen wordt verstrekt overeenkomstig de ingenoemde voorwaarden. 4 Niets in dit Verdrag wordt uitgelegd als een beperking van het recht van de Staten die Partij bij dit Verdrag zijn om af te zien van vertaalvereisten of om minder strikte vertaalvereisten toe te passen dan die bedoeld in het tweede en derde lid. 2001 133 16-08-2001 2008 62 14-04-2008 01-05-2008

Artikel 2 Vertaling in geval van geschil Niets in dit Verdrag wordt uitgelegd als een beperking van het recht van de Staten die Partij zijn bij dit Verdrag om voor te schrijven dat, in geval van een geschil inzake een Europees octrooi, de houder van het octrooi, voor eigen rekening, a. op het verzoek van een vermeende inbreukpleger een volledige vertaling verstrekt in een officiële taal van de Staat waarin de vermeende inbreuk heeft plaatsgevonden, b. op het verzoek van de bevoegde rechterlijke instantie of semi-rechterlijke instantie in de loop van rechtsgedingen, een volledige vertaling verstrekt in een officiële taal van de betrokken Staat. 2001 133 16-08-2001 2008 62 14-04-2008 01-05-2008

Artikel 3 Ondertekening – Bekrachtiging 1 Europese Octrooiverdrag Dit Verdrag staat open voor ondertekening door elke Verdragsluitende Staat bij hettot 30 juni 2001. 2 Dit Verdrag dient te worden bekrachtigd. Artikel 4 Toetreding artikel 3, eerste lid Europese Octrooiverdrag Dit Verdrag staat, na het verstrijken van de in, genoemde termijn voor ondertekening, open voor toetreding door elke Verdragsluitende Staat bij heten elke Staat die gerechtigd is toe te treden tot dat Verdrag. Artikel 5 Verbod van voorbehouden Geen Staat die Partij is bij dit Verdrag kan hierbij voorbehouden maken. 2001 133 16-08-2001 2008 62 14-04-2008 01-05-2008

Artikel 6 Inwerkingtreding 1 Europese Octrooiverdrag Dit Verdrag treedt in werking op de eerste dag van de vierde maand na de nederlegging van de laatste akte van bekrachtiging of toetreding door acht Verdragsluitende Staten bij het, met inbegrip van de drie Staten waarin in 1999 de meeste Europese octrooien van kracht zijn geworden. 2 Elke bekrachtiging of toetreding na de inwerkingtreding van dit Verdrag wordt van kracht op de eerste dag van de vierde maand na de nederlegging van de akte van bekrachtiging of toetreding. 2001 133 16-08-2001 2008 62 14-04-2008 01-05-2008

Artikel 7 Duur van het Verdrag Dit Verdrag wordt voor onbeperkte tijd gesloten. 2001 133 16-08-2001 2008 62 14-04-2008 01-05-2008

Artikel 8 Opzegging Elke Staat die Partij is bij dit Verdrag kan haar te allen tijde opzeggen, zodra zij gedurende drie jaar van kracht is geweest. De opzegging wordt medegedeeld aan de Regering van de Bondsrepubliek Duitsland. De opzegging wordt van kracht een jaar na de ontvangst van deze mededeling. Artikel 9 Toepassingsgebied Dit Verdrag is van toepassing op Europese octrooien ten aanzien waarvan de vermelding van de verlening openbaar is gemaakt in het Europees Octrooiblad nadat het Verdrag voor de betrokken Staat in werking is getreden. 2001 133 16-08-2001 2008 62 14-04-2008 01-05-2008

Artikel 10 Talen van het Verdrag Dit Verdrag wordt opgesteld in één exemplaar in de Duitse, de Engelse en de Franse taal, dat wordt nedergelegd bij de Regering van de Bondsrepubliek Duitsland, zijnde de drie teksten gelijkelijk authentiek. 2001 133 16-08-2001 2008 62 14-04-2008 01-05-2008

Artikel 11 Toezendingen en mededelingen 1 De Regering van de Bondsrepubliek Duitsland vervaardigt van dit Verdrag voor eensluidend gewaarmerkte afschriften en zendt deze toe aan de Regeringen van alle Staten die haar hebben ondertekend of hiertoe zijn toegetreden. 2 De Regering van de Bondsrepubliek Duitsland doet aan de Regeringen van de in het eerste lid bedoelde Staten mededeling van: De Regering van de Bondsrepubliek Duitsland laat dit Verdrag registeren bij het Secretariaat van de Verenigde Naties. a. elke ondertekening; b. de nederlegging van elke akte van bekrachtiging of toetreding; c. de datum van inwerkingtreding van dit Verdrag; d. artikel 8 elke ingevolgeontvangen opzegging en de datum waarop deze van kracht wordt. 2001 133 16-08-2001 2008 62 14-04-2008 01-05-2008
